COVID response dominated everything until federal agents arrested Larry Householder early on July 21. Charged with racketeering in what the U.S. Attorney described as the largest public corruption and bribery scandal in Ohio history, Householder and four associates had been under covert investigation for over one year. Much of the bribery allegations center around the passage of the nuclear bailout bill, House Bill 6. Other top issues over the quarter included immunity for businesses, detrimental ballot reform, unemployment compensation, and workforce development, and collection of local payroll taxes due to COVID. New Speaker of the House Amid federal racketeering charges, House Republicans returned to Columbus in late July to vacate the office of Speaker, removing Larry Householder from the post. He remains a member of the House and is on the ballot for re-election in his southeast Ohio district. House Republicans elected Bob Cupp of Lima as Speaker of the House, this time without any Democrat votes as is the norm. Cupp, a veteran legislator, Supreme Court Justice, and lifelong public servant offered unifying words in his inaugural address.     Ohio General Election Guide General Election: November 3, 2020 Summary of Races: The biggest story in Statehouse races as we approach Election Day is the recent charges that have been brought against Larry Householder. The criminal complaint brought against him alleges he took part in a $61 million racketeering scheme. As the case pends in federal court, many of the campaign funds that the House Republican Caucus rely on for financial support have been frozen and likely will not be able to be accessed until after the election. In what is already a tough cycle because of the presidential election, having the financial resources compromised puts many of the races in question. Having competed against a super majority for several years and seeing the presidential election as a boon for their base, the House Democrats were already looking to pick up quite a few seats. With the new financial woes that the Republicans could face, Democrats see this election as their chance to bring better balance to the party scale in the People’s Chamber. This impact could bleed into the Senate races as well. It is also worth noting that although the House has voted Larry Householder out of the Speaker position, he remains a Representative and will also still appear on the ballot in his district. However, since the news of the criminal charges broke, four individuals have declared candidacies against him. Since the petition deadline had passed by the time of this arrest, all four opponents will be write-in candidates. At a minimum, there will be at least 19 new members of the House and five new members of the Senate.

    Government Aairs Update OHIO HOTEL & LODGING ASSOCIATION Sponsored by: IGS Energy June 5, 2019 OHLA Testifies Before Senate on Tax Fairness for Bookings Obtaining tax parity for hotels and other entities which book lodging stays by closing the loophole exploited by online travel companies that collect, but do not remit, the full amount of sales and lodging taxes they owe is important for our entire industry. OHLA’s Executive Director recently appeared before the Ohio Senate Finance Committee to urge their support for language included in the House version of the state budget to do just that. In recent years, at least 14 states have taken action to correct the tax remittance issue, which deprives state and local governments, and CVB destination marketing partners, from revenue generated by hotel stays. Pennsylvania became one of the most recent when it passed similar legislation in late 2018. Pennsylvania has a very comparable number of hotels and rooms, according to industry data. In that state, closing the OTC loophole is estimated to bring in $24 million dollars annually just from correct remittance of their 6 percent state lodging tax. With all Ohio markets having tax rates above that amount, and the largest markets having total tax rates at checkout of more than 17 percent, the financial impact in Ohio would be between twice and three times that of our neighbors to the east. Online travel companies have been able to remit taxes at a lower rate than hotel and lodging properties for years, even when selling the same product at exactly the same price to consumers.

Since the budget passed after our last GAC meeting, here is a summary of some of the provisions of HB 166, as passed, that are relevant to GAC members: • The Ohio Hearing Aid Assistance program was funded at $200,000/year to help cover the cost of hearing aids for children whose families (up to 400% of the poverty level) have commercial insurance that does not cover hearing aids; • A managed care claims fund was created under Medicaid. The fund is made up of money paid by MCOs to ODM to pay providers if reimbursement is stalled due to MCO systems issues; • Recoupment of overpayments to Medicaid providers limited to 365 days and MCOs much provide details on the services for which the recoupment is sought; • $675M was appropriated to ODE for local districts to provide wrap-around services for children in schools. The funding is focused on improving student wellness and success; • Competitive grants of up to $100,000 will be available through the department of public safety for non-profit organizations to make security improvements Legislators returned to Columbus this week and have resumed committee hearings and session days. Since this is the first year of the two year legislative cycle, there is still plenty of time for legislation to be introduced and passed.
