Public Authority: The Public Information Officer, O/o. the Commissioner of Police, Chennai City Police, Chennai-600 008 The Inspector of Police, D1 Triplicane Police Station, Walajah Road, Chennai-600 005 The petitioner and the Public Information Officer of the D1 Triplicane Police Station were present. The Public Information Officer from the Commissioner of Police Office was absent. The petitioner had sent a petition according to him on 7.11.09 asked for some details regarding his detention, to the Public Information Officer/D1 Triplicane Police Station, Wallajah Road, Chennai. It was sent by Speed Post and was refused and returned marked by the postal authorities that “ no such officer and returned to the Sender” and the envelope with the seal in that was produced before the Commission. and on opening it the Commission finds that an RTI petition with two court fee stamps affixed was contained therein. On this the complaint was filed before the Commission under Section 18 of the Act which came for the Enquiry to-day. The Public Information Officer present had no explanation to offer except to say that something has gone wrong but he has no other details and was only able to discuss about the case underlined RTI petition. The Commission therefore upholds the complaint of refusing the RTI petition without proper cause by the Public Information Officer, D1 Triplicane Police Station and direct the Commissioner of Police to file the explanation of the Public Information Officers concerned as to why the penalty clause of the Act should not be operated, within 4 weeks of this order, before the Commission. Since the information is asked for within 48 hours and has not been given within the next 24 hours and what was asked for is the copy of the complaint filed on behalf of the Labour Court Judge, Thiru S.F.Akbar, by Thiru Narayanasami, Personal Security Officer on 6.11.09 at the D1 Triplicane Police Station it may be supplied to the petitioner and his acknowledgement obtained and filed before the Commission.
