Engagement Plan: Plan Change 54 – Industrial This Engagement Plan outlines the approach to be undertaken in order to meet the requirements under the Resource Management Act 1991 (RMA) for the preparation of a Plan Change to the Operative Whanganui District Plan. Specifically clauses 1A, 3, 3B, 4 of Schedule One to the Act require the following: • that a Plan Change “must be prepared in accordance with any applicable Mana Whakahono a Rohe”, • consultation during the preparation of a plan change by local authority 1. “shall consult – a) the Minister for the Environment; and b) those other Ministers of the Crown who may be affected by the policy statement or plan; and c) local authorities who may be so affected; and d) the tangata whenua of the area who may be so affected, through iwi authorities; and e) any customary marine title group in the area” • may consult with anyone • is considered to have consulted with iwi authorities “if it- a) considers ways in which it may foster the development of their capacity to respond to an invitation to consult; and b) establishes and maintains processes to provide opportunities for those iwi authorities to consult it; and c) consults with those iwi authorities; and d) enables those iwi authorities to identify resource management issues of concern to them; and e) indicates how those issues have been or are to be addressed.” • must give written notice to any requiring authority that has a designation that has not lapsed in the relevant part of the district plan • to invite those requiring authorities to give written notice to the territorial authority stating whether the requiring authority requires the designation to be included, with or without modification, in the proposed plan. 2. Consultation Principles Guided by the Principles of Consultation in the Local Government Act 2004 the following principles have been developed: 1. Consultation is viewed as an ongoing iterative process through all stages of the plan change. 2. Participants are provided with clear information on the process from the outset. 3. People are encouraged to present their views 1 4. People are given clear information concerning the purpose of the consultation and the scope of their decisions to be taken following the consideration of views 5. People who wish to have their views on the decision or matter considered by Whanganui District Council are provided with reasonable opportunity to present those views in a manner and format that is appropriate to the preferences and needs of those persons 6. Whanganui District Council gives views received through consultation due consideration when making its decision. 7. People who present views should have access to a clear record or description of relevant decisions and explanatory material relating to the decisions. 2.1 The Engagement Objectives are: 1. To meet the statutory requirements of the RMA 1991 and LGA 2002. 2. To ensure all relevant stakeholders are informed about the plan change and the key stages of the process. 3. To provide opportunities for stakeholders to participate and provide input and feedback to the proposed plan change. 2.2. Outcomes: It is expected that as a result of implementing this engagement plan, the following outcomes will be achieved: 1. Stakeholders and the community will be informed in an ongoing way of the Plan change and its purpose, and will be able to contribute to the development of the Plan change throughout the process. 2. Feedback will be received within timeframes sufficient to contribute to various stages of decision making. 3. Key environmental risks and opportunities will be identified and captured through the consultation process, and will be incorporated into the Section 32 report. 4. Consultation processes and feedback will be documented and recorded in a project- specific spreadsheet and document. This will provide a database so that Whanganui District Council will be able to demonstrate to stakeholders, if required, how their feedback influenced final decision making. The Section 32 Evaluation Report will formally document all engagement. 2 3.0 Parties who must be consulted with under Clause 3(1) Schedule 1 of the RMA • Minister for the Environment. • Any other Ministers of the Crown. • Local Authorities. • Tangata Whenua. • Any customary marine title group. Other parties have been identified also based on assessment of who has an interest in the proposal, and who has been consulted with on previous similar plan changes. 3.1 Stages of consultation under the RMA: 1. Commencement of the Plan Change process (which has already occurred). 2. Further consultation with iwi prior to notification. 3. Public notification of the plan change for submissions. 4. Receipt of submissions on the plan change. 5. Notification of the Summary of Submissions for further submissions. 6. Hearing of any submissions and associated evidence on the plan change. 7. While the plan is being monitored and evaluated. 3.2 Whanganui District Council Significance and Engagement Policy 2018: The Council’s Significance and Engagement Policy 2018 has been developed in response to the requirements of section 76AA of the LGA 2002. It aids Council to meet the functions of enabling democratic local decision making and action. The Policy this policy is to ensure council takes a consistent and transparent approach in determining the significance of a decision and the appropriate level of engagement is carried out.
