All Title IV aid awarded to such eligible students must be based on an EFC of zero without regard to the student’s calculated EFC. To qualify for this scholarship, a student must be Pell-eligible and have a Pell-eligible EFC (up to 5486 for the 2018-2019 award year), and be less than 24 years of age or enrolled at an institution of higher education at the time of his or her parent’s or guardian’s death. In subsequent award years, the student continues to be eligible for the scholarship, as long as the student has a Pell-eligible EFC and continues to be an eligible student.     TIME OVER MATTER: MEASURING THE REASONABLENESS OF OFFICER CONDUCT IN § 1983 CLAIMS Evelyn Michalos* In the United States, far more police encounters result in civilian and officer deaths than in other democratic countries. When a government actor uses excessive force against an individual during an arrest or investigatory stop in violation of the Fourth Amendment right against unreasonable seizure, 42 U.S.C. § 1983 provides a federal civil remedy for that individual. In Graham v. Connor and Tennessee v. Garner, the U.S. Supreme Court held that courts should assess the reasonableness of an officer’s use of force to seize an individual in light of the “totality of the circumstances,” which includes the severity of the crime, whether the suspect actively resisted arrest, and whether the suspect posed a threat to the officers and bystanders. However, the Court has never delineated how lower courts should assess the totality of the circumstances in excessive force claims under § 1983. Thus, circuit courts have applied varying methods to analyze law enforcement’s use of force. This Note examines whether the Second Circuit’s narrow approach, the Third Circuit’s broad approach, or the Seventh Circuit’s segmented approach properly identifies the circumstances to consider when measuring the reasonableness of officers’ uses of force during a seizure in § 1983 claims. This Note compares the three circuit court approaches to how Canadian courts evaluate the reasonableness of police conduct in excessive force claims. Ultimately, this Note concludes that the Third Circuit’s approach, which considers causally relevant conduct, such as preseizure conduct, is truest to the notion of “totality” and should be the uniform method.

    LASD Peace Officers Killed in the Line of Duty By Deputy Chris Miller (retired) & Lieutenant John Stanley As of this writing, 123 peace officers assigned to the Los Angeles Sheriff’s Department, or one of the eleven law enforcement agencies that it has either absorbed or merged with, have been recognized as being killed in the line of duty since the formation of Los Angeles County in 1850. Prior to 1971, each department in Los Angeles County honored their fallen heroes in their own way. It was not until May 14th of that year that the Los Angeles County Memorial was dedicated at Biscailuz Center in East Los Angeles. All agencies that lost peace officers while serving within the borders of Los Angeles County were invited to submit the names of their fallen officers. Plaques for the 258 peace officers lost in the County’s first 113 years were dedicated at that time. It was not until May 13th, 1988 that the California Peace Officer’s Memorial monument was dedicated in Sacramento and the National Peace Officer Memorial in Washington, D.C was not dedicated until October 15th, 1991. In the long decades before the honoring of fallen peace officers was contemplated on memorials, the recognition of the on duty ultimate sacrifice of lawmen was uneven at best. Even today the line of duty deaths of peace officers from the past are still being discovered. When the County, State and National memorials were first created they accepted the names of peace officers submitted to them by local agencies without question.

    GREELEY POLICE DEPARTMENT General Order 357.00 Reviewed: 01/19 357.00 LINE OF DUTY DEATH 357.01 Definitions: Line-of-Duty Death: Any action, felonious, accidental or natural, which claims the life of a Greeley Police Officer who is performing work-related functions either while on or off duty. Survivors: Immediate family members of the deceased officer: spouse, children, parents, siblings, fiancée, and/or significant others. Beneficiary: Those designated by the officer as recipient(s) of specific death benefits. Benefits: Financial payments made to the family to insure financial stability following the loss of a loved one. Funeral Payments: Financial payments made to the surviving family of an officer killed in the line-of-duty, which are specifically earmarked for funeral expenses. 357.02 Procedures and Responsibilities: It shall be the responsibility of the Chief of Police or a Deputy Chief (NOTIFICATION OFFICER) in cooperation with the Coroner’s Office to properly notify the next of kin of an officer who has suffered severe injuries or died. The name of the deceased officer must NEVER be released by the department before the survivors are notified. If there is knowledge of a medical problem with an immediate survivor, medical personnel should be available at the residence to coincide with the death notification. The family should learn of the death from the department first and not from the press or other sources. If there is an opportunity to get to the hospital prior to the demise of the officer, DO NOT wait. If the family requests to visit the hospital, they should be transported by police department vehicle.
