Adoption of draft agenda (1) OJ–PE630.537 The draft agenda was adopted. 3. Approval of minutes of the meeting of: 03 September 2018 24 September 2018 08-09 October 2018 The minutes were approved. _________________________ (1) In accordance with the committee’s Guidelines 2016, items in sections B of the draft agenda will not be discussed during the current meeting. However any PETI Member may ask before the end of the meeting for an item in section B to be kept open; it will then be automatically included in the Coordinators’ agenda for a decision on its further treatment at a subsequent Coordinators’meeting. Chair's announcements The Chair announced that Mrs Virpi Köykkä, current Head of Unit of the PETI Secretariat (since February 2015) would leave the secretariat at the end of November and that Mrs Leticia Zuleta de Reales Ansaldo would be the new acting Head of Unit in PETI as of 1st December. 5. Report on the Annual report on the activities of the European Ombudsman in 2017 (2018/2105 (INI)) Rapporteur: EVI (EFDD) The draft report as amended was adopted with 26 votes in favour, 0 against and 0 abstentions. 8. Opinion on the proposal for amending Parliament’s Decision 94/262/ECSC, EC, Euratom of 9 March 1994 on the regulations and general conditions governing the performance of the Ombudsman’s duties(2018/2080 (INL)) (for AFCO) Rapporteur: AUKEN (Greens/EFA) The draft opinion as amended was adopted with 16 votes in favour, 0 against and 8 abstentions. 9. Opinion on the Implementation of the Treaty provisions related to the EU Citizenship (2018/2111(INI)) Rapporteur: MARIAS (ECR) The draft opinion as amended was adopted with 19 votes in favour, 1 against and 6 abstentions. 10. Fact-finding Visit to Famagusta, Cyprus (7-8.05.2018) (deadline for AM on the recommendations : 28.09.2018 at 15:00) - adoption of the draft FFV report Rapporteur: WIKSTRÖM (ALDE) The draft report as amended was adopted with 26 votes in favour, 0 against and 0 abstentions. Oral Question to the Council and to the Commission, on behalf of PETI and ENVI, on the Natura 2000 cases of violations based on the petitions received - consideration and adoption of a draft oral question AUTHOR: WIKSTRÖM (ALDE) The oral questions were adopted with 23 votes in favour, 0 against and 0 abstentions. *** End of voting *** The meeting resumed at 11:33 by the Chair. Petition 0356/2018 by Ivan Yanev (Bulgarian) on problems encountered by persons with disabilities in Bulgaria Speakers: Ivan Yanev (petitioner), Inmaculada Placencia Porrero (EC-EMPL), Svetoslav Hristov Malinov, Kostadinka Kuneva, Rosa Estaras Ferragut, Notis Marias . Decision: It was decided to keep the petition open and send a letter to the Bulgarian authorities. *** Mrs Rosa Estaras Ferragut (Vice-Chair) replaced the Chair at 12.00 *** 13. Petition 0805/2017 by Radosław Ślusarczyk (Polish), on behalf of seven Polish NGOs, on non-compliance of Polish legislation on forest management with EU environmental law and Petition 0812/2017 by Patricio Oschlies Serrano (Spanish) on Białowieża forest in Poland Speakers: Izabela Zygmunt (petitioner 805/17), Przemyslaw Oginski (EC-ENVI), Julia Pitera Decision: It was decided to keep the petition open, send a letter to the Polish authorities and inform the petitioners of the oral question tabled by PETI and ENVI committees on Natura 2000 violations (see item 11) and ask the Commission for further information. Opinion on the Proposal for a Directive of the European Parliament and of the Council on discontinuing seasonal changes of time and repealing Directive 2000/84/EC, COM(2018)639(2018/0332(COD)) (for TRAN) Speakers: Cecilia Wikström (Rapporteur) Notis Marias, Marlene Mizzi and Rosa Estaras Ferragut The deadline for amendments was fixed at 3 p.m. on 14 December 2018. The adoption of the opinion will take place on 20 February 2019. * * * at 14:35 * * * 15. Chair's announcements concerning Coordinators' decisions 1) Request for January and for later agendas All requests for the 21-22 January and 20-21 February meeting agendas were taken into account. Petitions concerning the lack of objectivity in the media (1024/2017, 277/2018, 283/2018, 0477/2017, possibly others) and 480/18 on a construction project will be incorporated into the agenda of 21-22 January. Petitions 490/2018 on whistle-blower protection in Romania and 156/2018 on the Tihange nuclear power station will be incorporated into the agenda of 20-21 February. The follow-up of a FFV to Galicia (2013) will be added to the agenda of 21/22 January. The follow-up of a FFV to the Ebro and Tajo rivers (2016) will be added to a later agenda, in spring 2019. Urgency procedures The request concerning petition 960/2018 concerning the construction of a shopping mall in Cinisello Balsamo (Milano) will be dealt with in an urgency procedure. 2) Procedure for the PETI Annual report 2018 Coordinators took note of the decision already taken in a written procedure (30 October). The draft report will be presented by the Chair in English only on 6 December. Deadline for amendments will be 14 December. The consideration and vote on the report will take place in PETI on 22 January in order to schedule the adoption of the report in the February plenary. 3) Planning for the remaining months Coordinators took note of all the requests but agreed that the decisions concerning the remaining agendas would be taken separately, according to the normal procedure. The secretariat was mandated to take stock on the old petitions for the January meeting. The Chair will send a letter to the Brexit Steering Group concerning the follow-up of the UK petitions and the right to petition during the possible transitional period. PE630.607v01-00 4/22 PV\1169564EN.docx EN 4) Contested recommendations Contested recommendations were adopted in the form proposed by Chair for petitions 527/2018, 534/2018 and 575/2018. - petitions 457/2018 and 458/2018 which will remain open and receive a follow-up - petition 526/2018 was declared admissible and closed. 5) Requests concerning B-items Petition 1384/2013 was closed, as was petition 19/2018 (ECR and EFDD were against its closure). Petitions 2453/2014, 663/2015, 783/2015, 793/2015, 121/2017, 1085/2017, 1194/2017 and 160/2018 remain open and will be followed up. 6) Fact Finding visits and hearings Coordinators took note of the revised list of participants and the programme for Valledora (Mrs James and Mrs Vallina have cancelled their participation) as well as of the plans to organise a public hearing jointly with ENVI and ITRE on climate change denial on 21 March 2019. 7) European Court of Auditors (ECA) Coordinators were invited to provide input to the European Court of Auditors work programme (2020) by 16 January; a decision will be taken on 21 January. Coordinators were also informed of the willingness of the ECA members to come to the Committee to present their reports. 8) Items for information Coordinators took note of the items for information: a) List 3 of petitions considered potentially non-compliant with art. 227 TFEU (petitions from 0846-2018 to 0905-2018 and from 0906-2018 to 0937-2018). 1.
