It is a direct response to the GEF-funded National Capacity Self- Assessment (NCSA) project conducted in Palau during the period of 2006-2007, which identified environmental information as a constraint for good environmental decision-making and that there was a need for more comprehensive datasets to be made available to stakeholders including decision-makers and also a greater capacity of stakeholders for analyzing and using this information in related policy and programme making. Through a learning-by-doing process, this project will harmonize existing information systems, and integrate internationally accepted measurement standards and methodologies, as well as consistent reporting on the status of the environment in Palau.

    NIUE TREATY ON COOPERATION IN FISHERIES SURVEILLANCE AND LAW ENFORCEMENT IN THE SOUTH PACIFIC REGION THE PARTIES TO THIS TREATY: GIVEN that in accordance with international law as expressed in the United Nations Convention on the Law of the Sea, coastal States have sovereign rights for the purposes of exploring and exploiting, conserving and managing the fisheries resources of their exclusive economic zones and fisheries zones; TAKING INTO ACCOUNT Article 73 of the United Nations Convention on the Law of the Sea; NOTING that the Parties to the South Pacific Forum Fisheries Agency Convention, 1979 have agreed under Article 5 of that Convention that the Forum Fisheries Committee shall promote intra- regional coordination and cooperation in fisheries surveillance and law enforcement; CONSIDERING the vast areas of ocean covered by the exclusive economic zones and fisheries zones of coastal States in the South Pacific region and the vital economic significance of such zones to the economic development of South Pacific coastal States; WISHING THEREFORE to enhance their ability to enforce effectively their fisheries laws, and deter breaches of such laws; HAVE AGREED AS FOLLOWS: ARTICLE I - DEFINITIONS In this Treaty: (a) 'fishing' means: (i) searching for, catching, taking or harvesting fish; (ii) attempting to search for, catch, take or harvest fish; (iii) engaging in any other activity which can reasonably be expected to result in the locating, catching, taking or harvesting of fish; (iv) placing, searching for or recovering fish aggregating devices or associated electronic equipment such as radio beacons; (v) any operations at sea directly in support of, or in preparation for any activity described in this paragraph; (vi) use of any craft, air or sea borne, for any activity described in this paragraph except for emergencies involving the health and safety of the crew or the safety of a vessel; (vii) the processing, carrying or transhipping of fish that have been taken.

As the South Pacific Forum Fisheries Agency enters the 1990s there is increasing pressure on member countries to manage the marine environment and its resources in a sustainable manner. At the same time nearly all member countries are faced with problems arising from diminishing returns from traditional exports, such as copra, and consequently are increasingly being compelled to exploit their natural resources to pay for and maintain essential public services such as health and education. 2. FFA member countries are fortunate in that they control a disproportionately large area of ocean space compared to their total land area, and with it, the living and non-living resources of the ocean. The South Pacific Forum recognized as early as 1977 that one of the ways in which Pacific Island States would be able to realize their economic aspirations would be to cooperate through a regional organization in order to obtain tangible benefits from the resources of the sea.

    GEF SAP II PROJECT: NATIONAL PROJECT PREPARATION REPORTS TOKELAU Foreword This brief report, prepared by Les Clark and Colin Brown, aims to assemble information relating to Tokelau necessary for the preparation of the GEF SAP II Project. The main aims of the report are: • To make an assessment of the implications of the WCPF Convention for Tokelau • To identify possible interventions to support implementation by Tokelau of the WCPF Convention • To make an analysis of the incremental costs to Tokelau of activities related to the Convention • To undertake an analysis of stakeholders in Tokelau with interests in the regional oceanic fisheries resources • To identify relevant consultative mechanisms in Tokelau for the GEF SAP II Project To collect information relating to available indicators of performance in areas related to the WCPF Convention and to the financial sustainability of Tokelau’s participation in the Commission and implementation of the WCPF 1.     'Strength through Cooperation': a 21st Century Treaty for Multilateral Maritime Enforcement in the Pacific Camille Goodman* I. Introduction On 2 November 2012, the seventeen members of the Pacific Islands Forum Fisheries Agency (FF A) 1 adopted a new treaty providing for cooperation in fisheries surveillance and law enforcement activities. The Agreement on Strengthening Implementation of the Niue Treaty on Cooperation in Fisheries Surveillance and Law Enforcement in the South Pacific Region (the Agreement), 2 is clearly underpinned by a common purpose; the creation .of a strong but flexible mechanism that actively encourages cooperation between the Parties and maximises the reach and effectiveness of their jurisdiction and assets in the conduct of fisheries surveillance and enforcement. It also reflects a commitment to the use and continuous development of new tools, technologies and laws to combat illegal, unreported and unregulated fishing, and a recognition of the potential benefits of closer cooperation and information-sharing in relation to both fisheries and broader law enforcement activities. This Agreement is not 'just another fisheries treaty'. As overfishing in a number of the world's oceans makes the rich tuna resources of the Pacific region increasingly attractive to global fishing fleets, this Agreement is a timely mechanism to enhance its members' individual strength through collective cooperation. It is a product of the context and process of its negotiation and adoption; it reflects the high-level political commitment of Pacific Island Leaders to these issues, and the cooperative multilateralism that has been integral to the success of the FF A for more than thirty years. More than that, however, the Agreement introduces a number of modem and innovative concepts intended to provide its Parties with the widest possible range of opportunities for cooperation, consistent with international law and reflecting the practical realities of fisheries enforcement in the Pacific region.
