AN ACT to prohibit Members of Tynwald from contracting with or supplying Goods to the Insular Government or Boards of Tynwald.

GENERAL NOTE: The maximum fines in this Act are as increased by the Fines Act 1986 and by the Criminal Justice (Penalties, Etc.) Act 1993 s 1.

1 Short title This Act may be cited as ‘The Members of Tynwald (Disqualification) Act, 1930’.

2 Disqualification of members of Tynwald for board A member of Tynwald shall be disqualified for being nominated for or appointed or being a member of a board if such member, or any partnership in which he is interested, enters into or has entered into any contract in force with the Insular Government, or any person on behalf of the Insular Government, or with such board for the supply of any goods, or the execution of any work, or any other contract in which such member or his firm has any financial interest.1

3 Penalty and consequences on member of board being interested in contract with board No member of a board shall in any way share or be concerned in any business, dealings, or in the profits of any bargain or contract with or any work done under the authority of such board or of any officer of such board: Provided that this section shall not apply to — (a) any sale or demise of land to the board; or (b) any bargain or contract made with, or work done by, a company in which such member holds shares or debentures or other securities; or c AT 3 of 1930 Page 5

(c) the insertion of any advertisements relating to the affairs of the board in any newspaper in which such member has a share or interest; and no member of a board shall vote with respect to such sale, demise, bargain, contract, work or insertion. Any member of a board who acts in contravention of this section shall be liable on summary conviction at the suit of the Attorney-General, before the High Bailiff, to a penalty not exceeding £2,500. The judge by whom such member is convicted under this section shall forthwith report such conviction to the and the member so convicted shall vacate his seat in the Legislative Council or the as the case may be, and such vacancy shall be filled in the manner provided for filling vacancies in the Branch of the Legislature in which such member held his seat: Provided always that any member convicted under this section may appeal against such conviction to the Staff of Government Division of the High Court, and until such appeal has been heard and disposed of such member shall not sit in or vote at any sitting of Tynwald or of the Branch of Tynwald of which such member is a member, and the seat of such member shall not be vacated unless the conviction is confirmed by the decision of the said Staff of Government Division.2

3A Interpretation In this Act ‘board’ means — (a) a Department (within the meaning of the Government Departments Act 1987) or (b) a Statutory Board (within the meaning of the Statutory Boards Act 1987).3

4 Commencement of Act This Act shall come into operation when the Royal Assent thereto has been by the Governor announced to Tynwald and a certificate thereof has been signed by the Governor and the Speaker of the House of Keys.
