Nineteenth Ce ntury The Magazine of the Victorian Society in America Volume 40 Number 1 Editorial The Artist’s Shadow The Winter Show at the Park Avenue Armory in New York City is always a feast for the eyes. Dazzling works of art, decorative arts, and sculpture appear that we might never see again. During a tour of this pop-up museum in January I paused at the booth of the Alexander Gallery where a painting caught my eye. It was an 1812 portrait of two endearing native-New Yorkers Schuyler Ogden and his sister, the grand-nephew and grand-niece of General Stephen Van Rensselaer. I am always sure that exhibitors at such shows can distinguish the buyers from the voyeurs in a few seconds but that did not prevent the gallery owner from engaging with me in a lively conversation about Fresh Raspberries . It was clear he had considerable affection for the piece. Were I a buyer, I would have very happily bought this little confection then and there. The boy, with his plate of fresh picked berries, reminds me of myself at that very age. These are not something purchased at a market. These are berries he and his sister have freshly picked just as they were when my sisters and I used to bring bowls of raspberries back to our grandmother from her berry patch, which she would then make into jam. I have no doubt Master Ogden and his beribboned sister are on their way to present their harvest to welcoming hands. As I walked away, I turned one last time to bid them adieu and that is when I saw its painter, George Harvey. -

My facial hair didn’t give me away. Nor did my obligatory bachelor on stage, drunk and dancing with strippers. -

It is our delight to share this year’s publication with you. After reviewing submissions representing a wide variety of disciplines, we selected the following eleven pieces to be featured in the anthology. The rigor of this selection process proves the continuing excellence of student writing at Central College. We offer our sincerest congratulations to the published student authors: you should be proud of your exemplary work. While the goals of specific disciplines are easy to spot in this diverse blend of essays, we hope you will also take notice of the recurring themes that connect them. Gretchen, in the first essay of this anthology, looks at the “future of the past” and considers a great tragedy in light of the creation it has engendered. The title of the final essay, “Rebirth,” encapsulates our overarching message. The rest of the authors take on the monumental task of creating a new way of looking at a subject, be it a landscape, a piece of art, or our own humanity. Creation and innovation are presented in the pieces you are about to read as valid, significant responses to destruction and decay. This anthology encompasses the cycle of life. Each year, The John Allen Award is granted to the individual exhibiting the highest quality of student writing. We are pleased to announce that Sydney Embray will receive the honor this year. -
The Mystery of the Alabama Confederate Monument
Devotion, Deception, and the Ladies Memorial Association, 1865-1898: The Mystery of the Alabama Confederate Monument michael panhorst he eighty-eight-foot tall Alabama Confederate Monument T(Figure 1) on Montgomery’s Capitol Hill stands in commemora- tion of the service and sacrifice of 122,000 Alabamians who fought for the Confederacy during the Civil War. Fund-raising for the $47,000 monument began in 1865 and was largely the work of white women, as was typical of Civil War memorial patronage in the South. The Ladies Memorial Association (LMA) raised most of the money through lengthy efforts involving bazaars and appeals to private do- nors and the state government. Due to pressing post-war needs for proper burial of many Confederate bodies lying in shallow battlefield graves, and the needs of widows, orphans, and Confederate veterans during Reconstruction, plus an economy slow to recover from the war, the cornerstone was not laid until 1886. More than 5,000 people witnessed Jefferson Davis perform that ceremony with full Masonic rites near the spot where he had taken the oath of office as the only President of the Confederacy. Another twelve years passed before the monument designed by New York sculptor Alexander Doyle (1857-1922) was completed with his handsome bronze finial figure of Patriotism and bronze relief sculpture of a generic battle scene en- circling the column. Granite statuary by Frederick Barnicoat (1857- 1942) of Quincy, Massachusetts, representing the Infantry, Artillery, Cavalry, and Navy was added by the patrons to complete Doyle’s design. The elaborate dedication on December 7, 1898 (near the michael panhorst is Curator of Art at the Montgomery Museum of Fine Arts. -

THE NEW LOCHNER AMANDA SHANOR* Commercial interests are increasingly laying claim, often successfully, to First Amendment protections. Once the mainstay of political liberty, the First Amendment has emerged as a powerful deregulatory engine—and one with great implications for modern governance. This Article identifies that development as a growing constitutional conflict between the First Amendment and the modern administrative state and analyzes its origins and implications. The Article traces two opposing trends that have led to that constitutional conflict. A business-led social movement has mobilized to embed libertarian-leaning understandings of the First Amendment in constitutional jurisprudence. At the same time, administrative regimes have moved away from command-and-control regulation towards lighter-touch forms of governance that appear more speech-regulating. The stakes of this conflict are high. Because nearly all human action operates through communication or expression, the First Amendment possesses near total deregulatory potential. For that reason, I argue that the First Amendment operates as the fullest boundary line of constitutional state action. I identify the unique features of this modern form of constitutional deregulation—which I call the new Lochner—by interrogating the parallel drawn by a growing number of scholars and judges between recent First Amendment jurisprudence and Lochner v. New York’s liberty of contract. The Article explores linkages between theories of the First Amendment and administrative law, and it analyzes the implications of the First Amendment’s deregulatory turn for understandings of democratic legitimacy, choice, and constitutional change. I argue that the new Lochner must be rejected because advocates of its deregulatory vision are forwarding a concept of liberty that has no limiting principle and, if taken to its analytical conclusion, would render self-government impossible. -

Iowa State Capitol VISITOR GUIDE PREFACE In 1969, State legislators called for the preparation of a booklet for distribution to State Capitol visitors to call attention to the beauties of the Iowa State Capitol Building, stating that “the citizens of the State of Iowa can point with justifiable pride to the magnificence of the architectural structure of their Capitol Building” and that “the history of the building is an important facet of the heritage and development of the State.” Following this tradition of showcasing the State Capitol building, the Legislative Services Agency, on behalf of the Iowa General Assembly, has created this revised Iowa State Capitol Visitor Guide devoted to presenting the building in a pictorial format to the public as one of the State’s most recognizable symbols and treasured landmarks. The book is intended to serve as a guided tour of the building and the surrounding grounds and monuments, as a reference guide, and as a lasting keepsake of a memorable visit to the Iowa State Capitol. Proceeds from the sale of the book, as with all Capitol Gift Shop merchandise, are used to maintain and expand the Gift Shop’s selection of State Capitol and Iowa-themed items and to support educational outreach activities conducted by the Capitol Tour Guides. Book layout and design assistance was provided by Heuss Printing in Ames, Iowa. Photographs were furnished by Gary Hoard Photography in Madrid, Iowa. HAWKES OUR LADY OF VICTORIES Civic monuments, erected in memory of famous people or events, also symbolize the ideals and aspirations of the society which builds them. Nowhere is this more true than in Victorian America, which became the home of what T. H. Bartlett, late nineteenth-century art critic, described as “the ghastliest army of forms and effigies called soldiers monuments, that has ever inflicted [sic] a people since the earth was made.”1 A well-established social code, a renewal of patriotism and a growing asthetic self-consciousness interacted with a booming economy in the post-Civil War period. The result was a proliferation of statuary and architecture commemorating America’s solidarity through the events and personages of the Great War of the Rebellion. This created, in turn, a new profession, attracting men and women able to interpret the society’s ideals into tangible yet artistic symbols. -

William T. Kane while he was University Librarian at Loyola University. Separations: None Biographical Sketch William Terence Kane, S.J., was born on October 20, 1880, in Chicago, one of six children of Lawrence and Elizabeth McCarthy Kane. He attended Holy Family School and St. Ignatius College before entering the Society of Jesus in 1898. During World War I (1918-1919) he was a Chaplain for the 35th Division, where Harry S. Truman was a major. In 1930 he was named University Librarian at Loyola University, Chicago, a position he retained until his death in 1946. While University Librarian, Father Kane established the Jesuitca and Napoleonica collections at the library, in addition to creating an archival collection documenting the university’s history, Jesuit history, and local Catholic history. Scope and Content The Kane Collection is comprised of 19.5 linear feet spanning the years 1829 to 1945. The collection includes correspondence, reports, journals, minutes, photographs, blueprints, drawings, programs, syllabi, flyers, booklets, theses, sheet music, and Photostat copies. Father Kane concentrated on collecting Loyola University, Jesuit, and local Catholic history. Languages found in the collection include English, French, Latin, Italian, and Spanish.
