大埔區議會文件ehw 21/2015 號《赤徑分區計劃大綱草圖編號s/Ne-Ck/1》 1. 目的本文件旨在徵詢各議 大埔區 議 會 文 件 EHW 21/2015 號 供 2015 年 5 月 13 日環境、房屋及工程委員會會議用 《 赤徑分 區 計 劃 大 綱 草 圖 編 號 S/NE-CK/1》 1. 目的 本文件旨在徵詢各議 員 對《赤徑分區計劃大綱草圖編號 S/NE-CK/1》 及 其 《 註 釋 》 及 《 說 明 書 》 (附 件 一 至 三 )的 意見。 2. 背景 2.1 二 零 一 四 年 十 月 十 六 日 ,發展局局長行使行政長官 所 授 予 的 權 力,根 據《 城 市 規 劃 條 例 》(下 稱「條 例 」) 第 3(1)(a)條 指 示 城 市 規 劃 委 員 會 (下 稱 「 城 規 會 」 ) 擬 備 一 份 涵 蓋 赤徑地區的分區計劃大綱圖。 2.2 二 零 一 五 年 四 月 二十四 日 , 城 規 會 根 據 條例第 5 條,展 示《 赤徑分 區 計 劃 大 綱 草 圖 編 號 S/NE-CK/1》 (下 稱 「 該 圖 」 ), 以 供 公 眾 查 閱 。 3. 規 劃 區 赤徑規劃區 (下稱「該 區」) 的 總 面 積 約 為 34.74公 頃 , 周 圍被西貢東郊野公園環抱,只有北面向着該郊野公園北 岸其中一個海灣赤徑口。 該區三面被西貢東郊野公園環 繞,區內主要是一些林地、灌木林、草地、河溪、沙灘 、 連着懸崖的岩岸、後灘植被及紅樹林,是構成該郊野公 園整個天然環境的一部分。該區前臨海灣,中部有條鄉 村,山谷間有兩條天然河溪,構成麥理浩徑上赤徑口旁 一條延綿不斷的優美風景帶。整體而言,該區一派自然 鄉郊風貌,景色宜人,景觀價值高。 2 4. 整 體 規 劃 意 向 該區毗鄰西貢東郊野公園,是該郊野公園的自然系統不 可或缺的一部分。區內有多種天然生境,包括林地、灌 木林、草地、河溪、沙灘、連着懸崖的岩岸、後灘植被 及紅樹林,須加以保存和保護。整體而言,該區一派自 然鄉郊風貌,景色宜人,景觀價值高。該區的整體規劃 意向是保護該區的高保育和景觀價值,使其能與附近郊 野公園的整體自然美景互相輝映 。 除環境和生態方面的因素要考慮外,該區的發展還受制 於有限的交通和基礎設施。該區的規劃意向亦是要把鄉 村發展集中起來,以免對該區的天然環境造成不應有的 干擾及令區內有限的基礎設施不勝負荷。 5. 土 地 用 途 地 帶 5.1 「 鄉 村 式 發 展 」: 總 面 積 2.24 公頃 赤徑村是該區唯一的認可鄉村。此地帶的規劃意 向,是就現有的認可鄉村和適宜作鄉村擴展的土地劃 定 界 線 。 此 地 帶 的 界 線 是 考 慮 了 「 鄉 村 範 圍 」、未 處 理 的 小 型 屋 宇 申 請 數 目、所 預 測 的 小 型 屋 宇 需 求 量 、 區內地形及用地限制而劃的。地勢崎嶇和草木茂盛的 地方、河道和墓地都盡量不劃入此地帶內。 5.2 「 政 府 、 機 構 或 社 區 」: 總 面 積 0.08 公頃 此 地 帶 主 要 是 反 映 該 區 的 政 府、機 構 或 社 區 設 施,包 括該區東部位於麥理浩徑的公廁和垃圾收集站,以及 位於赤徑村南緣的聖家小堂。 5.3 「 綠 化 地 帶 」: 總 面 積 28.82 公頃 此地帶的規劃意向,主要是利用天然地理環境作為市 區和近郊的發展區的界限,以抑制市區範圍的擴展, 並 提 供 土 地 作 靜 態 康 樂 場 地。根 據 一 般 推 定,此 地 帶 不 宜 進 行 發 展 。 3 此 地帶內主要是林地、灌木林、草地和河溪,可發揮 緩 衝 作 用,分 隔 開 鄉 村 式 發 展 和 西 貢 東 郊 野 公 園,以 及保存該區的自然鄉郊風貌。 劃為「綠化地帶」的還包括位於該區東北邊緣的山坡 上的許可墓地的西部。該墓地供該區原居村民安葬先 人之用,已存在多年,屬現 有用途。為表示尊重當地 的 習 俗 及 傳 統,在 此 地 帶 進 行 殯 葬 活 動,一 般 可 予 容 忍。 5.4 「 海 岸 保 護 區 」: 總 面 積 3.60 公頃 此地帶的規劃意向,是保育、保護和保留天然海岸 線,以及易受影響的天然海岸環境,包括具吸引力 的地質特色、地理形貌,或在景觀、風景或生態方 面價值高的地方,而地帶內的建築發展,會維持在 最低水平。 此地帶主要涵蓋麥理浩徑北面赤徑口一帶的海岸區 (該處現有村落的數幢屋宇和屋宇的頹垣除外 ),以及 麥理浩徑南面有植被的小圓丘的懸崖。地帶內主要 是沙灘、連着懸崖的岩岸、後灘植被、紅樹林及河 口。 6. 展 示 該 圖 由 二 零 一 五 年 四 月 二十四日 起,城 規 會 根 據 條 例 第 5條展 示 該圖,以供公眾查閱,為期兩個月,至二零一五年六 月 二十四日 止。如對該圖作出申述,可於圖則展示期間 直接以書面向城規會作出申述。地址及網址如下: 地址: 城市規劃委員會秘書處 香港北角渣華道 333 號 北角政府合署 15 樓 網址: [email protected] 7. 地 區 諮 詢 城規會同意在該 圖展示期間諮詢 區 議 會 和 相 關 鄉 事 委 員 4 會。就 此,規劃署已於二 零 一 五 年 四 月 二 十 七 日 把 該圖交 予 西貢北約鄉 事 委 員 會 傳閱。 8. 總 結 請各議 員就該圖發表意見。 9. 附 件 附件一 《赤徑分區計劃大綱草圖編號 S/NE-CK/1》 附件二 《赤徑分區計劃大綱草圖編號 S/NE-CK/1》的《註釋》 附件三 《赤徑分區計劃大綱草圖編號 S/NE-CK/1》的《說明書》 規劃署 沙田、大埔及北區規劃處 二零一五年四月 DRAFT CHEK KENG OUTLINE ZONING PLAN NO. S/NE-CK/1 (Being a Draft Plan for the Purposes of the Town Planning Ordinance) NOTES (N.B. These form part of the Plan) (1) These Notes show the uses or developments on land falling within the boundaries of the Plan which are always permitted and which may be permitted by the Town Planning Board, with or without conditions, on application. Where permission from the Town Planning Board for a use or development is required, the application for such permission should be made in a prescribed form. The application shall be addressed to the Secretary of the Town Planning Board, from whom the prescribed application form may be obtained. (2) Any use or development which is always permitted or may be permitted in accordance with these Notes must also conform to any other relevant legislation, the conditions of the Government lease concerned, and any other Government requirements, as may be applicable. (3) No action is required to make the use of any land or building which was in existence immediately before the first publication in the Gazette of the notice of the draft development permission area plan conform to this Plan, provided such use has continued since it came into existence. Any material change of such use or any other development (except minor alteration and/or modification to the development of the land or building in respect of such use which is always permitted) must be always permitted in terms of the Plan or in accordance with a permission granted by the Town Planning Board. (4) A use or development of any land or building permitted under an earlier draft or approved plan including development permission area plan for the area and effected or undertaken during the effective period of that plan is always permitted under this Plan. Any material change of such use or any other development (except minor alteration and/or modification to the completed development of the land or building which is always permitted) must be always permitted in terms of the Plan or in accordance with a permission granted by the Town Planning Board. (5) Except to the extent that paragraph (3) or (4) applies, any use or development falling within the boundaries of the Plan and also within the boundaries of the draft development permission area plan, unless always permitted in terms of the Plan, shall not be undertaken or continued on or after the date of the first publication in the Gazette of the notice of the draft development permission area plan without permission from the Town Planning Board. (6) Except as otherwise specified by the Town Planning Board, when a use or material change of use is effected or a development or redevelopment is undertaken, as always permitted in terms of the Plan or in accordance with a permission granted by the Town Planning Board, all permissions granted by the Town Planning Board in respect of the site of the use or material change of use or development or redevelopment shall lapse. S/NE-CK/1 - 2 - (7) Alignment of roads and boundaries between zones may be subject to minor adjustments as detailed planning proceeds. (8) The following uses or developments are always permitted on land falling within the boundaries of the Plan except (a) where the uses or developments are specified in Column 2 of the Notes of individual zones or (b) as provided in paragraph (9) in relation to areas zoned “Coastal Protection Area”: (a) maintenance, repair or demolition of a building; (b) provision, maintenance or repair of plant nursery, amenity planting, open space, rain shelter, refreshment kiosk, footpath, bus/public light bus stop or lay-by, cycle track, taxi rank, public utility pipeline, electricity mast, lamp pole, telephone booth, telecommunications radio base station, automatic teller machine and shrine; (c) maintenance or repair of road, watercourse, nullah, sewer and drain; (d) geotechnical works, local public works, road works, sewerage works, drainage works, environmental improvement works, marine related facilities and waterworks (excluding works on service reservoir) and such other public works co-ordinated or implemented by Government; (e) rebuilding of New Territories Exempted House; (f) replacement of an existing domestic building, i.e. a domestic building which was in existence on the date of the first publication in the Gazette of the notice of the draft development permission area plan, by a New Territories Exempted House; and (g) provision, maintenance or repair of a grave of an indigenous New Territories villager or a locally based fisherman and his family members for which permission has been obtained from Government. (9) In areas zoned “Coastal Protection Area”, (a) the following uses or developments are always permitted: (i) maintenance or repair of plant nursery, amenity planting, sitting out area, rain shelter, refreshment kiosk, road, watercourse, nullah, public utility pipeline, electricity mast, lamp pole, telephone booth, shrine and grave; (ii) geotechnical works, local public works, road works, sewerage works, drainage works, environmental improvement works, marine related facilities, waterworks (excluding works on service reservoir) and such other public works co-ordinated or implemented by Government; and (iii) provision of amenity planting by Government; and S/NE-CK/1 - 3 - (b) the following uses or developments require permission from the Town Planning Board: provision of plant nursery, amenity planting (other than by Government), sitting out area, rain shelter, refreshment kiosk, footpath, public utility pipeline, electricity mast, lamp pole, telephone booth and shrine. (10) In any area shown as ‘Road’, all uses or developments except those specified in paragraphs (8)(a) to (8)(d) and (8)(g) above and those specified below require permission from the Town Planning Board: road and on-street vehicle park. (11) (a) Except in areas zoned “Coastal Protection Area”, temporary use or development of any land or building not exceeding a period of two months is always permitted provided that no site formation (filling or excavation) is carried out and that the use or development is a use or development specified below: structures for carnivals, fairs, film shooting on locations, festival celebrations, religious functions or sports events.

With the aid of a Powerpoint presentation, Mr. David Y.M. Ng, STP/New Plans, made the following main points: Location and Existing Land Uses a) Chek Keng (the Area) was located at Chek Keng Hau, one of the sea bays along the northern coast of the Sai Kung East Country Park. The Chek Keng Village, the only recognized village in the Area, was now largely abandoned and located in the middle of the Area, facing north towards the sea. The Area contained abandoned village houses, woodlands, shrublands, grasslands, wetlands, mangroves, streams, and fallow agricultural land. The coastal area contained mudflat stretches and a variety of marine life. It was rural in nature and was a popular hiking area with scenic views; Need for Statutory Plan b) the Chief Executive in the 2010-2011 Policy Address had acknowledged the need to regulate land use of the Country Park - 2 - enclaves to forestall human damage. To meet conservation and social development needs, these Country Park enclaves would be either included into Country Parks, or covered by statutory plans; c) the Area was one of the Country Park enclaves that needed to be covered by statutory plan.

A well-shaded reservoir path of shorter distance may be a better option than mountain hiking for the hot summer days. Located in Sai Kung, High Island Reservoir fits the bill. Take a detour and you will hit the Sheung Yiu Country Trail. The highlight of the recent hotspot is a crescent- shape concrete embankment in Po Kwu Wan Bay, once used by villagers for fish farming. The long and narrow barrier was built in the center of the sea but has fallen into disrepair over the years. Extra care is recommended when walking on it. Along the way is Hei Tze Wan, a deserted small pier excellent for photo taking.
