45 Annual Local Waiting Restriction Programme

The Committee considered the Report of the Chief Officer for Highways, Infrastructure Development and Waste (HIW/18/90) on the Annual Local Waiting Restriction Programme which had previously been presented to this Committee on 12 July 2018.

A significant number of objections and comments had been received since the advertisement of the agreed proposals, details of which were shown in Appendix I to the Report with plans of the proposals shown in Appendix II.

It was MOVED by Councillor Hughes, SECONDED by Councillor Twiss and

RESOLVED

(a) that work on the annual waiting restrictions programme process for 2019/20 be noted;

(b) that the recommendations contained in Appendices I and II to Report HIW/18/90) be agreed and the proposals implemented where relevant, subject to:-

ENV5666/14(A) Frog Lane, – that a site visit be arranged and that a decision on the matter be delegated to the Chief Officer for Highways, Infrastructure Development and Waste in consultation with the Local Member and Chair;

(c) that the proposals detailed in Appendices I and II to Report HIW/18/90) which attracted no objections be implemented as advertised.

* 46 Experimental Road Closure

(Councillor Sean Wheeldon from the Clyst Honiton Parish Council attended under the Council’s Public Participation Scheme and spoke in support of the proposed recommendations.)

The Committee considered the Report of the Head of Planning, Transportation and Environment and Chief Officer for Highways, Infrastructure Development and Waste (PTE/18/52) which proposed the permanent closure of the road through Clyst Honiton village, as outlined in Appendix I to the Report.

An experimental traffic regulation order prohibiting motor vehicles had been introduced on 9 November 2017 when the roundabout arm to Clyst Honiton was closed off with concrete barriers. Following the statutory six-month consultation period, the majority of feedback received was in favour of a permanent closure.

Members commended the Clyst Honiton Parish Council and the Council for their joint working on this matter.

It was MOVED by Councillor Bloxham, SECONDED by Councillor Randall-Johnson and

RESOLVED

(a) that responses to the advertised Traffic Regulation Order be noted;

(b) that a decision on the modification to the prohibition order be delegated to the Chief Officer for Highways, Infrastructure Development and Waste in consultation with the Local Members and Chair; and

(c) that authority for approval of minor amendments to the proposed scheme be delegated to the Chief Officer for Highways, Infrastructure Development and Waste.

* 47 - Residents Parking Consultation

The Committee considered the Report of the Chief Officer for Highways, Infrastructure Development and Waste (HIW/18/91) outlining the findings of a recent parking consultation undertaken in Sidmouth and parts of .

The level of response from the public indicated support for the introduction of residents’ parking restrictions in the vicinity of the town centre, as detailed in Appendix III, and funding for the scheme had been secured.

Members noted that other areas in Devon shared the same parking problems as Sidmouth and, similarly, could be explored at a future meeting of the Committee.

It was MOVED by Councillor Hughes, SECONDED by Councillor Twiss and

RESOLVED

(a) that the results of the consultation be noted;

(b) that the advertising of a traffic regulation order to introduce a residents’ parking scheme in areas of Sidmouth as described in Report HIW/19/91), subject to the detailed design being agreed with the local Member, be approved; and

(c) that a separate consultation exercise be undertaken in the wider Sidford area to better understand the views of all residents.

* 48 Hulham Road, Exmouth Petition

The Committee received the Report of the Head of Planning, Transportation and Environment and the Chief Officer for Highways, Infrastructure Development and Waste (PTE/18/53) which considered the actions in response to a petition received by the Cabinet on 4 October 2017 stating that “We the undersigned request that speed cameras are installed in Hulham Road as soon as possible as a deterrent to speeding vehicles”.

The Council and Devon and Cornwall Police had developed a joint procedure to allow concerns to be assessed in a consistent manner. This was called the Speed Compliance Action Review Forum (SCARF) which made use of data to ensure assessment of complaints was evidence based. Since receipt of the petition, speed data had been gathered by both Devon and Cornwall Police and the Council in separate covert operations, at locations agreed with the local Member.

The Committee heard that any issues relating to this should be reported to local Members for consideration by SCARF.

It was MOVED by Councillor Trail, SECONDED by Councillor Scott and

RESOLVED

(a) that Hulham Road, Exmouth be considered by the Speed Compliance Action Review Forum (SCARF); and

(b) that actions arising from the SCARF process be undertaken by the appropriate authority.

* 49 Lay-bys alongside B3174 Cranbrook

(In accordance with Standing Order 23(2) Councillor Bloxham had requested that the Committee consider this matter.)

(Ms P Werhun attended under the Council’s Public Participation Scheme and spoke in support of the proposals.)

The Committee considered the Report of the Local Member which proposed the closure of the two lay-bys located on opposite sides of the B3174 at Cranbrook and that the design of an east/west cycleway to and from Cranbrook/Exeter be brought forward.

The two lay-bys in question were principally used by HGVs for overnight parking as they provided a free location overnight. This resulted however in considerable disturbance to adjacent residents and a series of complaints had been received about noise disturbance especially overnight from refrigerated units and engines left running during the early hours. Instances of anti-social behaviour had also been reported.

Discussion points with Members and Officers covered:-

 the cycleway would likely travel along Roman Way and not across the lay-bys;  if a traffic regulation order was placed on the lay-bys, it could not be enforced overnight;  options for blocking off the lay-bys, e.g. barriers, earth or fencing;  how the lay-bys provided a place for HGV drivers to stop for rest breaks;  if the A30 suffered a closure, the B3174 provided a diversion route where lay-by facilities would be required; and  no funding was available; therefore funding sources would need to be identified.

It was MOVED by Councillor Bloxham, SECONDED by Councillor Twiss and

(a) that the two lay-bys located on opposite sides of the highway on the B3174 at Cranbrook (approximately 100m west of Parsons Lane) be closed to vehicle use by some means to be identified by the Chief Officer for Highways, Infrastructure Development and Waste; and

(b) that the design of the east/west cycleway to operate in parallel with the B3174 be brought forward.

* 50 Action Taken Under Delegated Powers

The Committee received the Report of the Chief Officer for Highways, Infrastructure and Waste (HIW/18/92) on action taken by her in consultation with the Chair and local Members.

* 51 Dates of Future Meetings

Future meetings of the Committee would take place on14 March, 18 July and 22 November 2019 at the new East Devon District Council’s offices at Blackdown in Honiton.

Annual Local Waiting Restriction Programme

Report of the Chief Officer for Highways, Infrastructure Development and Waste

Please note that the following recommendation is subject to consideration and determination by the Committee before taking effect.

Recommendation: It is recommended that work on the annual waiting restrictions programme process for 2019/2020 is noted.

1. Background

This report updates members on progress with the 4th year of this project, which is a countywide initiative. The project is intended to deliver only non-contentious proposals unlikely to attract substantial objection.

2. Proposal

To ensure that proposals can be delivered within the 2019/20 financial year, a closing date of 18 January 2019 for submission of proposals has been agreed with the Cabinet Member for Highway Management. Proposals received are listed in Appendix I to this report.

3. Consultations

Individual members will be contacted over the coming weeks regarding proposals within their divisions and it is also intended to gauge the support of Parish and Town Councils prior to advertising.

Following advertisement:

 Proposals which do not attract objections will be implemented without the need to report back to Committee.  Proposals attracting significant objections will be reported to the next East Devon HATOC on 18 July 2019.

4. Financial Considerations

The total costs of the scheme are contained within a countywide budget of £100,000 which has been allocated from the On Street Parking Account.

There will be a cost to the Council in advertising a new Traffic Order for each Committee Area, this will be approximately £1,500. In addition, the costs of any changes to signing or lining will be attributed to that Order.

5. Environmental Impact Considerations

The proposals are intended to rationalise on street parking and improve mobility and access within the district and are designed to:

 Encourage turnover of on street parking to benefit residents and businesses.  Enable enforcement to be undertaken efficiently.  Encourage longer term visitors to use off street car parks.  Encourage commuters to make more sustainable travel choices eg Car Share, Public Transport, Walking and Cycling.  Assist pedestrians and other vulnerable road users in crossing the highway.

The Environmental effects of the scheme are therefore positive.

6. Equality Considerations

There are not considered to be any equality issues associated with the proposals. The impact will therefore be neutral.

7. Legal Considerations

The lawful implications and consequences of the proposal have been considered and taken into account in the preparation of this report.

When making a Traffic Regulation Order it is the County Council’s responsibility to ensure that all relevant legislation is complied with. This includes Section 122 of the Road Traffic Regulation Act 1984 that states that it is the duty of a local authority, so far as practicable, secures the expeditious, convenient and safe movement of traffic and provision of parking facilities. It is considered that the proposals comply with Section 122 of the Act as they practically secure the safe and expeditious movement of traffic in the East Devon District.

8. Risk Management Considerations

There are thought to be no major safety issues arising from the proposals.

9. Public Health Impact

There is not considered to be any public health impact.

10. Reasons for Recommendations

The proposals rationalise existing parking arrangements within the East Devon District by:

 Encouraging turnover of on street parking to benefit residents and businesses  Enabling enforcement to be undertaken efficiently.  Encouraging longer term visitors to use off street car parks.  Encouraging those working in the town make more sustainable travel choices eg Car Share, Public Transport, Walking and Cycling.

The proposals contribute to the safe and expeditious movement of traffic in the East Devon District and therefore comply with S 122 of the Road Traffic Regulation Act 1984.

A376 Exmouth Exeter Road Pedestrian & Cycle Crossing

Report of the Head of Planning, Transportation and Environment

Please note that the following recommendation is subject to consideration and determination by the Committee before taking effect.

Recommendation: It is recommended that the scheme shown on plan C12021-010 included in Appendix I, is approved for construction at an estimated cost of £97,500.

1. Introduction

The report seeks scheme approval to construct a new signal controlled “Toucan” pedestrian and cycle crossing on the A376, Exeter Road, Exmouth. The proposed crossing will connect northern Exmouth to the Exe Estuary Trail via the National Trust, Lower Halsdon Farm public path.

2. Proposal

The scheme shown on Plan C12021-010 in Appendix I incorporates a new signal-controlled Toucan crossing facility, catering for both pedestrians and cyclists. The crossing is located on the A376 Exeter Road at the site of the entrance to the Lower Halsdon Farm path. The Lower Halsdon Farm path is labelled on the plan as an “existing shared path” to the western side of Exeter Road and it provides cycling and walking access to the Exe Estuary Trail for onward leisure links into the town or to Lympstone, Exeter and Dawlish. The scheme proposal incorporates minor footpath widening on the eastern side of Exeter Road to enable cyclists using the crossing to access a shared path into Estuary View. Estuary View joins Littlemead Lane which offers potential for a future connection for cyclists into the rear of A la Ronde.

Plan C12021-010 identifies an existing safety camera (speed camera) site to the south east of the proposed crossing. This safety camera site enforces southbound traffic traveling on the A376 into Exmouth. The proposed crossing has been located to the north of this camera site to avoid interference with the camera’s operation and detection markings.

The proposed crossing also provides a safe pedestrian facility for residential properties to cross the A376 and access bus stops or other local facilities in the town.

3. Options/Alternatives

Potential locations for establishing a new crossing and associated cycle links to A la Ronde were considered in partnership with the National Trust back in 2011/12. Following the opening of the Lower Halsdon Farm path in 2017, the proposed location of the Toucan crossing has now been identified to provide the most direct future link to A la Ronde.

Alternatives were considered to the south by either linking into Lamplough Road or into Rivermead Avenue. These alternatives would require significant costs to widen pavements for cycle use and would also have required the relocation or removal of an established safety camera site.

The proposed location minimises any widening of footpaths along Exeter Road and is situated to the north of the safety camera site to avoid any conflict with its operation.

An alternative for providing a shared use “Tiger” crossing without signal control was considered. But it was recommended that a signalised crossing would provide the greatest safety benefits for pedestrians and cyclists in this location.

4. Consultations

The National Trust undertook a public consultation exercise in 2011/12 regarding future options for community use of the land at Lower Halsdon Farm. The National Trust worked with DCC to identify options for a multiuse trail link between the Exe Estuary and A la Ronde including a crossing facility over the A376.

Following opening of the Lower Halsdon Farm path, the local County members for Exmouth and the National Trust, were contacted again to confirm continued support for providing an improved crossing facility over the A376 corridor.

To introduce any new controlled crossing, the scheme proposal will need to be advertised by public notice prior to construction.

5. Financial Considerations

The estimated scheme cost of the scheme is £97,500. The estimate includes an allowance for contingencies and also for night working to minimise disruption to traffic on the A376. It is proposed that the scheme will be funded through the Integrated Block element of the 2019/20 Transport Capital Programme.

Subject to scheme and budget approvals, it is intended that construction can take place in the first quarter of 2019/20 prior to the summer holiday period.

6. Environmental Impact Considerations

By promoting sustainable alternatives to travel by car, the proposal will have a minor but positive effect on vehicle emissions and the environment.

7. Equality Considerations

An Equality Impact and Needs Assessment (EINA) was undertaken for the Local Transport Plan. No negative impacts were identified. No new policies are being recommended in this report and therefore an individual Equality Impact and Needs Assessment for the scheme is not considered necessary.

8. Legal Considerations

To introduce a new or amended pedestrian crossing a public notice will be required to be advertised in accordance with Section 23 of The Road Traffic Regulation Act.

9. Risk Management Considerations

A controlled crossing will introduce delays to traffic on the A376 at peak times.

10. Public Health Impact

Improved crossing facilities will enhance links between residential areas and the established multiuse-trail leisure network. This will have a positive effect on promoting healthy and sustainable travel within the community.

11. Reasons for Recommendations

It is recommended that the scheme be approved for construction to support pedestrian and cyclist safety and to improve access to leisure and local facilities.

Stopping up of public highway; Land at North Street, Exmouth

Report of the Chief Officer for Highways, Infrastructure Development and Waste

Please note that the following recommendations are subject to consideration and determination by the Committee before taking effect.

Recommendation: It is recommended that:

(a) the extent of highway land at North Street, Exmouth, as detailed in Appendix I, is not needed for public use; and (b) this Committee resolves that subject to the consultations referred to in section 4, makes an application to the magistrates’ court for an order under Section 116 of the Highways Act 1980 that the said highway land be stopped up.

1. Introduction

Under Section 116 of the Highways Act 1980, Devon County Council can make an application to a magistrates’ court to stop up a section of highway if they think it is unnecessary.

We have received representation from Michelmores solicitors that their client, Devon & Cornwall Police, wishes to apply for a stopping up order so that the land in question (as shown in Appendix I) no longer forms part of the public highway.

The land in question is unregistered with the Land Registry and would revert to Devon & Cornwall Police Authority as the adjacent land owner.

2. Proposal

It is recommended that an application is made to the Magistrates' Court under Section 116 of the Highways Act 1980 for the stopping-up of part of the public highway in North Street, Exmouth as shown on the Drawing attached as Appendix I.

3. Alternatives

Devon County Council could refuse the application but would have no specific reasons for doing so.

4. Consultations

A number of organisations have been contacted on the proposal and a summary of the consultees and their response can be found in Appendix II.

Responses are still outstanding for Exmouth Town Council and East Devon District Council who have until 25 March 2019 to respond. If a response is received prior to the deadline then it will be discussed with the local County Council member and chair before a final decision is made whether to proceed with the application to the Magistrates Court.

5. Financial Considerations

There are no financial implications to this proposal as all costs will be met by the applicant.

6. Environmental Impact Considerations

There are no environmental impacts in relation to this proposal.

7. Equality Considerations

There are no equality considerations in relation to this proposal.

8. Legal Considerations

Under Section 116 of the Highways Act 1980 a highway authority can apply to a magistrates’ court to stop up highway on the ground that it is ‘unnecessary’. Whether a highway is unnecessary is a question of fact. It should be unnecessary for the sort of purpose for which the public might reasonably be expected to use it, for example, to reach a specific destination or for recreational purposes.

Only a highway authority can apply to a magistrates’ court for a stopping up order. A highway authority has discretion on whether or not to make an application. However, this discretion is capable of being judicially reviewed. It should therefore have good reason for not making an order.

9. Risk Management Considerations

No risks have been identified.

10. Public Health Impact

There are no implications of the proposals on public health in the area.

11. Reasons for Recommendations

In summary it is recommended that the Committee approve the request for an application to the magistrates’ court for a stopping up order on the land at North Street, Exmouth described above, as the land is not needed for public use and is unnecessary as public highway.
