THESIS POLYGAMY ON THE WEB: AN ONLINE COMMUNITY FOR AN UNCONVENTIONAL PRACTICE Submitted by Kristen Sweet-McFarling Department of Anthropology In partial fulfillment of the requirements For the Degree of Master of Arts Colorado State University Fort Collins, Colorado Summer 2014 Master’s Committee: Advisor: Lynn Kwiatkowski Cindy Griffin Barbara Hawthorne Copyright by Kristen Sweet-McFarling 2014 All Rights Reserved ABSTRACT POLYGAMY ON THE WEB: AN ONLINE COMMUNITY FOR AN UNCONVENTIONAL PRACTICE This thesis is a virtual ethnographic study of a polygamy website consisting of one chat room, several discussion boards, and polygamy related information and links. The findings of this research are based on the interactions and activities of women and men on the polygamy website. The research addressed the following questions: 1) what are individuals using the website for? 2) What are website members communicating about? 3) How are individuals using the website to search for polygamous relationships? 4) Are website members forming connections and meeting people offline through the use of the website? 5) Do members of the website perceive the Internet to be affecting the contemporary practice of polygamy in the U.S.? This research focused more on the desire to create a polygamous relationship rather than established polygamous marriages and kinship networks. This study found that since the naturalization of monogamous heterosexual marriage and the nuclear family has occurred in the U.S., due to a number of historical, social, cultural, political, and economic factors, the Internet can provide a means to denaturalize these concepts and provide a space for the expression and support of counter discourses of marriage, like polygamy.

DOUBLE TAKE: THE LAW OF EMBEZZLED LIvEs Lawrence M Friedman* JoannaL. Grossman** I. INTRODUCTION There was tremendous public sympathy for Notre Dame football player Manti Te'o, whose girlfriend, Lennay Kekua, had tragically died of leukemia. The sympathy, it turns out, was misplaced. Kekua never died because she never lived.' She was an internet hoax-a woman Te'o thought he loved, and with whom he had communicated over a long period of time, but who in fact had been created by jokesters. 2 Te'o appears to have been "catfished"-a modern term which means duped by a fake internet identity. A 2010 documentary, Catfish, depicted a man who meets a woman online and falls for her, only to learn later her identity was a far cry from the one portrayed on the Internet.3 In a television series of the same name, we see more unsuspecting people "catfished"-victims of an online dating hoax whose excitement and then humiliation are chronicled for viewer entertainment.4 "Catfishing" claimed Manti Te'o as one of its early victims.5 At the heart of "catfishing" is a basic problem-how do we ever know whether people are who they say they are? Mr. Peay's Horses: The Federal Response to Mormon Polygamy, 1854 - 1887 Mary K. Campbellt I. INTRODUCTION Mr. Peay was a family man. From a legal standpoint, he was also a man with a problem. The 1872 Edmunds Act had recently criminalized bigamy, polygamy, and unlawful cohabitation,1 leaving Mr. Peay in a bind. Peay had married his first wife in 1860, his second wife in 1862, and his third wife in 1867.2 He had sired numerous children by each of these women, all of whom bore his last name.3 Although Mr. Peay provided a home for each wife and her children, the Peays worked the family farm communally, often taking their meals together on the compound.4 How could Mr. Peay abide by the Act without abandoning the women and children whom he had promised to support? Hedging his bets, Mr. Peay moved in exclusively with his first wife. 5 Under the assumption that "cohabitation" required living together, he ceased to spend the night with his other families, although he continued to care for them. 6 After a jury convicted him of unlawful cohabitation in 1887,7 he argued his assumption to the Utah Supreme Court. As defense counsel asserted, "the gist of the offense is to 'ostensibly' live with [more than one woman.]' ' 8 In Mr. Peay's view, he no longer lived with his plural wives. The court emphatically rejected this interpretation of "cohabitation," declaring that "[a]ny more preposterous idea could not well be conceived."9 The use of the word "ostensibly" appeared to irritate the court.

BEFORE LOVING: THE LOST ORIGINS OF THE RIGHT TO MARRY Michael Boucai* Abstract For almost two centuries of this nation’s history, the basic contours of the fundamental right to marry were fairly clear as a matter of natural, not constitutional, law. The right encompassed marriage’s essential characteristics: conjugality and contract, portability and permanence. This Article defines those four dimensions of the natural right to marry and describes their reflections and contradictions in positive law prior to Loving v. Virginia (1967). In that landmark case, the Supreme Court enforced a constitutional “freedom to marry” just when marriage’s definitive attributes were on the brink of legal collapse. Not only did wedlock proceed in Loving’s wake to lose its exclusive claims to licit sex and legitimate procreation, personal autonomy in those very domains gained independent constitutional protection.
