Accountability for mass violence Examining the State’s record By Surabhi Chopra Pritarani Jha Anubha Rastogi Rekha Koli Suroor Mander Harsh Mander Centre for Equity Studies New Delhi May 2012 Preface Contemporary India has a troubled history of sporadic blood-letting in gruesome episodes of mass violence which targets men, women and sometimes children because of their religious identity. The Indian Constitution unequivocally guarantees equal legal rights, equal protection and security to religious minorities. However, the Indian State’s record of actually upholding the assurances in the secular democratic Constitution has been mixed. This study tries to map, understand and evaluate how effectively the State in free India has secured justice for victims of mass communal violence. It does so by relying primarily on the State’s own records relating to four major episodes of mass communal violence, using the powerful democratic instrument of the Right to Information Act 2005. In this way, it tries to hold up the mirror to governments, public authorities and institutions, to human rights workers and to survivors themselves. Since Independence, India has seen scores of group attacks on people targeted because of their religious identity1. Such violence is described in South Asia as communal violence. While there is insufficient rigorous research on numbers of people killed in religious massacres, one estimate suggests that 25,628 lives have been lost (including 1005 in police firings)2. The media has regularly reported on this violence, citizens’ groups have documented grave abuses and State complicity in violence, and government-appointed commissions of inquiry have gathered extensive evidence on it from victims, perpetrators and officials. -

India: Provide full protection to human rights defender Teesta Setalvad (Bangkok, 24 July 2015) - The Asian Forum for Human Rights and Development (FORUM-ASIA) strongly urges the Government of India and the Indian judiciary to drop all charges against the social activist Teesta Setalvad and to provide her the full protection she has a right to under national and international law. Teesta, who is accused of violating the Foreign Contribution Regulation Act (FCRA), is a well-known human rights defender who has worked tirelessly seeking justice for the victims of the 2002 Gulbarg Society Massacre in Gujarat. FORUM-ASIA strongly condemns the earlier decision today by the Mumbai Special Court not to grant Teesta anticipatory bail, and applauds that she was still granted bail later today by the Bombay High Court. “The Indian judiciary’s failure to reject the spurious charges against Teesta, demonstrates a worrying trend of the criminalisation of human rights defenders, which stifles their dissent,” comments Evelyn Balais- Serrano, Executive Director of FORUM-ASIA, “The rights of all human rights defenders should be protected at all times, and the judiciary must take measures to ensure that this is fulfilled.” On 8 July 2015, the Central Bureau of Investigation (CBI) filed a case against both Teesta and the NGO Citizens for Justice and Peace under sections 35, 37 of the Penal Code and sections 3, 11 and 19 of the Foreign Contribution Regulation Act (FCRA) based on alleged violations of the FCRA. Despite Teesta’s cooperation with the investigation, the CBI raided the office of Citizens for Justice and Peace and the residence of Teesta and Javed on 14 July 2015. -

The root of the riot is the CAA, NRC and NPR which discriminate Muslim community from other religious groups. There was an immediate protestation and demonstration starting with the student communities in various states and also many states. The demonstrations were more naturally in Delhi. Apparently the BJP had brought in their parivar from some other state and made themselves ready for to start of a massacre. The Police force were also supporting the killlings and stone throwing. On the brighter side of it, many of the Hindu communities stood up for their neighbors. I have been trying make sense of it all and was collecting the news as they emerged from various sources. This is simply a collection of cut and paste of those. This is done so that the coming generations will not forget what happened to India under BJP. History will stand testimony. Ms. Setalvad and Mr. Anand are human rights defenders who, in conjunction with several other individuals, founded the Mumbai-based non-governmental organization Citizens for Justice and Peace, which advocates for peace in Gujarat and provides assistance and legal aid to the victims of communal violence in the so-called Gulbarg Society Massacre of 28 February 2002, including to Ms. Zakia Jafri. Citizens for Justice and Peace has been actively involved in obtaining life sentences for 120 perpetrators of the 2002 massacre, as well as lesser sentences for seven other perpetrators. -
