Congratulations and thank you to all staff and students for your hardwork and support in realising this achievement. This is a testament to the immense potential of the University in providing quality higher education which is at par with other world-renowned universities. I am also pleased to share the news of our success in acquiring the IS09001:2015 Quality Management System Certification in July. This certification is a strategic effort to ensure that our management system is robust and efficient enough to support us in fulfilling our mission. On August 31, His Royal Highness Prince (Dr.) Haji Al-Muhtadee Billah ibni His Majesty Sultan Haji Hassanal Bolkiah Mu’izzaddin Waddaulah, the Crown Prince and Senior Minister at the Prime Minister’s Office, the Pro-Chancellor of UTB, officiated the Sixth Convocation Festival themed ‘VI5ION’. The festival celebrates the successful completion of studies for 451 graduands in the run up to the Convocation Ceremony which will be held on September 12. The theme was chosen to socialise UTB’s new five-year Strategic Plan 2019-2023 and highlight some of the achievements of the graduating cohort. We also congratulate staff who received their respective accolades at the UTB Staff Excellence Awards 2019. UTB will continue to recognise individual staff members who have shown exemplary professionalism, contribution and dedication in their respective domains, either in Teaching, Research or Administration. In July, the University also welcome 514 new students pursuing their studies at the University starting in the 2019/2020 Academic Year, including 36% who were postgraduates. I hope that students will have a rewarding academic experience in UTB whilst at the same time, taking an active part in co-curricular pursuits for personal development. The period investigated is between the 14th and 19th Century1. Apart from Brunei, the other countries that is considered to have been a part of the Malay Realm includes Malaysia, Indonesia, Patani in Thailand, and the Philippines. It was in these nations where the Malay Realm sultanates once existed, each with its own military, not only Brunei, but also Malacca, Aceh, Demak and Patani. The military2, in general, is defined as a group of people who are authorised to defend a country from any enemy attacks, whether it is from within the country or from external forces. They are also often ordered by a government or leader to attack other countries or certain factions, who they see as the enemy.     Perjanjian 1888: Suatu Harapan dan Kekecewaan. Oleh Ismail Bin Haji Awang Nordin Jabatan Sejarah, FASS Universiti Brunei Darussalam Abad ke -19 adalah kurun yang sangat mencabar bagi Negara Brunei Darussalam. Abad tersebut merupakan abad di mana negara-negara di Asia tenggara menghadapi arus hubungan, ancaman dan penjajahan daripada kuasa- kuasa barat. Negara Brunei Darussalam tidak terkecuali daripada arus tersebut. Situasi Brunei dalam abad ke-19 turut mengundang penglibatan orang-orang Inggeris. Pada mulanya secara individu, syarikat dan kemudian melibatkan kerajaan Inggeris. Kegiatan individu Inggeris, James Brooke di Sarawak dan Syarikat Borneo Utara Inggeris (Sabah sekarang) sangat mengancam kedaulatan dan wilayah-wilayah Brunei yang mana akhirnya mengecilkan Brunei seperti yang ada sekarang. Hubungan resmi kerajaan Brunei dengan kerajaan Inggeris (Great Britain) bermula dalam tahun 1847 iaitu dengan termeterainya Perjanjian Persahabatan dan Perdagangan. Perjanjian ini tidak dapat menjamin hubungan mesra dan kedaulatan Brunei. Kerakusan James Brooke dan anak saudaranya Charles Brooke di Sarawak dan Syarikat Borneo Utara Inggeris tanpa menghiraukan rasa hormat kepada Sultan Brunei dan kedaulatan Brunei telah menyempitkan wilayah Brunei. Perluasan wilayah mereka itu pula direstui oleh kerajaan Inggeris. Untuk mengelakkan wilayah-wilayah Brunei daripada terus menerus diambil oleh kedua kuasa tersebut maka Brunei telah menandatangani Perjanjian Perlindungan pada tahun 1888 dengan Great Britain. Perjanjian ini diharap akan dapat menjamin kedaulatan dan kelangsungan Brunei tanpa menggangu- gugat kesultanan Brunei yang masih tinggal, akan tetapi ianya adalah sebaliknya. Menjamin kesultanan Brunei adalah harapan khususnya Sultan Hashim Jalilul Alam Aqamaddin. Akan tetapi, disamping harapan itu, Sultan Brunei merasa sangat kecewa akan tindakan, khususnya Rajah Charles Brooke dan malah kerajaan Inggeris yang tidak menghormati perjanjian tersebut khususnya apabila Limbang dirampas oleh Rajah Charles Brooke.

Background: Negara Brunei Darussalam, i.e., “State of Brunei - Abode of Peace”, or “Brunei Darussalam”, or simply “Brunei”, is one of the oldest continuing monarchies in the world and one of the few executive ones. Its earliest known history dates back to 6th century, when Brunei was called “Puni” (possibly a distortion of the Sanskrit “Baruni”), or “Poli”. Brunei, then a Hindu-Buddhist kingdom, had linkages with the famed Sri Vijaya and Majapahit empires of the region, as well as with China. In the late 14th century, Brunei converted into an Islamic Sultanate when its ruler, Awang Alak Betatar, married a Muslim Johore princess from Malacca, and embraced Islam to become Brunei’s first Sultan – Mohammed Shah. Malay customs, rituals and culture have much of Indian-Hindu origin. 2. The contacts between India and Brunei have historical and cultural roots as extension of India’s relations with peninsular Malaysia and the Indonesian Island. Namun kita perlu melihat secara positif bahawa sejarah itu suatu proses yang bersambung. Apa yang berlaku hari ini merupakan sebahagian daripada peristiwa semalam dan menunjang menjadi sebahagian daripada peristiwa yang akan berlaku pada masa akan datang. Oleh yang demikian, pemahaman dan mengetahui tentang sejarah itu perlu. Sejarah itu penting sebagai pemangkin dalam meningkatkan ilmu pengetahuan. Sejarah itu juga memainkan peranan dalam pembinaan intelektual. Sejarah juga tidak boleh tidak berperanan dalam pembangunan bangsa dan negara. Sejarah itu juga dikatakan untuk mematangkan minda dan membentuk perpaduan sosial. Disamping sejarah itu dijadikan sumber kesedaran kepada masyarakat. Maka kertas kerja ini akan memperlihatkan dan memperjelaskan sejarah yang tercatat disebalik nama- nama jalan itu dan tujuan kepentingannya kepada bangsa dan negara.     Hukum Kanun Brunei: Isu dan Peranannya Memperkasakan Perundangan Islam Prof. Madya Dr. Haji Awg Asbol bin Haji Mail PENGENALAN • Dalam perkembangan tamadun manusia apabila mereka sudah berjaya menubuhkan sesebuah kerajaan, maka antara aspek awal dilakukan sebelum pelantikan pembesar bagi membantu raja mentadbir kerajaan ialah pengubalan undang- undang negara. • Ia perlu diwujudkan dengan matlamat supaya keadilan dapat ditegakkan dan tiada kezaliman berlaku dengan itu suasana aman dan harmoni dapat dicapai dalam negara. • Di zaman tradisional Kesultanan Melayu termasuk Brunei, undang-undang ini lebih dikenali sebagai kanun. Undang- undang atau kanun memang penting kepada sesebuah negara untuk menegakkan keadilan. Ia juga sebagai lambang kedaulatan setiap pemerintah. • Sesebuah negara pada kebiasaannya mempunyai dua kategori undang-undang, iaitu undang-undang negara dan undang-undang adat atau adat resam. Kedua-dua undang- undang ini akan sentiasa berubah dan bersifat dinamik. • Dalam hal yang demikian juga berlaku terhadap Negara Brunei Darussalam apabila Islam telah bertapak dan berkembang di negara ini dengan peristiwa Awang Alak Betatar menganut agama Islam pada tahun 1368 Masihi dengan mengambil gelaran Sultan Muhammad Syah. • Dengan kemunculan agama ini, maka ia tidak hanya berpengaruh dalam menukar pegangan agama dari Hindu Buddha kepada Islam tetapi dengan sendirinya perlu diwujudkan undang-undang Islam di samping undang-undang adat yang dipakai selama ini. • Dari sinilah wujudnya undang-undang syariah sebagaimana tercatat di dalam Hukum Kanun Brunei yang akan dibicarakan oleh kertas kerja ini dengan menumpukan kajian tentang isu dan peranannya dalam memperkasakan perundangan Islam. • Undang-undang baik undang-undang Islam mahupun undang-undang adat bukanlah sesuatu yang baharu dalam kerajaan dan masyarakat Brunei bahkan ia dipercayai sudah bertapak lama sekurang-kurangnya ia sudah wujud di sekitar abad ke-15 dan berterusan hingga abad ke-19.

In the history mentioned Islam has come to Brunei since the 7th century, which at that time Brunei has become a center of trade. The king of Brunei Malay kingdom since Sultan Muhammad Shah (1383), is a Muslim sultan who leads the kingdom as well as religious leaders, and is responsible for upholding the implemen- tation of religious teachings in the region. This paper will discuss the development of Islam and the dynamics of Malay politics, reli- gion and traditions in Brunei Darussalam to the present, including how Brunei Islam can pass through the British colonial era with unique conditions, even as they respect Britain as the savior of their country. Brunei reached its heyday from the fifteenth to the seventeenth century at the time of the Bolkiah Sultan, who ruled the entire island of Borneo and the Philippine archipelago, before the arrival of European colonial nations. Together with Malaysia, Brunei was colonized by Britain, and since 1888 the Kingdom of Brunei is a British Commonwealth. After Malaysia Merdeka (1957), Brunei declared its independence on January 1, 1984 from Malaysia. Although not a vast country. Brunei is an Islamic state that plays an important role in maintaining Islamic values in society. This is the success of the mosque coaching program and the advancement of religious education as a top priority.

    SULTAN-SULTAN BRUNEI SULTAN MUHAMMAD SHAH (TM 1363 - 1402) Sultan Islam Brunei yang pertama (sebelumnya terkenal dengan nama Awang Alak Betatar). Setelah berkahwin pada TM 1368 dengan Puteri Dayang Pingai iaitu Puteri Johor atau Temasek (Singapura Tua) Baginda dikenali dengan nama Sultan Muhammad Shah. Pada TM 1371, menghantar utusan ke China. Dalam catatan China Baginda disebut Ma–ha–mo– sha. Puteri Baginda, Puteri Ratna Dewi berkahwin dengan adinda kerabat Maharaja China iaitu, Ong Sum Ping (Pengiran Maharaja Lela). Baginda lindung pada TM 1402. SULTAN ABDUL MAJID (TM 1402 - 1408) TM 1402, naik takhta. Tidak pernah disebut dalam Salasilah Raja-Raja Brunei tetapi ada dicatatkan dalam riwayat China. TM 1406, menghantar utusan ke China, orang Cina menyebut baginda Ma-na-je-ka-na. TM 1408, berangkat ke China dan lindung di sana ketika berusia 28 tahun, meninggalkan putera bernama Hsia-wang berusia 4 tahun. SULTAN AHMAD (TM 1408 - 1425) Baginda naik takhta pada TM 1408, sebelum itu terkenal dengan nama Pateh Berbai. Pengiran Bendahara yang pertama bagi Brunei. Baginda disebut dengan gelaran Pengiran Bendahara Seri Maharaja Permaisuara. Berkahwin dengan adinda Ong Sum Ping (Pengiran Maharaja Lela). Menjadi mertua kepada Sultan Sharif ‘Ali. Baginda lindung pada tahun TM 1425 dan digantikan oleh menantu Baginda, Sultan Sharif ‘Ali. Sultan Sharif Ali (Tm 1425 - 1432) Sultan Sharif ‘Ali ibnu Sharif ‘Ajlan naik takhta pada TM 1425 bagi menggantikan mertua Baginda, Sultan Ahmad yang tidak mempunyai waris (putera). Baginda dijunjung untuk menjadi Sultan atas persetujuan pembesar-pembesar negara dan rakyat Brunei. Baginda keturunan Arab, berasal dari Taif. ‘Pedang Si Bongkok’ yang dibawa Baginda bersama ke Brunei itu membuktikan Baginda pernah menjadi Amir Makkah iaitu Al–Amir Sharif ‘Ali bin Sharif ‘Ajlan bin Sharif Rumaithah bin Sharif Muhammad Abu Numaie Al-Awwal, mempunyai jurai keturunan daripada Nabi Muhammad Sallallahu ‘Alaihi wa Sallam melalui cucunda Baginda, Sayidina Hasan.
