Presentedtothe ThirdSessionoftheWIPOIntergovernmentalCommitteeonIntellectualPropertyand GeneticResources,TraditionalKnowledgeandFolklore (June13to21,2002)

I. INTRODUCTION

ThispositionpaperoftheAfricanGroup,presentedtothethirdsessionoftheWIPO IntergovernmentalCommitteeonIntellectualPropertyandGeneticResources,Traditional KnowledgeandFolklore(theIGC),flowsfromthe“DecisiononIntellectualProperty, GeneticandBiologicalResources,TraditionalKnowledgeandFolkloreinAfrica”takenby theCouncilofMinistersandadoptedbytheHeadsofAfricanStat esattheSeventy -fourth OrdinarySession/NinthOrdinarySessionoftheAfricanEconomicCommunityofthe OrganizationofAfricanUnity(theOAU)(July5to8,2001,Lusaka,Zambia),andisthe synthesisofviewsandproposalsdevelopedbyAfricanStatesatseveralmeetingsheldin AfricaandwithinthecontextoftheIGC.Inthiscontext,thepaperreferstothe“Proposal PresentedbytheAfricanGrouptotheFirstMeetingoftheIntergovernmentalCommitteeon IntellectualPropertyandGeneticResources, TraditionalKnowledgeandFolklore” (WIPO/GRTKF/IC/1/10)andthepaperentitled“IntergovernmentalCommitteeonIntellectual PropertyandGeneticResources,TraditionalKnowledgeandFolklore”presentedbythe delegationofZambia(WIPO/GRTKF/IC/1/12).

II. PREAMBLE

TheAfricanGroup:

(1) recallsthe“DecisiononIntellectualProperty,GeneticandBiologicalResources, TraditionalKnowledgeandFolkloreinAfrica”adoptedbytheCouncilofMinistersand endorsedbytheHeadsofAfricanStatesattheSe venty -fourthOrdinarySession/Ninth OrdinarySessionoftheAECoftheOrganizationofAfricanUnity(July5to8,2001,Lusaka, Zambia),accordingtowhich:

“(The)Council(ofMinisters):

(1) COMMENDStheSecretaryGeneralonhisinitiativeandeffort sindeveloping thedraftAfricanModelLawontheProtectionoftheRightsofLocal Communities,FarmersandBreedersandfortheRegulationofAccessto BiologicalResources,aswellasthedraftAfricanModelLawonBio -Safety andanAfrica -wide Bio -SafetySystem;

(2) SUPPORTStheconveningoftheproposedexpertsmeetingsintendedto furtherexaminethedraftmodellawswithintheframeworkoftheAfrican WIPO/GRTKF/IC/3/17 AnnexII,page 2

commonpositionsonintellectualproperty,generally,andtheTripsAgreement inparticular;and

URGESMEMBERSTATESTO:

(i) Participateeffectivelyinthetwoon-goingprocessesofdevelopingmodel lawsandtousethesemodelsasabasisforfinalizingtheirnationallegislationsby adaptingtheirprovisionstothenationalcontextandwithintheframeworkoftheWTO negotiations,whilstmaintaining,asmuchaspossible,theprincipleofuniformityof nationallawsofintegratingAfricaneconomies;

(ii) Examinewaysandmeansofraisingawarenessabouttheprotectionof geneticresources,indige nousknowledgeandfolklore,takingintoaccounttheneedto protecttherightsoflocalcommunities;

(iii) Identify,catalogue,recordanddocumentthegeneticandbiological resourcesandtraditionalknowledge,includingexpressionsoffolkloreheldby their communities,withintheframeworkofnationallaws,withaviewtoguaranteeingthem protectionagainstmisappropriation;

(iv) Exchangeinformationandexperiencesandcontinue,withintheframework oftheOAU,withthesearchforjointsolutionsofcommonconcern,and,withthe effortsaimedatdevelopingcommonposition,policiesandstrategiesinrelationtothese issues.”

(2) recallsthedecisionoftheOAUproclaiming2001-10astheDecadeforTraditional Medicine;

(3) takesnoteofthedraftAfricanModelLawontheProtectionoftheRightsofLocal Communities,FarmersandBreedersandfortheRegulationofAccesstoBiological ResourcesadoptedbytheOAU;

(4) emphasizesthattheprotectionofgeneticresources,traditionalknowledge and expressionsoffolkloreisofgreatimportancetoAfricanStates.TheAfricanregionisrichin geneticresources,traditionalknowledgeandexpressionsoffolklore,whichareanimportant partoftheculturalandnaturalheritageofAfrica’speoples;

(5) believesthattheneedfortheprotectionofgeneticresources,traditionalknowledge andexpressionsoffolkloreshouldbeviewedandunderstoodwithinthecontextoflarger socio -economic,culturalandpoliticalprocessesinAfricastrivingforsu stainable development,socio -economicupliftofparticularlyruralcommunities,people -centered development,scientificandculturalendeavors,andtherespectforthehumandignityand culturalidentityoftraditionalandtraditionalcommunities;

(6) believesthatWIPOhasasignificantroletodevelopinternationallyacceptableand equitablesolutionstothe intellectualpropertyissues relatedtogeneticresources,traditional knowledgeandexpressionsoffolklore;

(7) notesthatissuespertainingtogeneticresources,traditionalknowledgeand expressionsoffolkloreshouldbeaddressedequitablybytheIGCwithdueregardtotheir equalimportance; WIPO/GRTKF/IC/3/17 AnnexII,page 3

(8) notesthedesirabilityofco- ordinationandsynergybetweenactionstakenatthe national,regionalandinternationallevels;

(9) believesthatthereisaneedtodevelopsuigeneris rightsandsystemstoprovide protectionnotadequatelyavailableundercurrentrightsandsystems,despitetheprotection providedinsomecasestotraditionalknowledgeassociatedwithgeneticresourcesand expressionsoffolklorebycurrentintellectualpropertysystems;

(10) notesthatStatesandtraditionalcommunitieshavedifficultyinimplementingand makingeffectiveuseofexistingrightsandsystemsfortheprotectionoftraditionalknowledge andexpressionsoffolklore;

(11) affirmsthesovereigntyofStatesovertheirgeneticresources,andrecognisesthe principleoffairandequitablesharingofbenefitsarisingfromtheuseofsuchresources;

(1 2) notesthattheuseofgeneticresourcesisinseparablefromandanintegralpartof traditionalknowledge.

III. AFRICANPOSITIO NONSPECIFICAGENDA ITEMSOFTHEIGC

AccesstoGeneticResourcesandBenefit -Sharing

(1) Inviewofthealarmingrate oflossandmisappropriationofgeneticresources, Statesareurgedtoputinplacelegislative,administrativeandstrategicpolicymeasuresand mechanismsfortheconservationandsustainableuseofbiologicaldiversity,whileprotecting therightsoftheownersandusersofgeneticresources.Suchmeasuresandmechanisms shouldinclude:

(a) thepreparationofnationallawsontheprotectionoftherightsoflocal communitiesinrespectoftheirgeneticresources;

(b) thedevelopmentofnationalpoliciesandlawsontheprotection, conservation,preservationandsustainableuseofgeneticresources;

(c) thecreationofacompetentnationalauthorityresponsiblefortheregulation, monitoringandcoordinationofdevelopmentalactivities,includingaccesstoandthe fairandequitablesharingofbenefitsinrespectofgeneticresourcesandallother mattersrelatingtotraditionalknowledge;

(d) regionalcooperationamonggeneticresourcesupplierStates,andthe draftingofharmonizedregionallegi slationonthemanagementofgeneticresourcesthat aremulti -culturalinnatureandcutacrossnationalborderswithinregionaleconomic integrationareas,suchasthedraftAfricanModelLawontheProtectionoftheRights ofLocalCommunities,FarmersandBreedersandfortheRegulationofAccessto BiologicalResources;

(e) thepromotionandrecognitionofresearchanddevelopmentofgenetic resourcesandassociatedtraditionalknowledge,andtheresponsibledisseminationofthe resultsofsuchresear ch; WIPO/GRTKF/IC/3/17 AnnexII,page 4

(f) thedesign,implementation,monitoringandevaluationofprogramsof information,education,communicationandawareness,particularlyatthelocal communitylevel;

(g) consolidationofregionalcoordinationefforts;

(h) AfricanStates,parti cularlythoselessdeveloped,shouldbenefit,incaseof need,fromtheassistanceofintergovernmentalorganizationsforcapacitybuildingand intheareascitedabove.

(2) TheAfricanGroupconsidersasanimportantstagethedevelopmentbytheIGCof “guidecontractualpractices”,guidelinesandmodelintellectualpropertyclausesfor contractualagreementsonaccesstoanduseofgeneticresources,andthefairandequitable sharingofbenefits.Inthisregard:

(a) contractualarrangementsonacce sstogeneticresourcesshouldtakeinto accountthefollowingpointsandprinciples:

(i) anyaccesstogeneticresourcesforindustrial,commercialor researchpurposesshouldbethesubjectofapriorrequestinwriting addressedtothecompetentnatio nalauthorityoranyotherrelevantbody responsibleforgeneticresources,inaccordancewithnationallaws;

(ii) adoptionoftheprincipleofpriorinformedconsentintheprocess ofaccessandthefairandequitablesharingofbenefits;

(iii) thesu bjectmatterofeachcontract,therightsandobligationsofall parties,thenatureofthebenefitsandthemethodoftheirdistribution,and theidentityofthebeneficiariesmustbeclearlyspecified;

(iv) theprotectionofthesupplier’sinterests,subjecttoassuranceofthe preservationandpermanencyofthegeneticresourceforpresentandfuture generations.

(b) theAfricanGroupsupportsenhancing,nationally,regionallyand internationally,thenegotiatingcapacityoftraditionalcommunitiesandgovernmental andresearchinstitutions,by,forexample,creatingawareness,information-sharing,and providingtargetedlegaleducation.

(c) theAfricanGroupsupportsputtingintoplacenationalandinternational regulatorymechanismsandframeworksformonitoringthecompliancebythepartiesof thetermsandconditionsofcontractsrelatingtoaccesstogeneticresourcesandthefair andequitablesharingofbenefits.

(3) Inrespectoftheprotectionofbiotechnologyandbiologicalresources,thereshould be:

(a) inaccordancewiththeprecautionaryprinciple,endeavoursforrespectfor therightsofbiotechnologyinventorsandinnovators,withdueregardtotherightsofthe ownersofgeneticresources; WIPO/GRTKF/IC/3/17 AnnexII,page 5

(b) theprotectionofallinventions andinnovationswithdueregardtotherules of bio -ethics;

(c) theestablishmentofnationalbiosafetyregulatoryframeworks;

(d) assistancetoresearchersandinnovatorsintheprotectionoftheirinventions.

TraditionalKnowledge

(1) TheAfrican Groupbelievesthatinconsideringsui generis formsofprotectionfor traditionalknowledge,attentionshouldbepaidtodeterminingandidentifyingthesubject matterofprotection;thetypeofprotectiondesired;thecontentoftherightstobegranted; thedurationofrightsgranted;and,theidentityoftheownersoftherights.Inthisrespect:

(a) indevelopingeffectivenational,regionalandinternationalsystemsof protection,itisnecessarytodevelopflexible suigeneris systemsthattake customary laws,protocolsandpracticesintoaccount,toprovideprotectionnotadequately providedbyexistingrightsandsystems;

(b) strategiesforidentifyingthesubjectmattertobeprotectedcouldinteralia includecompilinginventoriesoftrad itionalknowledgeandthenaturalheritage,with theassistanceofethicscommittees;thebetterorganizationofthesectorcomprising traditionalknowledge;cooperationbetweentraditionalmedicineandmodernmedicine suppliers;and,theteachingoftr aditionalknowledgeatprimary,secondaryandtertiary levels.Nationalauthoritiesshouldbecontinuouslyandfullyinvolvedinallphasesof thedevelopmentandimplementationoftheseactivities;

(c) theownersoftraditionalknowledgeareattheoutsettheindividuals, familiesand/orlocalcommunitiesfromwhichtheknowledgehascome.Ifthesecannot beidentified,thentheStateshouldstandinforthem.

(2) InrespectoftheIGC,theAfricanGroup:

(a) favorsthedevelopmentofalegallybindinginternationalinstrumentthat recognizes,protectsandrewardstraditionalknowledgeandinnovations;

(b) supportsthedevelopmentbytheIGCofaworkingdefinitionof “traditionalknowledge”thatisillustrativeandinclusive,andwhichestablis hesits characteristicfeaturesandthecriteriaaccordingtowhichitshouldbeprotected;

(c) supportsthecompilationofaninventoryofdocumentsrelatedtotraditional knowledgeforinclusionintheminimumdocumentationlistofthePatentCooperati on Treaty(thePCT),andtheclassificationofrelevanttraditionalknowledge documentationforpatentsearchpurposes;

(d) noteswithinterestthisstepofthedevelopmentandpublicationof appropriatedatabasesoftraditionalknowledgethatisalready inthepublicdomain, takingintoaccount,however,thecharacteristicsandneedsofAfricanTraditional KnowledgeSystems,whicharelargelyorally -held,aswellastheuseofdatabasesto WIPO/GRTKF/IC/3/17 AnnexII,page 6

providepositiveprotectionfortraditionalknowledge,particular ly“secretknowledge.” Further,theGroupencouragesAfricanStatestoestablishtraditionalknowledge databasesandmakethemavailable,incaseswhere“defensiveprotection”ofdisclosed traditionalknowledgeisdesired.TheGroupalsocallsuponWIPOtoprovide intellectualpropertyassistancetoAfricandocumentationinitiativesinthisregard, particularlyinrespectoftheintellectualpropertyimplicationsofsuchdocumentation.

(3) Moregenerally,Statesshould:

(a) speeduptheformulationof nationalpoliciesandlegislationinregardtothe recognition,preservation,developmentandpopularizationoftheinherentelementsof traditionalknowledgewhichimpactonthelifeofthepeopleandtheenvironment;

(b) createnationalcompetentauth oritiesforthemanagementandpromotionof traditionalknowledge;

(c) intensifyeffortstocreatepublicawarenessamongallstakeholdersonall issuesrelatingtothedevelopment,promotionandprotectionoftraditionalknowledge;

(d) translateregulatorytextslinkedtotraditionalknowledgeintothelocallanguages withaviewtotheinvolvementofallthecommunities.

(4) TheAfricanGroupalsobelievesthattraditionalcommunitieshaveakey responsibilityforidentifying,preserving,andpromotingtheirknowledgesystems,and nationalgovernmentsshouldsupportandassistthemintheseendeavours.

ExpressionsofFolklore

(1) TheAfricanGroupbelievesthatexistingintellectualpropertyrights,suchas copyright,trademarks(includingcertif icationandcollectivemarks),andindustrialdesigns, mayprovideadequateprotectionforexpressionsoffolkloreinrespectoftradition-based creationswherethecreator(orcreators)oftheexpressionis(orare)identifiable.Insuch cases,thecreato rshouldbetheownerandbeneficiaryoftherights.Ontheotherhand,where thereisnoidentifiablecreator,recourseshouldbehadtoa suigeneris intellectualproperty system,whichshouldprovidefortheStatetoholdtherights.Insuchcases,th eStateshould payanyfinancialproceedseithertotherelevantcommunityortoafundforthepromotionof culturalheritage.

(2) InrespectoftheIGC:

(a) theIGCshouldexaminethemeansbywhichintellectualproperty registrationsystems,particu larlythetrademarkandindustrialdesignssystems,couldbe adaptedtoenhancetheprotectionprovidedtoexpressionsoffolklore,withoutprejudice totheexaminationofthesequestionswithinotherorgansofWIPO.

(b) theAfricanGroupsupportsthe studyoftherelationshipbetweencustomary laws,protocolsandpracticesgoverningcustodianship,useandtransmissionof expressionsoffolklore,ontheonehand,andtheformalintellectualpropertysystem,on theother,inrelationinteralia tothees tablishmentofsuigeneris systemsofprotection andsoastoensurethatintellectualpropertyrightsdonotprecludecontinuedcustomary creationanduseofexpressionsoffolklore; WIPO/GRTKF/IC/3/17 AnnexII,page 7

(c) theWIPO/UNESCOModelProvisions,1982provideausefulreference pointforthedevelopmentofeffectivenational,regionalandinternationalsystemsof protection,althoughtheycouldbeupdatedandimprovedupon;

(d) theAfricanGroupfavorstheestablishmentofacomprehensiveinternational bindinginstrumentontheprotectionofexpressionsoffolklore,withsomeformofdispute settlementmechanismeithersimilartothatwhichisobtainableundertheTRIPSAgreement oramediationprocessasisprovidedbytheWIPOArbitrationandMediationCentre.

Specificrec ommendationstoWIPO

(1) WIPOshouldprovidegreaterlegal -technicalassistancefortheputtingin placeandeffectiveimplementationofsystemsfortheprotectionofexpressionsof folkloreatnationalandregionallevels.Suchassistanceshouldincludeawareness - raising,institution-building,andtrainingandinformationfortraditionalcommunitieson enforcement.

(2) WIPOshouldconductempiricalstudiesontheeconomiceffectsofthe exploitationoftangibleandintangibleexpressionsoffolklore,particularlyhandicrafts, indevelopingandtheleastdevelopedcountries,andparticularlyinthelightofnew technologiesforthereproductionanddisseminationofsuchfolkloricworks.

SpecificrecommendationstoAfricanStates

(1) Asamatterofurgency,expressionsoffolkloreshouldreceivemoreeffectiveand appropriateprotectionatnationallevels,inorderthatAfricanpeoplesderivethemaximum social -economicbenefitsfromsuchprotection.Inthisregard:

(a) appropriatenationallegisla tion,institutionsandstructuresshouldbeputin place,toensureprotectionofexpressionsoffolkloreasastrategyforcultural development;

(b) nationalmeasuresandsystemsfortheprotectionofexpressionsoffolklore shouldtakeintoaccounttheWIPO -UNESCOModelProvisions,1982asauseful possiblestartingpoint;

(c) AfricanStatesshouldalsoexploreandencourageusebytheirtraditional communitiesofexistingintellectualpropertyrightsfortheprotectionoftraditional cultureandexpressionsoffolklore;

(d) Africangovernmentsshoulddevotemoreattentionandresourcestofolklore issuesandtointellectualpropertygenerally,andinvolverelevantcommunitiesandcivil societiesinraisingawarenessofthevalueofexpressionsoffo lkloreandtheimportance ofprotectingthem;

(e) AfricanStatesshoulddevoteattentiontotheurgencyofcreatinganAfrican Regionalframeworkforthepreservation,protection,andmaintenanceoftheintegrityof expressionsoffolklore,includingtheestablishmentofnationalandregional documentationcenters. WIPO/GRTKF/IC/3/17 AnnexII,page 8

GeneralStatements

TheAfricanGroup:

(a) encouragesthecontinuedco -ordinationoftheworkofWIPOwiththe ongoingprocessesunderwayintheSecretariatoftheConventiononBiological Diversity(theCBD),theFoodandAgriculturalOrganisation(theFAO)andtheUnited NationsEducational,ScientificandCulturalOrganisation(UNESCO)toenhance synergies;

(b) remainsconvincedofthenecessityfortheestablishmentofaWIPO StandingCommitteeonIntellectualPropertyandGeneticResources,Traditional KnowledgeandFolklore,inorderthattheseimportantissuesbetakenintoaccount withinaframeworkdesignedtoachievespecificresults,inlinewithhowother substantiveissuesare dealtwithbyWIPO;

(c) considersthatthemandateoftheIGCbecontinuedbeyondtheWIPO ProgramandBudgetfor2002-03andthatconsiderationbegiventoconstitutingitasa StandingCommitteeatthattime,ifnotbefore;

(d) callsuponWIPOtocontinuetosupportandmakepossiblethefulland well -informedparticipationofdevelopingandleastdevelopedcountriesinthevarious meetingsandconsultationprocessinthisregard;

(e) requeststheWIPOProgramandBudgetCommitteetoapproveandexpedite thefundingoftheparticipationoftraditionalcommunitiesattheIGCsessions;

(f) stronglyencouragesofficialsfromAfricanStates,throughthecoordination oftheOAU,andinconsultationwiththeircorrespondencesfromotherdeveloping co untries,whoparticipateinIGCsessionsandothermeetingsrelatingtointellectual propertyandgeneticresources,traditionalknowledgeandfolklore,toreportbacktoand consultwithallrelevantgovernmentalandnon-governmentalstakeholderssoasto enrichtheparticipationofdevelopingcountriesinsuchmeetings;

(g) encouragesWIPOtoenhancecooperationwithsub-regionalandregional organizationsinvolvedinintellectualpropertyrights;

(h) expressesitsdeepgratitudetoWIPOfortheassistanceprovidedtoAfrican StatesandrequeststhatitcontinuestoprovideopportunitiestoAfricanandother developingcountriestoengagewithandcontributemeaningfullytotheIGCprocess. WIPO/GRTKF/IC/3/17 AnnexII,page 9

IV. CONCLUSION

TheAfricanGroupintendstocontinuously refineandbuildupontheseproposalsasthe workoftheIGCandnational,regionalandotherinternationalprocessesdevelop.The AfricanGrouplooksforwardtoworkingwiththeotherregionalgroupsintheIGCtoensure thepositiveprotectionofgeneti cresources,traditionalknowledgeandfolklore.
