63 Section 7: Criminal Offense, Criminal Responsibility, and Commission of a Criminal Offense Article 15: Criminal Offense A criminal offense is an unlawful act: (a) that is prescribed as a criminal offense by law; (b) whose characteristics are specified by law; and (c) for which a penalty is prescribed by law. Commentary This provision reiterates some of the aspects of the principle of legality and others relating to the purposes and limits of criminal legislation. Reference should be made to Article 2 (“Purpose and Limits of Criminal Legislation”) and Article 3 (“Principle of Legality”) and their accompanying commentaries. Article 16: Criminal Responsibility A person who commits a criminal offense is criminally responsible if: (a) he or she commits a criminal offense, as defined under Article 15, with intention, recklessness, or negligence as defined in Article 18; IOP573A_ModelCodes_Part1.indd 63 6/25/07 10:13:18 AM 64 • General Part, Section (b) no lawful justification exists under Articles 20–22 of the MCC for the commission of the criminal offense; (c) there are no grounds excluding criminal responsibility for the commission of the criminal offense under Articles 2–26 of the MCC; and (d) there are no other statutorily defined grounds excluding criminal responsibility. Commentary When a person is found criminally responsible for the commission of a criminal offense, he or she can be convicted of this offense, and a penalty or penalties may be imposed upon him or her as provided for in the MCC. Article 16 lays down the elements required for a finding of criminal responsibility against a person. -

Conspiracy, it is generally said, is a necessary doctrine in some respects, but also one that is overbroad and invites abuse. Conspiracy has been thought to be necessary for one or both of two reasons. First, it is said that a separate offense of conspiracy is useful to supplement the generally restrictive law of attempts. Plot- ters who are arrested before they can carry out their dangerous schemes may be convicted of conspiracy even though they did not go far enough towards completion of their criminal plan to be guilty of attempt.' Second, conspiracy is said to be a vital legal weapon in the prosecu- tion of "organized crime," however defined.' Federal law therefore proscribes providing the federal courts, Congress, or federal agencies with false information. The prohibition takes four forms: false statements; perjury in judicial proceedings; perjury in other contexts; and subornation of perjury. Section 1001 of Title 18 of the United States Code, the general false statement statute, outlaws material false statements in matters within the jurisdiction of a federal agency or department. It reaches false statements in federal court and grand jury sessions as well as congressional hearings and administrative matters but not the statements of advocates or parties in court proceedings. Under Section 1001, a statement is a crime if it is false regardless of whether it is made under oath. In contrast, an oath is the hallmark of the three perjury statutes in Title 18. The oldest, Section 1621, condemns presenting material false statements under oath in federal official proceedings. Section 1623 of the same title prohibits presenting material false statements under oath in federal court proceedings, although it lacks some of Section 1621’s traditional procedural features, such as a two-witness requirement. Subornation of perjury, barred in Section 1622, consists of inducing another to commit perjury. All four sections carry a penalty of imprisonment for not more than five years, although Section 1001 is punishable by imprisonment for not more than eight years when the offense involves terrorism or one of the various federal sex offenses. -

INTRODUCTION Imagine a case featuring a manufacturing shop boss who sent his employees into a toxic work environment. As happens at many job sites, hazardous chemicals unavoidably were nearby, and safety always was a matter of reducing their concentration. This attempted solution, however, may mean that dangerous levels of chemicals remain. But this time, the level of toxicity was far higher than usual. There is strong evidence that the shop boss knew about the danger, at least well enough to have realized that it probably had reached a deadly level, but the shop boss disputes this evidence. The employees all became ill, and one of them has died. The survivors sue in an attempt to recover damages for wrongful death. -

QUESTION 5 Don has owned Don's Market in the central city for twelve years. He has been robbed and burglarized ten times in the past ten months. The police have never arrested anyone. At a neighborhood crime prevention meeting, apolice officer told Don of the state's new "shoot the burglar" law. That law reads: Any citizen may defend his or her place of residence against intrusion by a burglar, or other felon, by the use of deadly force. Don moved a cot and a hot plate into the back of the Market and began sleeping there, with a shotgun at the ready. After several weeks of waiting, one night Don heard noises. When he went to the door, he saw several young men running away. It then dawned on him that, even with the shotgun, he might be in a precarious position. He would likely only get one shot and any burglars would get the next ones. With this in mind, he loaded the shotgun and fastened it to the counter, facing the front door. He attached a string to the trigger so that the gun would fire when the door was opened. Next, thinking that when burglars enter it would be better if they damaged as little as possible, he unlocked the front door. He then went out the back window and down the block to sleep at his girlfriend's, where he had been staying for most of the past year. That same night a police officer, making his rounds, tried the door of the Market, found it open, poked his head in, and was severely wounded by the blast. -

CRIMINAL LAW-PROSECUTION OF CORPORATE OFFICIALS UNDER THE FEDERAL FOOD, DRUG, AND COSMETIC AcT-United States v. Park, 421 U.S. 658 (1975). I. INTRODUCTION The Federal Food, Drug, and Cosmetic Act of 1938' provides criminal sanctions for those violating its provisions. 2 The Act since its inception has been applied to corporations, but judicial decision3 has extended its coverage to individual officials whose corporations have violated the Act. The standards applicable to individuals prose- cuted under the Act have been generally ill defined in two related areas: first, the officials who can be charged with violations of the Act; and second, the necessary degree of the defendant's involvement in the violation in order to make out a prima facie case.4 United States v. Park5 presented the United States Supreme Court with an excellent opportunity to clarify the law in this area. The Park case arose in the following manner. As a result of an inspection of its Baltimore warehouse, Acme Markets, Inc., a large national retail food chain,6 and its president, John R. Park, were charged with viola- tions of the Act. Each count of the information alleged that the defendants had received goods shipped in interstate commerce, and that while the food was being held in an Acme warehouse, they caused it to be exposed to contamination. These acts allegedly re- sulted in the food becoming adulterated within the meaning of the Act, which provides that: A food shall be deemed to be adulterated-(a). (3) if it consists in whole or in part of any filthy, putrid, or decomposed substance, or it is otherwise unfit for food; or (4) if it has been prepared, packed, or held under insanitary conditions whereby it may have 21 U.S.C. -

COMMENTS put to extensive efforts to collect and analyze prior awards not knowing whether the court will consider the collected precedents in the review of his case.69 It would be wise for the courts to eliminate the present confusion surround- ing the rule of comparative damages by defining the form, if any; of the rule to which they will give notice and then consistently applying this definition. A modified and consistent use of the rule would balance the desireability of achiev- ing justice in each case with the predictability necessary for both a stable legal system and an efficient allocation of our legal resources. BRuCE D. DRuccER IS CRIMINAL NEGLIGENCE A DEFENSIBLE BASIS FOR PENAL LIABILITY? In 1965 the New York Legislature enacted and the Governor of New York signed into law a Revised Penal Law to take effect September 1, 1967.1 The New York Commission for the Revision of the Penal Law adopted the suggestion of the American Law Institute Model Penal Code by including a general statutory provision defining four concepts of mental culpability: intention, knowledge, recklessness and criminal negligence.
