    REMARKS: PRESIDENTIAL SUCCESSION AND IMPEACHMENT: HISTORICAL PRECEDENTS, FROM INDIANA AND BEYOND JOHN D. FEERICK* I thank you for the opportunity to address you today on presidential succession and the impeachment provisions of the Constitution. Two heroes in my life as a lawyer are from this state. The first is former U.S. Senator Birch Bayh, who I first met in January 1964 when the American Bar Association assembled twelve lawyers and their guests to develop a position with respect to the subjects of presidential inability and vice-presidential vacancy. Bayh became the undisputed leader of the movement for change as a way of honoring a fallen President, John F. Kennedy, whose assassination two months before the ABA conference focused the nation on the gaps in the presidential succession system. Bayh also inspired me in the importance of a lawyer rendering public service. It is inspiring for me to give these remarks below the Speaker’s chair that he occupied. The second hero is Dean James White, a longtime professor at this law school, who served for thirty years as a consultant to the ABA in the areas of admission to the bar and legal education. He helped me transform from a practicing lawyer to an academic lawyer as a dean and professor at Fordham Law School. Today’s program on Indiana’s Vice Presidents of the United States is also part of my Indiana history. In 1966, I was asked to write a book for high school students, a first of its kind, on the vice presidents, which I proceeded to do with the help of my wife, Emalie.1 I learned in the process of four of the six Vice Presidents from Indiana: Schuyler Colfax, Thomas Hendricks, Charles Fairbanks, and Thomas Marshall.

BRINGING THE VICE PRESIDENT INTO THE FOLD: EXECUTIVE IMMUNITY AND THE VICE PRESIDENCY Abstract: The vice presidency of Dick Cheney from 2000 to 2008 raised complicated questions about the constitutional and legal position of the Vice President, including the Vice President's amenability to civil suits for damages. The U.S. Supreme Court's executive immunity jurisprudence has established that the President can claim absolute immunity for official acts, while cabinet members and presidential aides can assert only quali- fied immunity. No court has ever determined if the Vice President should be granted absolute or qualified immunity in civil suits for damages. Ac- knowledging that the vice presidency is an increasingly important politi- cal office, this Note argues that neither the Vice President's constitutional status nor his specific functions justify a grant of absolute immunity, This Note asserts that although the Vice President could claim some limited form of legislative immunity, qualified immunity is the appropriate stan- dard in most suits for damages.

    Agnew -Des Moines Speech----1 Vice President Spiro Agnew Speech at Des Moines, Iowa: Nov. 13, 1969 BACKGROUND TO AGNEW’S SPEECH On November 3, 1969, Nixon told the American people in a televised address that his new Vietnamization policy, what already had become known as his ”Nixon Doctrine,” would bring peace by withdrawing American ground combat forces from the country and having the Vietnamese fight their own war. Military aid would continue, but American troops would come home, though not on any fixed timetable. Below are excerpts from Nixon’s speech on November 3: Good evening, my fellow Americans. Tonight I want to talk to you on a subject of deep concern to all Americans and to many people in all parts of the world, the war in Vietnam. Now let me begin by describing the situation I found when I was inaugurated on January 20: The war had been going on for four years. Thirty-one thousand Americans had been killed in action. The training program for the South Vietnamese was beyond [behind] schedule. Five hundred and forty- thousand Americans were in Vietnam with no plans to reduce the number. No progress had been made at the negotiations in Paris and the United States had not put forth a comprehensive peace proposal. Their daughter and son-in-law, I think, stayed and packed all their clothes. So, we had to go back to our little house in Alexandria, Virginia, and for the first seven days of dad's presidency, and I remember that first meal after Dad became president -- after he got sworn in that day, we're sitting around the dinner table, and my mother was cooking and my mother looked over at Dad. She was at the stove, and she goes, 'Jerry, something's wrong here. You just became president. And I'm still cooking.' And that was the memory that sticks out the most of what a strange time that was -- that, for seven days, we had to live in our little house in suburbia and Dad would commute to the Oval Office.

After his presidency, Benjamin Harrison returned to his law practice and helped resolve the border dispute between Venezuela and British Guiana. 13. Before he was president, Chester Arthur was known as an abolitionist who won several cases for the "runaway slaves" he defended. 14. William McKinley defeated William Jennings Bryan, another well-known attorney, in the presidential election of 1896. 15. Franklin Roosevelt entered the presidency during one of the worst points of the Great Depression but helped the nation recover by entering into the New Deal and World War II.
