  • Cleaning the Security Apparatus Before the Two Meetings
ASIA PROGRAMME CLEANING THE SECURITY APPARATUS BEFORE THE TWO MEETINGS BY ALEX PAYETTE PH.D, CEO CERCIUS GROUP ADJUNCT PROFESSOR, GLENDON COLLEGE MAY 2020 ASIA FOCUS #139 l’IRIS ASIA FOCUS #139 – ASIA PROGRAMME / May 2020 n April 19 2020, Sun Lijun 孙力军 was put under investigation. Sun is the mishu of Meng Jianzhu 孟建柱, Party secretary of the Central Political and Legal Affairs o Commission [zhengfa] from 2012 to 2017, and a close ally of Politburo member Han Zheng 韩正, who is also a full member of Jiang Zemin’s 江泽民 Shanghai Gang 上海帮 . His arrest, which happened only one day after 15 pro-democracy activists were arrested in Hong Kong1, almost coincided with his return from Wuhan – as part of the Covid-19 containment steering group 中央赴湖北指导组. To this effect, it is evident that Sun’s investigation and arrest have been in motion for quite a while now. With Sun out of play, the former public security “tsar” Zhou Yongkang 周永康 has effectively lost most of his tentacles on the public security system. That said, Sun’s arrest might not even be the most important news shaking up the public security apparatus ahead of the upcoming “Two Meetings” 两会. CUTTING THE ROOTS As it is customary with Cadres working for public security, State security and national Defence, Sun Lijun’s public profile is quite limited. Sun, who studied in Australia, majored in public health and urban management, a very interesting choice especially considering the current pandemic. Sun was primarily active in Shanghai, and held a number of notable posts in his career including: • Director of the Hong Kong affairs office of the Ministry of Public Security from 2016 until his arrest; • Deputy director of the infamous “610” unit 中央610办公室– also known as the Central Leading Group on Preventing and Dealing with Heretical Religions 中央防范 和处理邪教问题领导小组2; • Director of the No.

UCLA UCLA Pacific Basin Law Journal Title The Yang Obeys, but the Yin Ignores: Copyright Law and Speech Suppression in the People's Republic of China Permalink https://escholarship.org/uc/item/4j750316 Journal UCLA Pacific Basin Law Journal, 29(1) Author McIntyre, Stephen Publication Date 2011 DOI 10.5070/P8291022233 Peer reviewed eScholarship.org Powered by the California Digital Library University of California THE YANG OBEYS, BUT THE YIN IGNORES: COPYRIGHT LAW AND SPEECH SUPPRESSION IN THE PEOPLE'S REPUBLIC OF CHINA Stephen McIntyret ABSTRACT Copyright law can either promote or restrict free speech: while copyright preserves economic incentives to create and pub- lish new expression, it also fences off expression from public use. For this reason, the effect of copyright law on speech in a given country depends on the particular manner in which it is under- stood, legislated, and enforced. This Article argues that copyright law in the People's Repub- lic of China (PRC) serves as a tool for speech suppression and censorship. Whereas China has engaged in official censorship for thousands of years, there has historically been little appreciation for proprietary rights in art and literature. Just as China's early twentieth century attempts to recognize copyright overlapped with strict publication controls, the PRC's modern copyright regime embodies the view that copyright is a mechanism for policing speech and media. The decade-long debate that preceded the PRC's first copy- right statute was shaped by misunderstanding, politics, ideology, and historicalforces. Scholars and lawmakers widely advocated that Chinese copyright law discriminate based on media content and carefully circumscribe authors' rights.

  • “China's Digital Authoritarianism: Surveillance, Influence, And
“China’s Digital Authoritarianism: Surveillance, Influence, and Political Control” May 16, 2019 Hearing Before the House Permanent Select Committee on Intelligence Prepared statement by Peter Mattis Research Fellow, China Studies Victims of Communism Memorial Foundation * * * I. OVERVIEW Chairman Schiff, Ranking member Nunes, distinguished members of the Committee, thank you for inviting me to appear before you. The Chinese Communist Party’s influence and, particularly, its political interference in the United States is an important topic as we establish a new baseline for U.S.-China relations. Any sustainable, long-term strategy for addressing China’s challenge requires the integrity of U.S. political and policymaking processes. This requires grappling with the challenges posed by the party’s efforts to shape the United States by interfering in our politics and domestic affairs. The United States, its political and business elite, its thinkers, and its Chinese communities have long been targets for the Chinese Communist Party. The party employs tools that go well beyond traditional public diplomacy efforts. Often these tools lead to activities that are, in the words of former Australian prime minister Malcolm Turnbull, corrupt, covert, and/or coercive. Nevertheless, many activities are not covered by Turnbull’s three “Cs” but are still concerning and undermine the ability of the United States to comprehend and address Beijing’s challenge. Here are a few of the ways in which the Chinese Communist Party has shaped the ways in which Americans discuss, understand, and respond to the People’s Republic of China, its rise, and its activities: ● We have been persuaded that the Chinese Communist Party is not ideological and has substituted its Leninist tradition for a variation of capitalism.

China’s Political Institutions and Leaders in Charts Susan V. Lawrence Specialist in Asian Affairs November 12, 2013 Congressional Research Service 7-5700 www.crs.gov R43303 CRS Report for Congress Prepared for Members and Committees of Congress China’s Political Institutions and Leaders in Charts Summary This report provides a snapshot of China’s leading political institutions and current leaders in the form of nine organization charts and three tables. The report is a companion to CRS Report R41007, Understanding China’s Political System, by Susan V. Lawrence and Michael F. Martin, which provides a detailed explanation of China’s political system. This chart-based report is intended to assist Members and their staffs seeking to understand where political institutions and individuals fit within the broader Chinese political system and to identify which Chinese officials are responsible for specific portfolios. The information may be useful for Members and staff visiting China, hosting visitors from China, preparing for China-related hearings, or drafting China-related legislation. Figures 1 and 2 depict China’s political power structure as it was envisioned in Chapter 3 of the 1982 state constitution, and as actually implemented. The key difference is that while Chapter 3 of the state constitution identifies the National People’s Congress as the highest organ of state power, the Communist Party of China exercises leadership over the entire political system. Figures 3, 4, and 5 provide information about the Communist Party’s leadership. Figure 3 presents the Party’s hierarchy. Figure 4 lists the members of the Party’s most senior decision- making body, the Politburo Standing Committee, and their portfolios.
