Please provide a general update on the situation for Movement for Democratic Change (MDC) members, both rank and file members and prominent leaders, in respect to their possible treatment and risk of serious harm in Zimbabwe. The situation for MDC members is precarious, as is borne out by the following reports which indicate that violence is perpetrated against them with impunity by Zimbabwean police and other Law and Order personnel such as the army and pro-Mugabe youth militias. Those who are deemed to be associated with the MDC party either by family ties or by employment are also adversely treated. The latest Country of Origin Information Report from the UK Home Office in December 2009 provides recent chronology of incidents from July 2009 to December 2009 where MDC members and those believed to be associated with them were adversely treated. It notes that there has been a decrease in violent incidents in some parts of the country; however, there was also a suspension of the production of the „Monthly Political Violence Reports‟ by the Zimbabwe Human Rights NGO Forum (ZHRF), so that there has not been a comprehensive accounting of incidents: POLITICALLY MOTIVATED VIOLENCE Some areas of Zimbabwe are hit harder by violence 5.06 Reporting on 30 June 2009, the Solidarity Peace Trust noted that: An uneasy calm prevails in some parts of the country, while in others tensions remain high in the wake of the horrific violence of 2008…. -

Date……………………… i ABSTRACT The Responsibility to Protect (RtoP) is an interdisciplinary normative framework that reconceptualises state sovereignty as a responsibility rather than a right. It obliges states to protect their people from humanitarian catastrophe, and in the event of state failure or unwillingness to heed this responsibility, requires of the broader international community to assume the residual duty to protect. When the principles of RtoP were endorsed by world leaders at the United Nations’ 2005 World Summit, it seemed as though the normative regime was gaining currency in international relations. However, the operationalization of RtoP continued to be dogged by controversy and conceptual ambiguity. This prompted UN Secretary-General Ban Ki-Moon in January 2009 to appeal to the international community to strengthen the “doctrinal, policy and institutional life” of the norm. This study responds to Ban’s call and seeks to complement efforts of scholars across the world to refine the conceptual parameters of RtoP. -

In brief: Zimbabwe – 2013 elections Standard Note: SN06695 Last updated: 5 August 2013 Author: Jon Lunn Section International Affairs and Defence Section Zimbabwe held presidential and parliamentary elections on 31 July 2013. They resulted in overwhelming victory for President Robert Mugabe and his Zimbabwe African National Union-Patriotic Front (ZANU-PF) and shattering defeat for Prime Minister Morgan Tsvangirai and his Movement for Democratic Change-Tsvangirai (MDC-T). The elections bring to an end over four years of ‘power-sharing’ under the February 2009 Global Political Agreement (GPA) that followed the violence-ridden elections of 2008, which were stolen by ZANU-PF. The 2013 elections were certainly extremely flawed – it had been obvious for some time that they would be – but there is no escaping the fact that President Mugabe and ZANU-PF have comprehensively outmanoeuvred their rivals since the GPA was agreed, in the process rebuilding a domestic political constituency on promises of ‘indigenising the economy’, combined with an often ruthless reassertion of a self-proclaimed ‘right to rule’. As one analyst, James Muzondidya, put it in an excellent book published earlier this year: The ZANU-PF strategy, consistent with its hegemonic political culture, has been to engage in cosmetic political and economic reforms that will not result in further democracy or result in a loss of its historic monopoly on power [...] Indeed, over the last four years, ZANU-PF has kept the strategic doors to its power, such as the security sector and the mining and agricultural industries, firmly closed. While acknowledging the major constraints that the opposition faced under the GPA, Muzondidya is highly critical of its performance, viewing its top leadership as often having been naive and noting that a significant number of MDC-T councillors at the municipal level became embroiled in corruption scandals, damaging the party’s claim to represent change. -

I also wish to refer to the President's letter, by which the Panel's mandate was extended until 30 November 2001 (S/2001/951), and the Panel was requested to submit, through me, an addendum to its final report. By the statement of its President of 2 June 2000 (S/PRST/2000/20), the Security Council requested the Secretary-General to establish a Panel of Experts on the illegal exploitation of the natural resources and other forms of wealth of the Democratic Republic of the Congo with the following mandate: (a) To follow up on reports and collect information on all activities of illegal exploitation of natural resources and other forms of wealth of the Democratic Republic of the Congo, including in violation of the sovereignty of that country; (b) To research and analyse the links between the exploitation of the natural resources and other forms of wealth in the Democratic Republic of Congo and the continuation of the conflict. -

Zimbabwe: The Transitional Government and Implications for U.S. Policy Lauren Ploch Analyst in African Affairs October 27, 2011 Congressional Research Service 7-5700 www.crs.gov RL34509 CRS Report for Congress Prepared for Members and Committees of Congress Zimbabwe: The Transitional Government and Implications for U.S. Policy Summary The U.S. government, which has expressed concerns regarding the rule of law in Zimbabwe for over a decade and which has long been critical of President Robert Mugabe, has been cautious in its engagement with the country’s three-year-old power-sharing government. That government, which includes members of the former opposition, has improved economic and humanitarian conditions during its ongoing transitional rule. However, significant concerns about the country’s political future remain. Zimbabwe’s March 2008 elections resulted in the party of long-serving President Mugabe losing its parliamentary majority for the first time since independence. Opposition leader Morgan Tsvangirai received more votes than Mugabe in the presidential race, but fell short of the needed margin for victory. Tsvangirai later withdrew his name from the ballot days before the required runoff, amid widespread political violence. Mugabe was thus declared the winner. In September 2008, after weeks of negotiations, Tsvangirai and Mugabe reached an agreement to form a unity government, with Mugabe remaining head of state. Tsvangirai became prime minister and cabinet and gubernatorial positions were divided among the parties. Disputes delayed implementation of the agreement until February 2009, when members of the opposition were sworn in alongside former rivals as ministers in a new government. The parties to the power-sharing agreement have faced significant challenges in working together to promote political reconciliation and in addressing serious economic and humanitarian needs. -

The Arms Trade Treaty: Zimbabwe, the Democratic Republic of the Congo, and the Prospects for Arms Embargoes on Human Rights Violators David B. Kopel,* Paul Gallant** and Joanne D. Eisen*** Abstract: Advocates of the proposed United Nations Arms Trade Treaty (ATT) promise that it will prevent the flow of arms to human rights violators. This Article first examines the ATT and observes that the ATT, if implemented as promised, would require dozens of additional arms embargoes, including embargoes on much of Africa. The Article then provides case studies of the current supply of arms to the dictatorship in Zimbabwe and to the warlords in the eastern Democratic Republic of the Congo (DRC). The Article argues that the ATT would do nothing to remediate the conditions that have allowed so many arms to be acquired by human rights violators. The ATT would have no more effective force than the embargoes that are already imposed by the U.N. Security Council; therefore U.N. member states, including China, which violate current Security Council embargoes, could just as well violate ATT embargoes. Accordingly, the ATT is a distraction, and human rights activists should instead examine alternative methods of addressing the problem of arms in the hands of human rights violators.
