Currently, SFPD General Order 9.06 requires mandatory towing of vehicles driven by a driver without a valid driver’s license, which often results in the impounding of vehicles for thirty days. The resulting impoundment fees can accumulate to several thousand dollars, which in many cases exceed the value of vehicle. Impoundment thus can effectively constitute a civil forfeiture, permanently depriving the owner of his or her vehicle when someone is found to be driving the vehicle without a valid license. In addition to exorbitant towing and impoundment fees, vehicle owners are deprived of their cars during the impoundment period, which can prevent the owners from commuting to work, taking their children to school or doing any of other tasks for which a car has become essential in today’s society. For individuals forced to live in their cars, impoundment can mean the loss of their home and all their possessions. SFPD’s policy has had a particularly harsh impact on poor and immigrant residents in San Francisco who are either unable to afford the costs of a valid California driver’s license or cannot obtain a California license under California law, which requires proof of legal immigration status.
