Fernanda Stinchi Pascale Leonardi 3 RESUMO O desenvolvimento de novas tecnologias da informação e a popularização da internet como principal meio de comunicação da sociedade contemporânea impactou diretamente a produção cultural, objeto de tutela do direito autoral. Estas novas tecnologias modificaram e facilitaram a forma como criamos, reproduzimos e compartilhamos obras intelectuais. No entanto, esta facilidade é aplicável tanto para utilizações legais como ilegais. A atual Lei de Direitos Autorais (Lei nº 9.610/98), elaborada em um contexto anterior à era digital, mostra- se anacrônica com relação a estas modificações, sendo insuficiente para coibir utilizações ilegais e inflexível com relação a determinadas utilizações relacionadas ao direito constitucional de acesso à cultura, que são viabilizadas no contexto digital, mas não previstas na lei. Com base neste diagnóstico, o Ministério da Cultura elaborou e levou à consulta pública um Anteprojeto de Reforma da Lei de Direitos Autorais em 2010, contando com uma revisão em 2011, e que foi engavetado no fim do mesmo ano. Os textos consolidados destas duas fases da consulta contaram com a participação de diversas partes interessadas na reforma, e incluiu um conjunto de modificações voltadas a adequar a lei à sociedade da informação. Buscou-se, no presente trabalho, avaliar se os textos do Anteprojeto corrigiram satisfatoriamente os anacronismos da lei anterior. Para isto, buscou-se primeiramente identificar quais são as principais funções do sistema normativo dos direitos autorais frente à sociedade, das quais abstraiu-se a função promocional (estimular a criação intelectual) e a função social (viabilizar o acesso à cultura). Com isto em mente, analisou-se o impacto das novas tecnologias com relação (i) ao suporte em que as obras são fixadas; (ii) ao meio em que as obras são compartilhadas; e (iii) às formas de criação que surgem e se popularizam neste novo contexto. Após isto, estabeleceu-se um panorama das reações regulatórias, elaboradas nos moldes do sistema tradicional de direito autoral, a este novo cenário, avaliando como estas regulações cumpriram ou prejudicaram o cumprimento das supramencionadas funções do direito autoral. A partir do diagnóstico estabelecido por este panorama, foi possível avaliar a compatibilidade ou incompatibilidade do Anteprojeto no contexto atual. Como conclusão, por mais que o APL ainda carregasse falhas e inadequações, ele foi consistiu em um grande avanço com relação à legislação atual. Infelizmente, seu engavetamento resultou em um retrocesso aos movimentos de reforma no sistema, que permanece estático até os dias de hoje. Palavras-Chave: Direito Autoral; Reforma da Lei de Direitos Autorais; Propriedade Intelectual; Regulação da Internet; Direito e Tecnologia. 4 ABSTRACT The development of new information technologies and the popularization of the Internet as the main form of communication of the contemporary society had a direct impact in cultural production, one of the main objects of Copyright Law. These technologies changed and facilitated the way one creates, reproduces and shares intellectual works. Nevertheless, this is applicable both to legal and illegal uses of copyrighted material. The current Brazilian Copyright Act (Lei nº 9.610/98), formulated shortly before the digital era, is anachronistic in relation to those modifications, being insufficient to prevent illegal uses of copyrighted works, and inflexible in relation to some uses that are only feasible in the digital context, but are directly related to the constitutional right to access to culture. With this diagnostic in mind, the Ministry of Culture drafted and put into public consultation a Copyright Act Reformation Bill, aiming to adequate the regulatory system to this new context. The public consultation was undertaken in 2010, and the consolidated bill was revised in 2011. By the end of that year, the bill was shelved. Both consolidated texts had the participation of multiple stakeholders. The main objective of this work is to evaluate the compatibility of the bill in the context of the information society. In order to do this, we first identified the main functions of Copyright law: the promotional function (stimulate the cultural production) and the social function (ensure access to culture). With that in mind, we analyzed the impact of new information technologies in relation to (i) the support in which the copyrighted work is affixed; (ii) the medium in which the works are shared; and (iii) the new forms of creation that are enabled through digital technologies. After that, we established an overview of the regulatory reactions to those impacts. We then evaluated how those reactions influenced the fulfillment of the two aforementioned functions of Copyright. After this diagnostic, we were able to analyze and evaluate the Copyright Act Reformation Bill in relation to the information society. As a conclusion, even if the bill was not entirely adequate, it represented a huge step forward in relation to the current Copyright Act. Unfortunately, the fact that the bill was shelved represented a huge missed opportunity and a step back in relation the adaptation of the Copyright system in the digital era. In Internet governance debates, a myriad of actors is invested in defining the meaning of “freedom” in relation to Internet-specific technologies. A central component in meaning-making processes about Internet-specific technologies and their functions is the constant negotiation of online rights, such as personal privacy and freedom of expression. In the process of these and other contestations over what should or should not constitute Internet freedom, this study explores how a specific community of participants in the Internet governance debate, namely public-key cryptography advocates, has constructed a discourse in which “crypto” (encryption software) serves as an enabler of freedom. While the design of “crypto” aims to render online communication illegible to anyone but its intended recipient(s), the representation of crypto serves as a battlefield in a larger discursive struggle to define the meaning of Internet freedom. This thesis investigates how crypto- advocates, and in particular Cypherpunks, have articulated crypto-discourse: a partially fixed construction of meaning that establishes a relationship between “crypto” and a negative conception of Internet freedom, in relation to the state. I argue that crypto-discourse excludes other possible positive meanings of Internet freedom. In so doing, the discourse removes responsibility from democratic states to secure online rights and freedoms for their citizens.

    THE PIRATE BAY: BANDITISMO SOCIAL NO CYBERESPAÇO COMO MEIO DE CONSTRUÇÃO DE UMA COMUNICAÇÃO CONTRA-HEGEMÔNICA Fernando Raposo Tania Rodriguez RESUMO O presente trabalho discute o lugar da plataforma p2p The Pirate Bay em meio às teorias do cyberespaço e de teorias da comunicação contra-hegemônica, buscando compreender o sentido da pirataria por meio de proposições teóricas que ob- servam o fenômeno do banditismo social, tomando como aportes teóricos os livros Bandidos (1975), do historiador marxista britânico Eric Hobsbawm e TAZ – Temporary Autonomous Zone (1985). Para além da função de territorialização de culturas e imaginários culturais que exercem os meios comunicacionais na contemporaneidade, este ensaio parte fundamentalmente de dois questionamentos: que ferramentas epistemológicas estariam a contento da análise de um objeto que surge no seio das milhões de páginas polissêmicas, percebidas aqui como memórias culturais de nosso tempo, que habitam o ciberespaço?
