On the basis of information furnished by the registrant, the above named pesticide is hereby registered/reregistered under the Federal Insecticide, Fungicide and Rodenticide Act. Registration is in no way to be construed as an endorsement or recommendation of this product by the Agency. In order.to protect health and the environment, the Administrator, on his motion, may at any time suspend or cancel the registration of a pesticide in accordance with the Act. The acceptance of any name in connection with the registration of a product under this Act is not to be construed as giving the registrant a right to exclusive use of the name or to its use if it has been covered by others. This product is conditionally registered in accordance with FIFRA sec 3(c)(7)(a) provided that you: 1. Submit and/or cite all data required for registration of your product under FIFRA sec. 3(c)(5) when the Agency requires all registrants of similar products to submit such data; and submit acceptable responses required for re-registration of your product under FIFRA section 4. 2. Make the labeling changes listed below before you release the product for shipment: a. Revise the "EPA Registration Number to read, EPA Reg. No. 74559-7". No. 74559-7 b. The following revisions must be made to the proposed label: o Add the statement "the product is not recommended for use on carpets made from polypropylene/olefm fibers. Submitted efficacy data did not support claims made to this type of carpet fiber. o On page 1, the following language must be removed underneath the Product Name must be removed: o (Insert usage site) o Sanitizer (where the term is used multiple times) o Destroyer and eliminator Fast Acting o Carpet Spot and Stain Sanitizer for pet messes o Cleaner (where the term is used multiple times) o Pet and Stain (where the terms are used multiple times) o Dual Action, Triple Action, Multiple Purpose (where the terms are used multiple times) o Antibacterial (where the term is used multiple times) o All terms in reference to "booster" o Large area sanitizer • On page 2, delete most of the Recommended Use (Location) table. The only use acceptable for this table is for soft surfaces. The product is being marketed for treatment soft surface areas. The use sites in this section are for non-hard porous surfaces. • On page 3, Under Directions for Use, contact times must be added "to spot sanitize" and "To use as a precleaner (sanitize[r])". • All references throughout the label that states "(x)" in conjunction with a claim for "minutes" or "hours" must be qualified with the actual contact time. • On page 5, the claim (spot clean and) must be removed. The way the claim is worded, the term may give the impression that "cleaning" is associated with pesticidal activity. • All references throughout the label that states "'eliminates', "controls", "sanitizes and eliminates...allergens", "permanently" or 'removes (x%)' in conjunction with the term "allergen" must be removed. These terms are false and misleading and may imply pesticide prevention. Moreover, no data were submitted to support the claims. • On page 5, the reference "(x%) of (bacteria)" must be qualified to "99.9% of bacteria". • On page 5, include the "ATCC numbers" for the organisms listed. • All references throughout the label that states "Controls", "destroys", "eliminates" and "eliminates... the growth" in conjunction with the term bacteria" must be removed. The term is false and misleading because it implies that the product will kill a wide variety of different bacteria. PageS EPA Reg. No. 74559-7 On page 7, the following claims must be removed: o Boost cleaning performance to also sanitize o Sanitization 'boost' o Boost your cleaning results with proven sanitizing power o Improve your cleaning results with proven sanitizing power The claims are false and misleading because it may imply heightened efficacy. Some of the claims may give the impression that "cleaning" is associated with pesticidal activity. On page 7, the claim "Large area sanitizer" must be removed. The directions for use of this product specify that sanitization is to occur for spot treatment areas. On page 7, remove the statements, "Goes beyond normal cleaning"; "Kills bacteria for a deep down clean"; and "Kills bacteria that ordinary cleaners don't". These terms are false and misleading because implies that "cleaning" has heightened efficacy. On page 8, delete "(& more)". The term is broad and ambiguous. On page 11, remove the claim, "No reselling". The term is false and misleading because it may imply that the product has residual activity. On page 11, remove the statement, "Safe for all carpets". This statement is misleading since efficacy data did not support use on all types of carpet fibers. All of the following claims listed throughout the label must be removed: o Protects families o Healthier Homes o Healthy Home o Designed with families... o Safe for families o Safe for children and pets o Family friendly o Pet and family friendly The claims are false and misleading and imply safety around families and children. Pesticide products are considered toxic and must be used according to labeling directions. No product has absolute safety. On page 11-12, the following claims must be removed: o Non-irritant to skin and eyes o Non-irratant to skin o No need for gloves o Non-irritant to eyes o Gentle on your soft surfaces o Friendly to your soft surfaces o Mild o Safe o Gentle... for your carpet Page 4 EPA Reg. No. 74559-7 o Safe and gentle for your carpet o Gentle on your carpet o Gentle o Proven to work with fading, discoloring, damaging The claims are false and misleading and imply safety. • On page 12, remove the term "Simple Power". The term is false and misleading because it may imply heightened efficacy. If these conditions are not complied with, the registration will be subject to cancellation in accordance with FIFRA sec. 6(e). Your release for shipment of the product constitutes acceptance of these conditions. A stamped copy of the label is enclosed for your records.
