    Accountability for mass violence Examining the State’s record By Surabhi Chopra Pritarani Jha Anubha Rastogi Rekha Koli Suroor Mander Harsh Mander Centre for Equity Studies New Delhi May 2012 Preface Contemporary India has a troubled history of sporadic blood-letting in gruesome episodes of mass violence which targets men, women and sometimes children because of their religious identity. The Indian Constitution unequivocally guarantees equal legal rights, equal protection and security to religious minorities. However, the Indian State’s record of actually upholding the assurances in the secular democratic Constitution has been mixed. This study tries to map, understand and evaluate how effectively the State in free India has secured justice for victims of mass communal violence. It does so by relying primarily on the State’s own records relating to four major episodes of mass communal violence, using the powerful democratic instrument of the Right to Information Act 2005. In this way, it tries to hold up the mirror to governments, public authorities and institutions, to human rights workers and to survivors themselves. Since Independence, India has seen scores of group attacks on people targeted because of their religious identity1. Such violence is described in South Asia as communal violence. While there is insufficient rigorous research on numbers of people killed in religious massacres, one estimate suggests that 25,628 lives have been lost (including 1005 in police firings)2. The media has regularly reported on this violence, citizens’ groups have documented grave abuses and State complicity in violence, and government-appointed commissions of inquiry have gathered extensive evidence on it from victims, perpetrators and officials.

    India: Provide full protection to human rights defender Teesta Setalvad (Bangkok, 24 July 2015) - The Asian Forum for Human Rights and Development (FORUM-ASIA) strongly urges the Government of India and the Indian judiciary to drop all charges against the social activist Teesta Setalvad and to provide her the full protection she has a right to under national and international law. Teesta, who is accused of violating the Foreign Contribution Regulation Act (FCRA), is a well-known human rights defender who has worked tirelessly seeking justice for the victims of the 2002 Gulbarg Society Massacre in Gujarat. FORUM-ASIA strongly condemns the earlier decision today by the Mumbai Special Court not to grant Teesta anticipatory bail, and applauds that she was still granted bail later today by the Bombay High Court. “The Indian judiciary’s failure to reject the spurious charges against Teesta, demonstrates a worrying trend of the criminalisation of human rights defenders, which stifles their dissent,” comments Evelyn Balais- Serrano, Executive Director of FORUM-ASIA, “The rights of all human rights defenders should be protected at all times, and the judiciary must take measures to ensure that this is fulfilled.” On 8 July 2015, the Central Bureau of Investigation (CBI) filed a case against both Teesta and the NGO Citizens for Justice and Peace under sections 35, 37 of the Penal Code and sections 3, 11 and 19 of the Foreign Contribution Regulation Act (FCRA) based on alleged violations of the FCRA. Despite Teesta’s cooperation with the investigation, the CBI raided the office of Citizens for Justice and Peace and the residence of Teesta and Javed on 14 July 2015.

Acting on the application, the court has asked for call details of Ahsan Jafri’s landline number. The 2014 parliamentary election in India reduced Congress party to merely 44 seats in the lower house, big blow for a party whose history is integral the country’s founding narrative. In the last parliamentary election the Congress party polled only 19.3% of the votes declining from 28.6% in 2009, while on the other hand the main right wing party i.e. BJP won 282 parliamentary seats and 31% of the national votes. The extreme right-wing organisations have undoubtedly become the central pole of Indian politics. Moreover, its recent success in Uttar Pradesh provincial election, which is one of the most populated province with 215 million inhabitants, is the strongest evidence yet of the broader shift to the right and the BJP’s victory in UP state strengthens this shift. This paper intends to study the recent rise of extreme right-wing Hindu organisations in India. Most prominent among these organisations are RSS, BJP, VHP, Bajang Dal and Shiv Sena. However, all of them work together under the philosophy of Hindutva (i.e. Hindu-ness) and are rabidly anti-minority in their stance. The aim of this study is to highlight the recent rise in extreme right-wing Hindu organisations and to examine their ideas and philosophy regarding Indian history and culture. It is also useful to set this against a global context in which divisive and ultra-nationalist forces are on the rise within Europe and Donald Trump has assumed the US presidency.

To work for peace and reconciliation, fighting against cultural fascism in the society through cultural medium and trying to create the better society which will be Rational, Modern, Equal and Just. Changed focus-Changed Strategy-Changed Activities: Since the socio-cultural scenario has changed, issues have also changed in present society of Gujarat as well as the country also; our organization also needs to change the approach, strategy and the ‘language’ to address the society. It is a need of an hour to spread ideology of Peace and co-existence, Secularism and Rationality, Scientific approach towards life and Development with Social Justice. Gujarat carnage 2002 will complete 10 years in next few days. Some of the civil society organizations have decided to organize certain programs during next four months to remind the people of Gujarat that what we have done before 10 years is never pardonable. Still thousands of victims are weeping and waiting for justice. Still peace is a far away lighthouse, because there is no voice of remorse from our civil society or politicians. It was and still it is a shame for us. A Film-Festival on Communal Conflict and Idea of Social Justice: ‘FILMOGRAPH: ‘47-‘84-‘92-‘02’ is one of the programs organized by Darshan for above reasons and purposes. This film festival against communalism was organized from 3 to 6 December at Golden Jubilee Hall, St Xavier’s Loyola School, Memnagar, Ahmedabad. This festival showed four films (everyday one film at 7 pm evening) which are representing four major turning events of communalism in our society.
