    SEPTEMBER/OCTOBER 2010 BY TODD FARLEY Exene Cervenka's Rebellion Against the Eoects of MS Ever true to her defiant nature, the punk rocker keeps her multiple sclerosis symptoms from hogging the stage. For a punk rock icon, Exene Cervenka isn't much of a nihilist. In fact, when the co- founder of the seminal Los Angeles band X was diagnosed with multiple sclerosis (MS) in May of 2009, Cervenka didn't allow herself to become negative at all. The singer was familiar with the disease. As a teenager, she solicited funds for the National Multiple Sclerosis Society. As an adult, she raised money and awareness for Sweet Relief, a charity started by MS patient and singer Victoria Williams that aids uninsured musicians. (Read more about how Victoria handles her MS.) But even the spooky irony of those experiences wasn't enough to get Cervenka down. Punk rock girl Exene Cervenka stays optimistic. "I haven't changed my plans," she says, in true punk style, "and I don't intend to." Cervenka, born Feb. 1, 1956, received much musical acclaim in the late '70s and early '80s when her band, X, led the California punk movement of that time. Songs like "Los Angeles," "The New World," and "I Must Not Think Bad Thoughts" became underground classics. (Little known fact: Many rock critics believe Madonna's early look was lifted from Cervenka. The Material Girl's style of thrift-store duds and arm bangles was surprisingly similar to what Cervenka regularly wore on stage.) The 1981 X album Wild Gift was named Rolling Stone's Record of the Year.

John Doe (Doe) was admitted as a freshman student to the University of California at Santa Barbara (UCSB). Before he even arrived in Santa Barbara, UCSB placed him on interim suspension pending its investigation into an allegation of dating- relationship violence. UCSB then delayed completion of the investigation, in violation of its own written policies. Doe brought this action against the Regents of the University of California (Regents). The superior court preliminarily enjoined the interim suspension pending completion of the administrative proceedings. Ultimately, Doe was exonerated in the administrative proceedings. Over his objection, the superior court then dismissed his action as moot. The court denied Doe’s motion for attorney’s fees under Code of Civil Procedure section 1021.5, reasoning that he had failed to show the litigation conferred “a significant benefit . on the general public or a large class of persons.” (Code Civ. Proc., § 1021.5.)1 Doe appeals from the judgment of dismissal and the postjudgment order denying his motion for attorney’s fees. We affirm the order of dismissal. We conclude Doe satisfied the criteria for an award of fees under section 1021.5. We reverse the denial of the fee motion and remand for a determination of the amount to be awarded. On display on the Museum's fourth floor, the exhibit will give visitors a glimpse into how X's four original members – Exene Cervenka, John Doe, Billy Zoom, and DJ Bonebrake – quickly established the band as one of the best in the first wave of L.A.'s flourishing punk scene. "An X exhibit in a museum? Unbelievable! We are honored, dumbstruck and so grateful that all four original members are here to celebrate and share our history and 40th anniversary. It’s a very long way from a basement on Hollywood Blvd (The Masque) to the GRAMMY Museum, but we feel that we bring with us all the punks from then and now.
