Transatlantic Cooperation and the Prospects for Dialogue
Transatlantic Cooperation and the Prospects for Dialogue The Council for Inclusive Governance (CIG) organized on February 26, 2021 a discussion on trans-Atlantic cooperation and the Kosovo-Serbia dialogue for a group of politicians and civil society representatives from Kosovo and Serbia. Two CIG board members, former senior officials in the U.S. Department of State and the European Commission, took part as well. The meeting specifically addressed the effects of expected revitalized transatlantic cooperation now with President Joe Biden in office, the changes in Kosovo after Albin Kurti’s February 14 election victory, and the prospects of the Kosovo-Serbia dialogue in 2021. The following are a number of conclusions and recommendations based either on consensus or broad agreement. They do not necessarily represent the views of CIG and the Swiss Federal Department of Foreign Affairs (FDFA), which supports CIG’s initiative on normalization between Kosovo and Serbia. The discussion was held under the Chatham House Rule. Conclusions and recommendations The change of governments in Kosovo and in the US are positive elements for the continuation of the dialogue. However, there are other pressing issues and reluctance both in Belgrade and in Pristina that make it almost impossible for the dialogue to achieve breakthrough this year. • The February 14 election outcome in Kosovo signaled a significant change both at the socio- political level and on the future of the dialogue with Serbia. For the first time since the negotiations with Serbia began in 2011, Kosovo will be represented by a leader who is openly saying that he will not yield to any international pressure to make “damaging agreements or compromises.” “However, this is not a principled position, but rather aimed at gaining personal political benefit,” a speaker, skeptical of Kurti’s stated objectives, said. -

The €1,000,000,000 1.500 per cent. Notes due 2029 (the “Notes”) to be issued by the Republic of Serbia, represented by the Government of the Republic of Serbia acting by and through the Ministry of Finance (the “Issuer”) will mature on 26 June 2029 and, unless previously purchased and cancelled, will be redeemed at their principal amount on that date. The Notes will bear interest at a rate of 1.500 per cent. per annum. Interest will accrue on the outstanding principal amount of the Notes from and including 26 June 2019 and will be payable annually in arrear on 26 June in each year, commencing on 26 June 2020. All payments of principal and interest in respect of the Notes shall be made free and clear of, and without withholding or deduction for, any taxes, duties, assessments or governmental charges of whatever nature imposed, levied, collected, withheld or assessed by or within the Republic of Serbia (the “Republic of Serbia” or “Serbia”) or any political subdivision or any authority thereof or therein having power to tax, unless such withholding or deduction is required by law. In that event, the Issuer shall pay such additional amounts as will result in the receipt by the Noteholders of such amounts as would have been received by them if no such withholding or deduction had been required, subject to certain exceptions set out in the Conditions (as defined below). -

SERBIA PREFACE A visit to Serbia places one in the center of the Balkans, the 20th century's tinderbox of Europe, where two wars were fought as prelude to World War I and where the last decade of the century witnessed Europe's bloodiest conflict since World War II. Serbia chose democracy in the waning days before the 21st century formally dawned and is steadily transforming an open, democratic, free-market society. Serbia offers a countryside that is beautiful and diverse. The country's infrastructure, though over-burdened, is European. The general reaction of the local population is genuinely one of welcome. The local population is warm and focused on the future; assuming their rightful place in Europe. AREA, GEOGRAPHY, AND CLIMATE Serbia is located in the central part of the Balkan Peninsula and occupies 77,474square kilometers, an area slightly smaller than South Carolina. It borders Montenegro, Croatia and Bosnia-Herzegovina to the west, Hungary to the north, Romania and Bulgaria to the east, and Albania, Macedonia, and Kosovo to the south. Serbia's many waterway, road, rail, and telecommunications networks link Europe with Asia at a strategic intersection in southeastern Europe. Endowed with natural beauty, Serbia is rich in varied topography and climate. Three navigable rivers pass through Serbia: the Danube, Sava, and Tisa. The longest is the Danube, which flows for 588 of its 2,857-kilometer course through Serbia and meanders around the capital, Belgrade, on its way to Romania and the Black Sea. The fertile flatlands of the Panonian Plain distinguish Serbia's northern countryside, while the east flaunts dramatic limestone ranges and basins. -

Between 1991 and 1999 the regime of Slobodan Milošević did not ban a single anti-war demonstration by nongovernmental organizations because they served as proof to the international community of his ‘democratic’ attitude towards the ‘handful’ that did not support him. The regime and its media paid little attention to the reports of domestic human rights organizations on human rights and humanitarian law violations during the armed conflict because the regime felt secure and supported by the majority of citizens. The period of the NATO bombing campaign from 24 March until 9 June 1999 united the opposition, civil society and regime. Nongovernmental organizations led the way in criticizing the international community and urging the citizens to keep their differences with the government aside as long as bombs kept dropping on the country. It was in those circumstances that several Human Rights Defenders and human rights organizations became the target of government media and secret services above all for publicly pointing out that the regime was taking advantage of the NATO campaign to settle with the Albanians. Because of its attitude during the NATO campaign, the Humanitarian Law Centre (HLC) was twice visited by members of the military security service, who threatened to bring charges of espionage against the HLC Executive Director; also, financial police examined the organization’s accounts and financial records for three weeks. -

The process is entering a critical stage. An agreement on comprehensive normalization or a peace treaty under which both sides will commit to mutual respect, peaceful co- existence and hopefully cooperation is within reach. Comprehensive normalization with Kosovo is an obligation for Serbia’s accession to the European Union and is also needed by Pristina in order to move forward. It is unclear, however, what is the most efficient way of getting there. It is not clear how to produce a document that will be acceptable to both sides and a document in the spirit of win-win rather than of win-lose. Since 2010, Serbia and Kosovo have been on a quest to normalize their relations. In Brussels, in 2013, their prime ministers reached the first agreement of principles governing normalization of relations. Implementation deadlines were agreed upon as well. However, five years later the agreement remains to be implemented in full, most notably the provisions on establishing the Association/Community of Serb-Majority Municipalities and on energy. Kosovo’s institutions are not fully functioning in Kosovo’s predominantly ethnically Serb north and Serbia’s parallel administrative institutions continue their existence across Kosovo. -
