RECOMMANDATION DU RAPPORT Que le Comité des finances et du développement économique reçoive le présent rapport à titre d'information. DISCUSSION The Delegation of Authority By-law (By-law No. 2012-109) was approved by City Council on 11 April 2012 and provides Delegated Authority to approve and conclude Real Estate transactions involving Acquisitions, Disposals and Leasing of Real Property. Sections 60 and 63 of Schedule “C” of the By-law provide the Delegated Authority to approve and conclude real property transactions at four staff levels. In addition, By-Law No. 2013-103 approved by City Council on 10 April 2013 amended Section 60 and Section 63 of Schedule “C” of the Delegation of Authority By-law (By-law No. 2012-109) to increase the financial authority delegated to various City staff for real estate transactions involving acquisitions and disposals. Delegated authority to approve and conclude Real Estate transactions dealing with acquisition and disposal of real property are subject to the provisions of the Disposal of Real Property Policy, the Disposal of Real Property Procedures and the Acquisition of Real Property Corporate Policy. Prior to the acquisition or disposal by Delegated Authority, all criteria of the said By-law and Policy must be met. Subsections 60(6) and 63(5) of Schedule “C” of By-law 2012-109 require that the exercise of Delegated Authority shall be reported to the Finance and Economic Development Committee on a semi-annual basis. This report covers the first half of the reporting period for 2013. These transactions are detailed in Document 1 attached to this report. The Real Estate Partnerships and Development office (REPDO) certifies that all transactions approved under Delegation of Authority for the period of 1 January to 30 June 2013 are in compliance with the Delegation of Authority By-law and Disposal By- law. RURAL IMPLICATIONS There are no rural implications associated with this report. CONSULTATION Public notification of this report will occur through normal notification process. LEGAL IMPLICATIONS There are no legal impediments to receiving the report for information. RISK MANAGEMENT IMPLICATIONS There are no risk management implications associated with this report. FINANCIAL IMPLICATIONS Prior to transaction approval, Realty Services staff confirms with Finance staff that the appropriate funds are available in the budget. The availability of funds is a condition and requirement of approval under Delegated Authority. ACCESSIBILITY IMPACTS There are no accessibility impacts associated with this report. TECHNOLOGY IMPLICATIONS There are no technological implications associated with this report. TERM OF COUNCIL PRIORITIES The real estate acquisition, disposal and lease transactions approved under Delegation of Authority for the period of 1 January to 30 June 2013 support the following strategic priorities of City Council: Transportation and Mobility (TM) – meet the current and future transportation and mobility needs of residents by improving transit and by emphasizing choice and accessibility of multiple types of transportation; and its objectives TM1 - ensure sustainable transit services by offering reliable travel options at the lowest possible cost and in a financial and operationally sustainable way; and TM3 – provide infrastructure to improve mobility choices by supporting a variety of initiatives related to routes and rapid transit. Financial Responsibility (FS) – practice prudent fiscal management of existing resources and make sound long-term choices that allow core City services to be sustainable now and into the future; and its objective FS2 - maintain and enhance the City’s financial position. Governance, Planning and Decision-Making (GP) - apply a sustainability lens to decision-making; and its objective GP3 - make sustainable choices and ensure that long-term impacts on the City and the quality of life of its residents are considered when making decisions about how the City’s assets are managed, and how rural and urban areas are developed.
