    International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Rapporteur Report The Hague June 29-July 1, 2015 International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Conference in The Hague, June 29 – July 1, 2015 Executive Summary Leading decision-makers from more than a dozen countries gathered in The Hague from June 29 to July 1, 2015, to consider the failure of the international community to protect the United Nations “safe area” of Srebrenica, resulting in the largest massacre in Europe since World War II. Participants included three former members of the UN Security Council, senior government and UN officials, peacekeepers, and eyewitnesses to the Srebrenica tragedy. Over the course of four working sessions, a public event, and numerous informal meetings, conference participants focused on a disastrous two-year chain of events that culminated in the fall of Srebrenica in July 1995. They examined the origins of the “safe area” policy, beginning with the March 1993 visit to Srebrenica by French General Philippe Morillon, and disagreements on how to implement frequently impractical Security Council resolutions. The discussion revealed sharp disconnects between the policy-makers in New York, the peacekeepers on the ground, and the people the “safe areas” were ostensibly designed to keep safe. “I saw this conference as a kind of truth commission,” said Srebrenica survivor Muhamed Duraković. “Twenty years on, we cannot bring back the dead, but we can learn from what went wrong in Srebrenica. If we are not able to go through the process of fact-finding, truth, and reconciliation, we may be creating problems for future generations.” At the heart of the international failure in Srebrenica in July 1995 was the inability of the major powers to devise and implement an agreed strategy for ending the defining conflict of the immediate post-Cold War era.

  • Hasan Nuhanović
    HASAN NUHANOVIĆ Hasan Nuhanović was an interpreter for the United Nations in Srebrenica and saw his family murdered when the town fell to the Bosnian Serb Army. In the years since he has campaigned for justice for the victims of Srebrenica. ‘I am seeking justice. If I had not done this I would not be able to go on with my life.’ Hasan Nuhanović was born on 2 April 1968 in Zvornik, Bosnia and Herzegovina, to Bosnian Muslim parents Ibro and Nasiha Nuhanović. Hasan enroled in the University of Sarajevo as a mechanical engineering student. His father Ibro was a businessman, his mother Nasiha looked after the family home and his younger brother Mohammad attended high school. When Yugoslav President Josip Broz Tito died in 1980, ethnic and national tensions began to tear Yugoslavia apart. In 1992 in Bosnia and Herzegovina confl ict broke out between Serbs, Croats and Bosnian Muslims, also called Bosniaks. With Bosnian Serb forces intent on ethnically cleansing the region, Hasan, who was home from university, and his familly were forced to fl ee their home in Vlasenica. They fl ed to Srebrenica, a town where Hasan’s uncle lived. Here they would remain for three years. Srebrenica, a Bosniak town besieged by the Bosnian Serbs, became a symbol of resistance for the Bosniak cause. The Bosnian Serbs prevented essential supplies from reaching the civilians inside the town. With the town’s pre-war population swollen to 60,000 by refugees, Hasan remembers terrible conditions in Srebrenica, with little food, water or electricity available to the desperate people trapped there.

    Srebrenica in summary 07 Aug 2008 An overview of the legal proceedings relating to the 1995 genocide Following the commemoration of the 13th anniversary of the genocide at Srebrenica, the Hague Justice Portal reviews and summarises the numerous legal proceedings relating to the tragic events of July 1995. The Srebrenica massacre was the worst atrocity of the Bosnian War (1992-1995) and the largest massacre committed in Europe since the Second World War. On 16 November 1995, four months after the horrific events took place, the International Criminal Tribunal for the former Yugoslavia (ICTY) confirmed the indictment against recently captured Bosnian Serb leader Radovan Karadžić and General Ratko Mladić. In expressing the magnitude of the crimes committed at Srebrenica, Judge Riad stated: The evidence tendered to the prosecutor describes scenes of unimaginable savagery, thousands of men executed and buried in mass graves, hundreds of men buried alive, mutilated and slaughtered… These are truly scenes from Hell, written on the darkest pages of human history. While the ICTY was established in 1993 by the UN Security Council specifically to deal with the ongoing atrocities committed in the region, proceedings relating to the events in Srebrenica have also taken place before several other courts. In 2007, the International Court of Justice delivered its decision in the historic Genocide Case, which addressed the issue of whether the Serbian state could be held responsible for the Srebrenica genocide under international law. The special War Crimes Chambers set up in Sarajevo and Belgrade have also dealt with crimes committed in Srebrenica and recently – here in the Netherlands – representatives of the victims have attempted to bring the Dutch State (and the United Nations itself) to account for the fateful events at Srebrenica.

These elections created nationalist parties intent on perpetuating ethno-national identities and causes. By 1992, war was being imposed through Serbian and Croatian nationalists seeking to expanded into “greater” national territory. In the coming years the perpetrators of “ethnic cleansing,” displacement, mass atrocity, and genocide, were rewarded by the international community at the Dayton Accords in 1995. Dayton ended the war, but then imposed an ethno-nationalistic portioned Bosnia. A “tycoon class” of nationalist leaders continues to enrich themselves through corruption supported by poverty, fear, insecurity, and the promotion of divisive ethnic identities. The hate didn’t exist before; it was artificially installed. It was all so unbelievable that at first, it seemed funny…The emphasis on ethnicity and exclusion was so strong that ethnic hatred became normalized…There is also the ideology of religion and nationality…Never has there been more religion and less faith…National and religious identities are openly used as weapons in the political arsenal.” – Vedran Grahovac, Prijedor1 Denial of Bosnian genocide is rooted in Serb and Croat religious nationalism and Islamophobia. Unresolved and manipulated memory continue to haunt the Balkans. It is a fundamental mistake, however, to accept the narrative of “Balkanization” as an intractable “truth” of people living here. Balkanization implies that people are separated by exclusive group identities that make them prone to war and to live in perpetual hostility.

She is also a Research Fellow in the Individualisation of War Project at the European University Institute, and an Associate Fellow of the International Law Programme at Chatham House. Abstract In recent years there have been repeated calls for the establishment of so-called “safe areas” to protect civilians from the effects of hostilities in a number of contexts. The present article presents the international law framework relevant to the establishment and operation of such areas: the provisions of international humanitarian law on protected zones; the rules regulating resort to armed force, Security Council authorization and mandates for the establishment of such areas by multinational forces in the absence of agreement between belligerents; and the refugee and international human rights issues raised by such zones. Using the example of the “protection of civilians sites” in South Sudan, the article then highlights some of the operational challenges raised by safe areas. It concludes with some reflections on how to enhance the likelihood that belligerents will establish such protected zones in the future. For the first time, we brought together the key decision-makers from that period, including the leaders of the civilian and military branches of the UN mission in Bosnia, senior officials from UN Headquarters, and political leaders and officials from key governments, including the Netherlands, US, France, UK and Bosnia itself. We were particularly honored to have with us a Srebrenica survivor. Our goal was to better understand the chain of events that led to the genocide, with the aim of preventing such calamities in the future. Our public panel this morning includes Muhamed Duraković, a Srebrenica survivor who survived the genocide by making a 37-day trek through Bosnian Serb Army controlled territory, Yasushi Akashi, the Special Representative of the UN Secretary-General in the former Yugoslavia from 1993 to 1997, Joris Voorhoeve, Minister of Defense of the Netherlands from 1994 to 1998, General Sir Rupert Smith, the UNPROFOR Commander in Bosnia from 1995, Assistant Chief of Defense Operations from 1992 to 1994, Carl Bildt, 5-1 European Union Special Envoy to the former Yugoslavia 1995, and Zlatko Lagumdžija, former Deputy Prime Minister of Bosnia and Herzegovina from 1992 to 1994.
