The Public Utilities Office has relied on the Independent Market Operator for data concerning generators on the SWIS and has reported the maximum sent out capacity offered by these facilities into the Balancing Market, as of 25 November 2014. These figures may differ slightly from the number of capacity credits awarded and from facility nameplate capacity owing to factors including parasitic load and ambient temperature. For NWIS and NIS facilities, various sources have been used as there is no single definitive list of facilities. The nature of mining operations has not been investigated. The Public Utilities Office does not have access to data on the number of employees or on the closure schedule of power stations. The Minister, in making her decision, discussed four main reasons for her conclusion which I will address as follows: 1. Source of Year 11 Cohort for EACS The Minister has concluded that the major source of enrolment for the year 11 cohort would be from ESHS and this would have a detrimental impact on current programmes. However, in spite of the closure of the Ravensthorpe Nickel Mine, enrolments at Esperance Senior High School are significantly up, particularly in Year 11 and 12 in 2009 in comparison to the previous year. Year 11 has 236 students in 2009 compared to 200 in 2008 and Year 12 has 162 in Year 12 compared to 130 in 2008.

Savings and Transitional Rules Parts A to ZZI, ZZK, ZZL, ZZN (except for clause 11.86.8), ZZO to ZZT, ZZV and ZZX have no effect in this jurisdiction (see regulation 5A of the National Electricity (Northern Territory) (National Uniform Legislation) (Modification) Regulations). The application of those Parts may be revisited as part of the phased implementation of the Rules in this jurisdiction.
