Ordinance prohibiting public exposure of “the female breast with less than a fully opaque covering of any part of the nipple.” Laconia, N.H., Code of Ordinances ch. 180, art. I, §§180-2(3), 180-4. The Supreme Court of New Hampshire affirmed their convictions in a published opinion rejecting state and federal Equal Protection Clause defenses. Contrary to federal appellate decisions, New Hampshire’s high court held an ordinance punishing only females for exposure of their areolas does not classify on the basis of gender. Alternatively, New Hampshire’s high court held the Ordinance would survive intermediate scrutiny anyway—a holding directly at odds with a recent Tenth Circuit decision, which in turn conflicts with decisions of the Seventh and Eighth Circuits. The questions presented are: 1. Does an ordinance expressly punishing only women, but not men, for identical conduct—being topless in public—classify on the basis of gender? 2. -

Application to Operate a Public Bathing Place Pennsylvania Department of Health June 2015 PA Department of Health Page 1 Public Bathing Place Application Instructions for Filling out the Application to Operate a Public Bathing Place Under the Pennsylvania’s Public Bathing Law (35 P. S. §§ 672-680d) and the regulations in 28 Pa. Code Chapter 18, it is unlawful to operate a public bathing place without first obtaining a permit from the Department of Health. Once construction has been completed, it is the responsibility of the owner/operator of the public bathing place to contact the district office of the Pennsylvania Department of Health and arrange for an operational inspection (See Page 3 – District Offices of the Department of Health). The purpose of the operational inspection is to ensure that the facility is operating in a safe and healthful manner and in compliance with the Public Bathing Law and the regulations in 28 Pa. Code Chapter 18. Upon satisfactory completion of the operational inspection, a permit to operate a public bathing place will be issued by the Department. To obtain a copy of the Department of Health regulations for public bathing places, contact the district office of the Department of Health or visit the following website: http://www.pacode.com/secure/data/028/chapter18/chap18toc.html. The applicant should consult with the design engineer or architect for the dimensions of each unit and the specifications for the recirculation, chemical treatment, and filtration equipment. A unit is an individual swimming pool, beach, hot tub, wading pool, or other artificial or natural body of water that is to be used for public swimming and bathing. -

TO SEE AND BE SEEN: RECONSTRUCTING THE LAW OF VOYEURISM AND EXHIBITIONISM Stuart P. Green* INTRODUCTION Lady Godiva was an 11th-century Anglo-Saxon noblewoman who lived with her husband, Lord Leofric, in the English village of Coventry.1 According to a legend dating back to as early as the 13th century, the compassionate Godiva, concerned about the harsh tax burden her husband had placed on his subjects, appealed to him, over and over, for their relief. At last, weary of her entreaties, Leofric set forth this challenge: if his wife would ride naked through the center of town, the tax would be lifted. Lady Godiva took him at his word, and the next day rode her horse down the main street of Coventry, covered only by her long hair. According to one version of the legend, a proclamation was issued that all persons should stay indoors and shutter their windows during Godiva’s ride.2 According to an alternate version, the people stayed indoors voluntarily, shuttered behind closed windows as a gesture of respect and appreciation for her actions on their behalf.3 In the end, Lord Leofric made good on his promise and announced that the tax burden on his subjects would indeed be lifted.4 A subplot in a later version of the Lady Godiva legend involves the role of a young tailor known forever after as “Peeping Tom.” According to the story, the lustful Tom drilled a hole in his shutters so that he might see Godiva pass. Persistent gender inequality may threaten economic growth and/or social progress.1 At the most micro level, discrimination impedes girls and women from achieving their individual hopes and dreams. Through its Millennium Development Goals, the United Nations has championed an increase in equality for women and girls across different sectors by 2015.2 Despite a push to promote females worldwide, one example of where progress remains stagnant is the U.S. film industry. Research reveals that the percentage of female speaking characters in top-grossing movies has not meaningfully changed in roughly a half of a century.3 Further, women are often stereotyped and sexualized when they are depicted in popular content. Occupationally, our previous research shows that few women hold positions of power and importance on screen. While Hollywood is quick to capitalize on new audiences and opportunities abroad, the industry is slow to progress in creating compelling and complex roles for females. -

PLAYING BY PORNOGRAPHY'S RULES: THE REGULATION OF SEXUAL EXPRESSION DAVID COLEt INTRODUCTION Sometimes a sentence is worth a thousand words. In 1964, as the Supreme Court stumbled toward a constitutional approach to obscenity, Justice Potter Stewart suggested that only "hard-core pornography" should be suppressed.' He admitted that the category may be incapable of "intelligibl[e]" definition, but 2 nonetheless confidently asserted, "I know it when I see it." Justice Stewart's sentence captures the essence of the Court's sexual expression jurisprudence, which rests more on the assertion of distinctions than on reasoned analysis. For many years, the Court, unable to agree upon a doctrinal framework for obscenity regulation, simply ruled by per curiam judgments, without offering any explanation for what it was doing.' When the Court did attempt to explain its actions, some suggested that it would have been better off maintaining its silence.' The Court has now put forward a set of doctrinal "rules" that in the end do little more than obscure what is basically Stewart's intuitive approach. In a weak moment, Mayor DiBlasio even threatened to rip up the pedestrian plaza where they have stationed themselves rather than allow them to continue appearing. But while the controversy over the rights of the desnudas goes on, a separate, but related, protest has surfaced.
