Society Profile

The Legal Archives Society of Alberta (LASA) is dedicated to preserving, promoting and understanding the evolution of law and society in Alberta by establishing and preserving a complete and accurate historical record of the legal profession in Alberta. Incorporated under the Societies Act of Alberta in 1990, LASA is governed by an independent Board of Directors.

In fulfillment of its mission, LASA operates a legal heritage program and facility for the private sector legal community. LASA’s principle objectives are to:

• preserve the documentary heritage of lawyers, judges, and legal organizations in Alberta

• provide services for the legal community to identify, retain, and use their archival records

• provide source material for legal and public research in the history of law and society in Alberta

• enhance awareness of and celebrate the role of the law in Alberta’s history

The Legal Archives Society of Alberta received some very significant records in the past year including those of the Hon. Ronald Martland, the Hon. William A. McGillivray, Q.C. and the Hon Chief Justice Allan H.J. Wachowich.

We are pleased that the legal profession continues to choose LASA as its repository for preserving its history. LASA’s staff work diligently to provide archival and research services and promote Alberta’s legal history through LASA’s various programs.

Once again, the provided our core funding. Our annual campaign and the generosity of our donors provided the financial assistance that allowed us to meet our project goals. We would like to thank our donors for making 2008 another successful year for LASA.

Executive Director’s Report

After a year of working in tandem with the Law Society of Alberta celebrating its centenary, LASA has returned to focusing on its core mandate. Work continues on updating the 2nd edition to Lords and Ladies of the Western Bench and a publication detailing the history of the Court of Appeal. LASA continues to receive and process personal records from members of Alberta’s legal community. Work continues on developing displays to be installed in courthouses throughout the province. LASA continues to finalize the Court of Appeal Bust project.

Kim Horner replaced Sophie-Helen Cimon as the Administrative and Development Officer in December 2008.

We look forward to developing our programs further in the coming year. Our holdings continue to increase and our finances remain stable. Increased funding will become necessary as our records and demand for our services increase, but we continue to meet our objectives and plan for the future.

LASA Page 3 Administration and Finances

In 2007/2008, LASA operated on a budget of $230,000. The Law Society of Alberta provided the core grant of $120,000.

LASA is a registered charity and holds category “A” status under the Cultural Properties Export and Import Act.

Project Funding

For the fiscal year of 2007/2008 LASA received a total of $9,800 in project funding or commitments from outside sources to fund specific projects.

Archives Society of Alberta $4,950 was received from the ASA (Access to Holdings Program) to prepare records for the the late Hon. A.Milton Harradence, Q.C.

Community Initiative Program Funding received by LASA continues to be used to finish the Court of Appeal Bust Project and the Courthouse Display Project.

Summer Career Placement $4,850 was received from the Canadian Government to hire a temporary, full-time summer student to reorganize LASA’s Oral History holdings and process small donations of records.

2008 Annual Campaign

The purpose of the annual campaign is to raise funds to cover operating expenses for the current and next fiscal year. Staff and volunteer supporters normally set out to achieve the 2007/2008 goal of $50,000 (before expenses) through two major projects: a direct mail campaign, and the Historical Dinners and auctions. The total of the 2008 campaign was $39,605 before expenses.

Direct Mail Campaign LASA mailed out over 8,500 appeal letters and donor cards to the Alberta legal community in May 2007. Combined with other contributions throughout the year, the profession responded with $39,605 in direct donations.

Historical Dinners LASA held it’s annual Historical Dinners in 2008 in Edmonton and Calgary. In Calgary Don Smith spoke about Honore Jaxon, Louis Riel’s secretary during the 1885 Rebellion. In Edmonton Bruce Ziff discussed Reuben Well Leonard and the establishment of the Leonard Trust Foundation in 1923. After expense, LASA raised $2,328.91 from the dinners and silent auctions.

LASA Page 4 Alberta Legal Heritage Fund

In 1997 LASA established the Alberta Legal Heritage Fund at the Edmonton Community Foundation, the Calgary Foundation and the Medicine Hat Community Foundation. In 1998, funds were established in the Community Foundations of Red Deer, Lethbridge and Grande Prairie. Funds from casinos held in 1998, 1999, 2000, 2002, 2003 and 2004 were also added to the Alberta Legal Heritage Fund in each community. The income from the funds is used to ensure the future preservation of legal archives in Alberta. In the past year $12,363 was received in Endowment Income.

Casino

LASA held a charity casino at Casino Calgary on April 24 and 25, 2008. Casino profits are first deposited in a city-wide pool and then distributed. LASA’s portion of this profit was received during the 2007/08 fiscal year and amounted to $80,287. LASA’s next Casino is in July 2009.

Membership

Membership stood at 197 on October 31, 2008, a decrease from last year’s total of 209. Revenue from annual campaign donations for 2007/2008 was $39,605 a slight decrease from last year’s amount of $43,763. The average donation in 2006/2007 was $204; in 2007/2008, it was $201.

Annual General Meeting

On March 5, 2008, LASA held its Annual General Meeting at the Legislative Library in Edmonton. Members of the current Board of Directors, Graham Price, Q.C., Janice Agrios, Q.C., Don Bishop, Q.C., Garth Fryett, Q.C., Gordon Hoffman, Q.C., the Hon. Willis O’Leary and the Hon. Judge Robert A. Philp allowed their names to stand.

The authors of the Centennial Series of the Legislative Assembly of Alberta gave an interesting talk about several lawyers who have had careers in the Legislative Assembly as either MLAs, Speakers or as the Premier of Alberta.

LASA Page 5 LASA operates a province-wide archives program and facility based in the Law Society of Alberta offices in Calgary. The main components of the archives function are:

• acquiring and appraising records of the legal community

• arranging, describing, and constructing finding aids for records

• storing and conserving records

Facilities and Conservation

LASA’s administrative and research offices and storage vault is limited. In 2006 there was appoximately 100 metres of records stored at Iron Mountain. In 2007 LASA transferred 50 boxes (16 metres) of archival records to Iron Mountain for permanent storage.

LASA still requires a long-term solution to archival storage space. Investigation on installing mobile shelving onsite in LASA’s office is underway.

Acquisitions LASA acquired 34 accessions in 2008, amounting to nearly 9.29 linear metres of textual records, over 187 photographs, 143 videos, 31 cultural historic items (ink drawings, courtroom sketches and watercolour print), and 14 textiles (judicial apparel). Currently LASA’s holdings exceed 560 metres. Noteworthy acquisitions in 2008 include:

Martland family papers – The Hon. Ronald Martland and John Martland, QC. Accession numbers 2008-006, 2008-027, 2008-028 Extent: 1 metre of textual records; 150 photographs; 10 textiles; 1 art; 2 videos Date Range: 1928-2007

Three accruals of archival papers, photographs and other material from the late Su- preme Court of Canada Justice, the Honourable Ronald Martland, and his son John G. Martland, Q.C.

Ronald Martland attended the and was selected a Rhodes Scholar for Alberta and furthered his studies at . Prior to his appointment to the Su- preme Court of Canada, Martland was a partner in the Edmonton firm Milner Steer. He was the recipient of many awards (Alberta Order, Honourary degrees, Order of Canada etc.) represented in these papers. Justice Martland taught at the University of Alberta Law School for a number of years and was president of the Edmonton Bar Association. He was elected a Bencher with the Law Society and served in that capacity from 1948 to 1958. He retired from the on his birthday, February 10, 1982, and died in Ottawa on November 20, 1997. Martland’s son, John Martland, QC, is a retired lawyer from Calgary’s Bennett Jones law firm. Many significant photographs depicting members of Alberta’s legal community are included in these accessions. Other items include: memorabilia regarding the 2007 Jasper Reunion; correspondence from the Law Society of Alberta regarding assurance fund claims; and a 1969 statement of claim and bill of costs relating to the defamation case involving Calgary lawyer Robert P. Fraser and J. Rodney Sykes (Mayor of Calgary). Also included is a front-page article written by Chris Evans marking the occasion of John Martland’s appointment as Presi- dent in the “Law Society of Alberta / Canadian Bar Association Newsletter”; and many photographs depicting pastel art portraits of former Chief Justices of the Trial Division and Appellate Division of the Supreme Court of Alberta commissioned by artist Dorothy Oxborough in 1987. Letterhead from the Calgary Bar Association and the Jones, Black & Company law firm in Calgary are also included.

The Honourable William A. McGillivray, Q.C. Accession number 2008-003 12.5 cm of textual records

Donation includes ca. 200 personalized congratulatory letters and responses from William McGillivray following his appointment as Chief Justice of the Alberta Court of Appeal, 1974-1975. Also includes other memorabilia and several obituary notices and tributes received following McGillivray’s death in December 1984.

The Honourable Chief Justice Allan H.J. Wachowich Accession numbers 2008-007, 2008-014, 2008-016 2.88 metres of textual records; 4 textiles; 22 photographs, ca. 1972-1995

Nine boxes of textual records removed from the filing cabinets in the visiting judges office adjacent to Chief Justice Wachowich. Items include a Judge’s notebook belonging to Justice James C. Cavanagh, ca. 1990; administrative subject files re: district court and trial division history, judgments outstanding, (ca. 1980-1995); and binders relating to each Alberta judicial district. A second accession included four judicial robes collected

LASA Page 7 by Chief Justice Allan Wachowich, 1980-2008 and a third acquisition includes 22 photo- graphs of the old Edmonton courthouse, ca. 1972. Also included is letterhead from the late Master in Chambers, Mr. L.D. Hyndman, Q.C.

Arrangement and Description

The activity of arranging and describing archives involves: accessioning the records to gain physical control; completing a preliminary listing of the material to facilitate access to the holdings; storing material for long-term preservation; and producing finding aids compliant with the Rules of Archival Description to aid researchers. A group of records from one person or organization is described in archival terms as a Fonds. Detailed descriptions of all acquisitions received by LASA are available on the automated ACCESSION database. Approximately 75% of LASA’s holdings are archivally arranged and described at the fonds and series level on the FONDS database. Of the 111 fonds described, most are processed to the file and item level and include a finding aid available for researchers.

The processing of the papers of the Law Society of Alberta, Member file series was completed last September (approximately 9 metres including 52 volumes of textual records) by contract Archivist Linda Janzen. Grant funding for this project came from the Archives Society of Alberta, Access to Holdings program.

Two other grant submissions to the Canadian Council of Archives NADP program and the Archives Society of Alberta control of holdings program were made in December 2007. LASA received word that it was successful in obtaining $5,000 to process the papers of the Hon. Asa Milton Harradence, QC. Processing of these papers will begin in the fall of 2008. Reference Services

LASA maintains an automated reference system which provides access to information on lawyers, legal organizations, and judges in the province and supports research projects such as family histories, case law, and biographies. Staff perform limited searches and interpretation of material in response to reference inquiries.

LASA received 93 requests for information relating to or taken directly from its holdings. Some of these requests involved extensive in-house research of archival material over a period of weeks; others were simple requests for information provided in a matter of minutes over the telephone. The information has been used for locating practice files, to complete genealogical research, or to produce historical publications. The types of researchers were broken down as follows: Donor/Depositor - 16; Legal Community - 32; Academic Community - 11; Private Researchers - 23; Media - 1; Other Archives/ Libraries - 10.

Exhibits and Interpretation Exhibits are being prepared for installation in several courthouses around the province, including Calgary, Edmonton, Red Deer, Lethbridge, Medicine Hat, Grande Prairie, Peace River, Fort McMurray, St. Paul, Drumheller and Wetaskiwin. LASA is hoping to com- plete installalation of the exhibits and Court of Appeal Busts by Summer 2009.

Additionally, contributions were made to Archives Society of Alberta (ASA) virtual exhibit featured on www.archivesalberta.org. The 2008 virtual exhibit theme was ‘His- toric Hi-Tech’. A calendar was produced to supplement the theme with archival images supplied by repositories across Alberta. Publications

LASA continues work on updating the 2nd edition of Lords and Ladies of the Western Bench and a history of the Court of Appeal of Alberta. Both publications are slated for release in 2009.

Architypes

Two issues of LASA’s newsletter, Architypes, were distributed to members of the Law Society throughout the year. Volume 16, Issue II featured the first in a four-part series written by the Hon. Justice W.E. Wilson detailing the history of his father’s firm, Cairns Ross Wilson & Wallbridge. This issue also featured a few of the writings of C. Steward Blanchard, K.C. Volume 17, Issue I included the continuation of the four-part serious featuring E.B. Wilson. This issue also featured a summary of the recent acquisition of records from the Hon. Virgil P. Moshansky, Q.C., which includes the inquiry in to the Air Ontario F-28 crash at Dryden, Ontario. This issue also included a book review of the recently-released book The Alberta Supreme Court at 100: History and Authority, edited by Jonathon Swainger and contained a number of essays detailing the history of the Court in Alberta.

LASA has initiated a province-wide series of recorded interview projects preserving the memory of the legal community for posterity. Most of the previous year’s oral histories have now been transcribed and copies have been sent to the interviewees for a final edit.

Calgary Project

March 2009 will mark three years of interviews for the latest round of LASA’s oral history program. 41 interviews have been completed with nine completed in 2008. Subjects have included judges, litigators, small town lawyers and senior female practitioners. High- lights have been interviews with Justice R.A.F. Montgomery, Q.C., Justice Mary Hetherington, Justice J.D. Rooke, Judge Hunt-Mcdonald, Jack Dunphy, Q.C., Doug McGillivray, Q.C., Gwen Randall, Q.C., John Martland, Q.C. and Cheryl Gottselig, Q.C.

Ken Mills is the Chair of the Calgary Committee and David Mittelstadt conducted most of the interviews.

Edmonton Project Work continues in Edmonton led by Garth Fryett, Q.C. and Don Bishop, Q.C.

Legal History Library

LASA received several donated books in 2008 and would like to thank all of those people who generously contributed to LASA’s growing collections.
