Judicial Review of Political Questions in Nigeria and Malaysia: a Comparative Analysis JUDICIAL REVIEW OF POLITICAL QUESTIONS IN NIGERIA AND MALAYSIA: A COMPARATIVE ANALYSIS BY SAMBO OLADAPO ABDULFATAI A thesis submitted in fulfilment of the requirement for the degree of Doctor of Philosophy Ahmad Ibrahim Kulliyya of Laws International Islamic University Malaysia APRIL 2013 ABSTRACT This thesis aims at finding the Nigerian and Malaysian courts‘ approach or attitude in the exercise of judicial review power on political questions. Because of similar circumstances stated in the research, these two jurisdictions are chosen. The researcher develops the pragmatic theory in order to delimit the meaning and scope of political questions. This is borne out of the weaknesses in the classical and prudential theories on the doctrine of political questions to realistically delimit the meaning and scope of political questions. Based on this premise, the thesis analyses the two jurisdictions‘ approach or attitude in the exercise of judicial review power on political questions. To achieve the aims of this research, the thesis analyses the concept of judicial review and political questions as well as the legal frameworks for judicial review as affecting political questions. It uses many case laws to analyse the reactions of the courts to political questions flowing from legislative actions, executive actions and affairs of political parties over the years with July, 2012 being the cut-off date of the research. Interviews with many stakeholders formed the basis of the research findings. The thesis finds that political questions though appear political in nature have come with legal and constitutional stings which the courts need to interprete. However, the legal frameworks on the exercise of judicial review power on political questions are weak and inadequate mainly because of ouster of the courts‘ jurisdictions. It further finds that the courts in Nigeria have abandoned its initial application of political question doctrine. While it now largely reviews political questions, Malaysian courts refrain from this practice to a large extent. To this extent, the thesis finds that judicial review or judicialisation of political questions is the current doctrine in Nigeria. It therefore reveals the merits and the risks in this practice. It also finds the legal and political implications of the practice. The thesis also reveals major legal impediments and constitutional usefulness of judicial review of political questions. As a result of this finding, the thesis recommends constitutional and legislative amendments in order to allow the courts properly decide, on their merits, matters which appear political in nature but with legal and constitutional stings.     Punishment for Apostasy: Conflict Between the Right to Freedom of Religion and Criminal Sentence, A Case Study in Malaysia Mohamed Azam Mohamed Adil Abstract My article is concerned with the conflict in laws between freedom of religion and law of apostasy within the broader Malaysian constitutional framework. The issue is controversial because, while freedom of religion is guaranteed in the Malaysian Constitution, some respective states in Malaysia have treated Muslims who intend to leave the Islamic faith as criminals. Even though there is no death penalty for apostasy in Malaysia, apostates shall be detained, fined or punishable with imprisonment up to three years. Such punishments seem contrary to the provision of Article 11(1) of the Federal Constitution which guarantees the right of freedom of religion. It also deprived individual liberty as provided in Article 5(1) of the Federal Constitution. Moreover, these punishments also seem contrary to Article 4(1) of the Federal Constitution that maintains the supremacy of the Constitution, and Article 75 that upholds the Federal law powers in the event where State law is inconsistent with the Federal law. This article seeks to study in depth the notion of the right of freedom of religion and the question of apostasy from the Malaysian laws perspective. In doing so, this article will investigate whether Muslims are given the right to leave the Islamic faith and to choose and profess any religion they wish as guaranteed under Article 11(1) of the Federal Constitution. This article will also highlight the problems surrounding the provisions in relation to law of apostasy in Malaysia.

Unlike in a unitary state, each level has final authority and can be self-governing in some area. In Malaysia, after 12th General Election, there were many issues had arisen as to the running of the system after four states come under the administration of the opponent parties. This study examines the historical background of Malaysian federalism and the historical impact on the current system. It also seeks to analyse the pattern of the federalism in three phases that is, pre- independence, post- independence and after 12th General Election 2008 (GE). The pattern will be analysed based on decided cases and issues that arose between the federal and the states government especially the opponent states. This is to identify the relation between the history and federalism in Malaysia and to what extend the history affects the running of the system. The discussion would focus on the characteristics and the running of the system under the said phases. This thesis seeks to establish that the nature of the Malaysian Federalism has substantially changed from its ideal characteristics. This study argues that there is a lack of constitutional safeguards for the states since the Federal Constitution vests overwhelming power in the Federal authorities.

The Declaration has given rise to many other important human rights documents such as the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights in 1966, the Convention on the Prevention and Punishment of the Crime of Genocide in 1951 and the Convention on the Rights of the Child. Not only did the UDHR become the catalyst for international conventions, it also found its way into many national constitutions and regional conventions, where it became the founding legal document for many aspects of state relations with its citizens. For the purposes of this article, the national judiciary of Malaysia will be the focus of our analysis on how they have decided disputes in relation to human rights questions, with specific reference to issues relating to the right of religion and freedom of expression, association and assembly within the national and international law framework.
