Arizona Administrative Register / Secretary of State Semiannual Index EXECUTIVE ORDERS & PROCLAMATIONS OF GENERAL APPLICABILITY, AND STATEMENTS ISSUED BY THE GOVERNOR PURSUANT TO A.R.S. § 41-1013(B)(2) AND (3) The Administrative Procedure Act requires all Executive Orders and Proclamations of General Applicability issued by the Governor to be published in the Arizona Administrative Register. In addition, the Register shall include each statement filed by the Governor in granting a commutation, pardon or reprieve, or stay or suspension of execution where a sentence of death is imposed. Spelling, grammar, and punctuation of these orders has been reproduced as submitted. Governor’s Executive Orders and Proclamations of general applicability are on file with the Office of the Secretary of State and are available for public viewing from the Public Services Division between 8:00 a.m. and 5:00 p.m., Monday through Friday (except state holidays) at 1700 W. NOW, THEREFORE, I, Janice K. Brewer, Governor of the State of Arizona, by virtue of the authority vested in me by the Arizona Constitution and the laws of the State, do hereby order pursuant to A.R.S. § 41-1542 and in accordance with Section 111(a) and (3)(1) of the Workforce Investment Act of 1998, the creation of the Workforce Arizona Council (the “Council”). 1. The Council shall be composed of the following members: • The Governor or Governor’s designee from the Office of the Governor; • The Chief Executive Officer of the Arizona Commerce Authority or the Chief Executive Officer's designee from the Arizona Commerce Authority; • The Director of the Arizona Department of Economic Security or the Director’s designee from the Arizona Department of Economic Security; • Two Chief Elected Officials, appointed by the Governor, including the State Superintendent of Public Instruction or the Superintendent’s designee from the Arizona Department of Education; • A representative, appointed by the Governor, of a rural community college district; • A representative, appointed by the Governor, of an urban community college district; • Two representatives, appointed by the Governor, that has experience regarding youth programs; • Two representatives, appointed by the Governor, from organized labor; • A representative, appointed by the Governor, from a faith-based or community-based workforce development organization; • Representatives, appointed by the Governor, from large businesses and who shall compose at least thirty percent of the total membership of the Council; • Representatives from small businesses, appointed by the Governor, and who shall compose at least twenty-five percent of the total membership of the Council; • Two members from the Arizona House of Representatives appointed by the Speaker who shall serve as non-vot- ing ex-officio members; and • Two -members from the Arizona State Senate appointed by the Senate President who shall serve as non-voting ex-officio members. 2. Voting members shall serve for three years and at the pleasure of the Governor. 3. Voting members may not, except where specified, send designees to represent them at the Council meetings. Voting members who miss more than three consecutive Council meetings are subject to replacement. 4. The Governor shall appoint a representative of a private sector employer from among the Council’s members to serve as the Council Chair. 5. The Chair may appoint sub-committees as needed to carry out Council business. 6. The Council shall meet at least four times a year. 7. The Council shall advise the Governor on workforce development strategy and policy for the State of Arizona. The Council shall: • Carry out the duties and functions prescribed for the state Workforce Investment Board under Public Law 105- 220 (Workforce Investment Act of 1998); • Review the provision of services and the use of funds and resources under applicable federal workforce develop- ment programs and advise the Governor on methods of coordinating such programs and provisions consistent with the governing laws and regulations.; • Establish goals for the development and implementation of performance measures relating to applicable federal, state and local workforce development programs; • Restructure the state’s governance model and processes for the workforce development system; • Adopt policies that will assist in the successful implementation of the new processes; • Establish goals for the development and coordination of education, employment and training systems; • Establish goals for the development and implementation of the Arizona’s Job Training Program; • Adopt policies that will require persons enrolling in a taxpayer-funded job training program to be drug-tested; • Encourage increased effectiveness of state agencies that help people find jobs as a condition of receiving public assistance; • Continue in accordance with 29 CFR 29.13 a 13 member standing Arizona Apprenticeship Advisory Committee (the “Committee”) consisting of: four representatives of employee organizations; four representatives from busi- ness and industry; one representative from a post secondary institution; one representative from a workforce June 30, 2013 Page 103 Volume 19, Issues 1-26 Arizona Administrative Register / Secretary of State Semiannual Index development organization; one representative from the Arizona Industrial Commission; one representative from the Arizona Department of Education; and one non-voting representative from the Bureau of Apprenticeship and Training. The Council shall designate a chair from the Committee’s voting membership. The procedure for deciding a tie shall be as outlined in the approved regulations. The Committee shall carry out all the duties and functions required of a state apprenticeship council. The Committee shall adopt an acceptable State Plan for Equal Employment Opportunity in Apprenticeship pursuant to 29 CFR part 30 and adhere to regulations as pre- scribed in 29 CFR part 29 and approved by the U.S. Department of Labor, Bureau of Apprenticeship and Train- ing, Employment and Training Administration; • Issue studies, reports or documents the Council considers advisable; and • Increase awareness of and participation in State workforce programs through external and internal marketing strategies. 8. The Council shall submit a written annual report as outlined in A.R.S. § 41-1542 to the Governor, the President of the Senate, the Speaker of the House of Representatives and the Joint Legislative Budget Committee by December 1 of each year. 9. All Council actions and recommendations are subject to the Governor’s approval. 10. The status of the Council shall be reviewed no later than December 31, 2016 to determine appropriate action for its continuance, modification or termination.
