Term Attachments Attachment "A", Letter of Assent Attachment 'B", MOU on Drug Abuse Prevention and Detection Signature Page Craft Request Form PROJECT LABOR AGREEMENT CITY OF LOS ANGELES DEPARTMENT OF PUBLIC WORKS BUREAU OF ENGINEERING FlRE STATION No. 64-SOUTH LOS ANGELES INTRODUCTION AND FINDINGS The project involves the construction of the new FlRE STATION No. 64-SOUTH LOS ANGELES, with a gross area of approximately 24,600 combines square feet for the two buildings (a two-story Fire Station and one-story Apparatus Storage Building) to house LAFD personnel, site parking, apparatus equipment storage, and a multi- purpose facility, located on the existing and active Fire Station No. 64.site and adjoining vacant lots at Main and 108th Streets. The new fire station building will house LAFD personnel and active operations on a 2417 schedule. The new structure will contain, but not limited to, the following elements; lights and heavy apparatus bays, offices and related support areas, command office, conference room, dormitories for the command officer, firefighter and paramedics, apparatus storage, maintenance pit and a multi-purpose facility. The purpose of the Agreement is to p romote efficiency of construction operations during the construction of the FIRE STATION No, 64-SOUTH LOS ANGELES Project and provide for orderly settlement of labor disputes and grievances without strikes or lockouts, thereby promoting the public interest in assuring the timely and economical completion of the Project. WHEREAS, the successful completion of the Project is of the utmost importance to the Los Angeles Fire Department, Department of Public Works, and the general public in the City of Los Angeles; and WHEREAS, large numbers of workers of various skills will be required in the performance of the construction work, including those to be represented by the unions affiliated with the Los AngeleslOrange Counties Building and Construction Trades Rev. 050912 3 of 36 Council and any other craft labor organization which is signatory to this Agreement, employed by contractors and subcontractors who are signatory to agreements with said labor organizations; and WHEREAS, it is recognized that on a project of this magnitude with multiple contractors and bargaining units on the job site at the same time over an extended period of time, the potential for work disruption is substantial without an overriding commitment to maintain continuity of work; and WHEREAS, the interests of the general public, the City of Los Angeles, the Unions and ContractorlSubcontractorlEmployerwould be best served if the construction work proceeded in an orderly manner without disruption because of strikes, sympathy strikes, work stoppages, picketing, lockouts, slowdowns or other interferences with work; and WHEREAS, the ContractorlSubcontractorlEmployer and the Unions desire to mutually establish and stabilize wages, hours and working conditions for the workers employed on the Project by the ContractorlSubcontractorlEmployer,and further, to encourage close cooperation among the Contractor/Subcontractor/Employer and the Unions to the end that a satisfactory, continuous and harmonious relationship will exist among the parties to this Agreement; and WHEREAS, this Agreement is not intended to replace, interfere with, abrogate, diminish, or modify existing local or national collective bargaining agreements in effect during the duration of the Project, except to the extent that the provisions of this Agreement are inconsistent with said collective bargaining agreements, in which event, the provisions of this Agreement shall prevail; and further, it is understood that General contractors and each sub-contractor are bound and shall remain bound, for the duration of this Project, by the terms of this Agreement and the applicable local and national collective bargaining agreements for the craft work performed, established between the - signatory Unions and contractors, in effect and covering the area of this Project. The provisions of this Agreement, including the signatory Craft Unions' local collective bargaining agreements may be changed from time to time consistent with the Rev. 050911 4 of 36 procedures contained in each agreement, and which are incorporated herein by reference shall apply to the work covered by this Agreement, notwithstanding the provisions of any other local, area and/or national agreement which may conflict with or differ from the terms of this Agreement; provided, however, that such does not apply to work performed under the National Cooling Tower Agreement, the National Stack Agreement, the l'dational Transit Division Agreement (NTD, or within the jurisdiction of the International Union of Elevator Constructors, except that Articles dealing with Work Stoppages and Lock-Outs, Work Assignments and Jurisdictional Disputes, and Settlement of Grievances and Disputes shall apply to such work. Where a subject covered by the provisions of this Agreement is also covered by Craft Union's collective bargaining agreement, the provisions of this Agreement shall apply. Where a subject is covered by a provision of Craft Union's collective bargaining agreement and not covered by this Agreement, the provision of the collective bargaining agreement shall prevail. Any dispute as to the applicable source between this Agreement and any Craft Union's collective bargaining agreement for determining the wages, hours or working conditions of employees on this Project shall be resolved under the procedures of Article IX; and WHEREAS, the contractors for the construction of the Project will be awarded in accordance with the applicable provisions of the Los Angeles Charter and the Los Angeles Administrative Code; and WHEREAS, the Agreement is not intended to have an adverse impact on the policy of the City of Los Angeles to maximize business opportunities for minority and women businesses in the City contracts; and WHEREAS, the City has the absolute right to select the lowest and best regular responsible bidder for the award of construction contracts on the Project; and Rev. 050912 WHEREAS, the parties signatory to this Agreement pledge their full good faith and trust to work towards a mutualy satisfactory completion of the Project; NOW, THEREFORE, IT IS AGREED BETWEEN AND AMONG THE PARTIES HERETO, AS FOLLOWS: Rev. 050912 ARTICLE I DEFINITIONS 1.1 "Agreement" means Project Labor Agreement. 1.2 "Board" means the City of Los Angeles Board of Public Works. 1.3 "City" means the City of Los Angeles. 1.4 "Committee" means Joint Administrative Committee as described in Article XI1 of this Agreement. 1.5 "Construction contract" means all City contracts which have been certified by the City Controller, awarded by the Board, and which are necessary to complete the Project. 1.6 "Contractor/Employer(s)" or "ContractorIEm ployer1Owner Operator(s)" means any individual firm, partnership, owner operator, or corporation, or combination thereof, including joint ventures, which is an independent business enterprise and has entered into a contract with the Board or any of its contractors or subcontractorslowner operators of any tier, with respect to the construction of any part of the Project under contract terms and conditions approved by the Board and which incorporate the Agreement. 1.7 "Council" means Los AngelesIOrange Counties Building and Construction Trades Council. 1.8 "Engineer" means the City Engineer of the City of Los Angeles or its authorized representative. 1.9 "Letter of Assent" means agreement acceptance letters by all Subcontractors/ - Employer(s) or Owner Operators. Rev. 0509 11 7 of 36 1.10 "Plan" means the Plan for the Settlement of Jurisdictional Disputes in the Construction Industry as described in Article XIV of this Agreement. 1.1 1 "Project" means the Cityawarded construction contract(s) for the FIRE STATION NO. 64 - SOUTH LOS ANGELES. 1.12 "Union(s)" or "Signatory Unions" means the Los AngeleslOrange Counties Building and Construction Trades Council affiliated with the Building & Construction Trades Department (AFUCIO) Craft International Unions and any other craft labor organization signatory to this Agreement, acting in their own behalf and on behalf of their respective affiliates and member organizations whose names are subscribed hereto and who have through their officers executed this Agreement.
