Separation of powers: A primer By Ryan J. Watson and James M. Burnham - - Sunday, July 5, 2015 Constitutional concepts like free speech or the right to bear arms are ingrained in our popular culture, but just 36% of Americans can name all three branches of the federal government.1 Even fewer understand why and how our Constitution allocates power among the Legislative, Executive, and Judicial branches. As we celebrate Liberty Month, it is worthwhile to review how the Constitution's separation of powers supplies a key bulwark protecting individual liberty in the world's most successful Republic. The Founders were familiar with human nature and the correlative tendency of every ruler towards tyranny. They had experienced oppression at the hands of the English King and realized that the only way to truly protect individual liberty was to limit the power of any single government official. James Madison, a central architect of the Constitution, rightly observed that if "men were angels, no government would be necessary." Federalist No. 51 (1788). He knew that every official or body would seek to accumulate "all powers, legislative, executive, and judiciary, in the same hands," and that such a concentration would be "the very definition of tyranny." Federalist No. 47 (1788). Thomas Jefferson agreed, labeling such a concentration of power as "precisely the definition of despotic government." Notes on the State of Virginia, Query 13 (1784). At the national level, the Founders addressed this tendency towards tyranny in two ways. First, they recognized that the only way to limit each official's power was to limit each office's power—that is, to divide the sovereign power of government across different offices and separate branches. The Founders therefore divided federal power across three different branches and numerous different officials. Second, the Founders wisely realized they could not trust mere "parchment barriers against the encroaching spirit of power," Federalist No. 48, and thus, to keep officials within those limits, used "ambition to counteract ambition," aligning the "interest of the man with the constitutional rights of the place." Federalist No. 51. The Founders thus created a system in which not only does no single official possess plenary power, but officials must also battle each other to exercise power. In that constitutional system, "the private interest of every individual" runs counter to the private interest of every other individual. Id. The Founders ensured, in other words, that each individual official's inherent desire for more power would serve as a separate "sentinel over the public rights." Id. The Founders created this system by dividing the government's powers among, and even within, three separate and competing branches. Here's a quick snapshot of how they did it: As Article I of the Constitution makes clear, the Legislative Branch enacts legislation, levies taxes, regulates interstate commerce, appropriates money, and (at least theoretically) declares war. The Constitution further divides the Legislature into two bodies, the House and Senate. The Executive Branch, established in Article II, implements the laws created by Congress, and the President makes treaties, serves as Commander in Chief, and appoints federal judges and principal officers. Finally, the Judiciary, established in Article III, declares what the law is—by interpreting the Constitution and laws, and applying them to specific cases and controversies. The Founders then enmeshed each branch's powers in an elaborate system of checks and balances, whereby the branches (attempt to) keep each other in line. For example, although Congress enacts legislation, the President can veto it (subject to an override by a two-thirds vote of each house of Congress). While the President appoints officers, the Senate has the power to give advice and consent to those appointments, and also to the President's treaties. And although federal judges enjoy life tenure and salary protection, they are empowered only to apply the law rather than make it, and they can be impeached. This system cannot function, though, if the branches do not fulfill their constitutionally- designated roles and jealously guard their prerogatives when other branches encroach. The system fails and liberty suffers if the Executive acquiesces in congressional action that divests it of executive power; if Congressional representatives become so obsessed with merely remaining representatives that they are supine in the face of Executive overreach; or if the Judiciary fails to leave the legislating to Congress. For many decades, the branches took their duties seriously and defended their powers against one another. The Framers carefully calibrated the Government's powers among the three branches with the aim of cabining governmental power in order to preserve liberty. During Liberty Month, we would do well to brush up on these principles. They will be needed in the days ahead. Ryan J. Watson and James M. Burnham are appellate lawyers at Jones Day.     ANOTHER WORD ON THE PRESIDENT’S STATUTORY AUTHORITY OVER AGENCY ACTION Nina A. Mendelson* By delegating to the “Secretary” or the “Administrator,” has Congress indicated an intent regarding presidential control of executive branch agencies? This seemingly simple interpretive question has prompted significant scholarly debate.1 In particular, if the statute names an executive branch agency head as actor, can the President be understood to possess so-called “directive” authority? “Directive” authority might be understood to cover the following situation: the President tells the agency head, “You have prepared materials indicating that options A, B, and C each satisfies statutory constraints and could be considered justified on the agency record. The Administration’s choice will be Option A.” The President could, of course, offer a reason— perhaps Option A is the least paternalistic, most protective, or most innovation-stimulating of the three. If the option preferred by the President otherwise complies with substantive statutory requirements on the record prepared by the agency,2 the question is whether the statutory reference to “Administrator” or “Secretary” should be understood as a limit on the President’s authority to direct the executive branch agency official to act in a particular way. Rose* Anti-Federalism is generally thought to represent a major "road not taken" in our political history. The Anti-Federalists, after all, lost the great debate in 1787-88, while their opponents' constitution prevailed and prospered over the years. If we needed proof of the staggering vic- tory of the Federalist Constitutional project, the 200th anniversary cele- brations of 1987 would certainly seem to have given it, at least insofar as victory is measured by longevity and adulation.' One of the most imposing signals of the Federalists' triumph is the manner in which their constitution has come to dominate the very rheto- ric of constitutionalism. This is particularly the case in the United States, where the federal Constitution has the status of what might be called the "plain vanilla" brand-a brand so familiar that it is assumed to be correct for every occasion. This Constitution is the standard by which we understand and judge other constitutions, as for example those of states and localities. 2 Indeed, the federal Constitution's rhetorical dominance extends to some degree even to other parts of the world, when foreign citizens look to it for guidance about their own governmental 3 structures.   • Constituting Federalism
    1 Constituting Federalism The ideas denoted by the term "federalism" have been central to the American constitutional order, and federalism as a political form plays an increasingly important role around the world. This seminar will focus on the United States constitutional experiences with federalism, a term not mentioned in the U.S. Constitution, but one that has, since the second half of the twentieth-century, become frequently invoked in constitutional discourse. Federalism is proffered as an explanation when justices approach questions of whether to override congressional judgments about the deployment of national powers or to preclude states from regulating particular arenas. Beneath the mix of interpretations of the Constitution and the sometimes dry discussions of jurisdictional rules and doctrines of comity lie conflicts about equality, immigration, criminal procedure, regulation of the economy, protections to be accorded workers and consumers, and the authority of states, Indian tribes, and localities. These will be the subjects of discussion at the seminar. The seminar meets Friday afternoons, 2:00–5:00 p.m., February 7, 14, and 21, and 28 at the New-York Historical Society, 170 Central Park West, New York City. Rubinfeld School of Law (Boalt Hall) University of California at Berkeley INTRODUCTION However history assesses the Reagan Presidency, there is little doubt that it has challenged in a central way how we conduct our national fiscal policy. The old axioms of federal spending, tax, and debt policy have each been threatened by at least one Reagan policy initiative.1 No less important is the Reagan challenge to our current structure of federal-state-Iocal fiscal relations. While the core reforms of the Reagan New Federalism proposal never quite made it into law, the Reagan budgets have significantly curtailed the levels of federal support for state and local governments.2 Perhaps most importantly, the Reagan federalism initiatives have forced a serious rethinking of the evolutionary path of our federalist public economy, an evolution that has moved the financial and management responsibility for public goods and services steadily upward to the national level.3 What was once an interactive network of independent local and state governments has become an interlocking hierarchy of governmental subdivisions financed and managed to an increasing degree from Washington.4 The Reagan challenge has forced us to ask a fundamental question: Is this the federalist structure we really want? Any clear answer to this question requires a well-articulated view of what a federalist economy can do. In this exploratory essay, there is no reason not to ask for a first-best economy in which all resources are efficiently allocated and fairly distributed.

In particular, I ask whether the theory and practice of autonomism is consonant with federalist principles. ‘‘Autonomism’’ is a normative term that advocates the use of autonomist principles, and it has an intricate relationship with federalism, but is generally distinct from it. Autonomists are wary of federalism because they believe it has homogenizing and uniformizing tendencies. Autonomism as an ideology of territorial order and institutional design exhibits a number of clear anti-federalist stances, but yet it is based on the general federalist principle that multiple levels of government can lead to better governance in multinational states.     American Studies Mr. Carlson The Federalists Alexander Hamilton, James Madison, and John Jay Background on the Papers: Today, The Federalist Papers is the single greatest source of information on the Constitution of the United States. These documents provide the ideas about and explanations for what the Founding Fathers were trying to accomplish writing the United States Constitution. The Federalist Papers is a collection of essays, or a treatise1, on what a free government can and should do to make sure there is peace and security for their country. The Federalist papers were written to convince people that ratification of the Constitution was a good plan for the country. Many people today do not realize how the Constitution was a revolutionary change in how governments were organized. During the Constitutional Convention, the delegates rebelled against the existing Articles of Confederation and needed the states to ratify the Constitution as a plan for the government. The delegates did not seek approval from the government set up by the Articles of the Confederation.
