Introduction

The purpose of this report is to outline the estimated fiscal impact of annexation upon the City of Fishers and the ability of the City to provide necessary municipal capital and non capital services to an area proposed for annexation.

The area proposed for annexation that is analyzed in this report is referred to as the North Shore Woods/Taylor Woods (Kroger) and is generally located at: North side of 116th Street, west of Olio Road

The Indiana Statutes (IC-36-4-3-13-d) governing annexation activity by the City of Fishers requires the preparation of a written fiscal plan and the establishment of an annexation policy by resolution, as of the date of the annexation ordinance. The fiscal plan is required to present cost estimates and a plan for the extension of municipal services to the areas proposed for annexation. Municipal services of a non-capital nature are required to be provided within one (1) year of the effective date of the annexation ordinance to the extent that such services are equivalent in standard and scope to those services already provided within the . Likewise, municipal services of a capital improvement nature are required to be provided within three (3) years of the effective date of the annexation ordinance.

This report contains a review of the development revenues and expenditures that may result from the annexation of certain territory by the City. While the City is committed to providing the highest quality service to all areas of the community, the dollar figures when represented are only estimates and are subject to change. Variations may occur depending upon the rate and extent of future development, an increase or decrease in the cost of providing municipal services, or fluctuations in the future property assessments. The City of Fishers Code of Ordinances Title 15-151.010 defines the corporate boundaries of the municipality, establishes a map entitled the City of Fishers Zoning Map and the property subject of this Fiscal Plan is hereby incorporated herein by reference. Requirement of Indiana Law Annexation Criteria

The City Council of the City of Fishers is granted the authority under Indiana law to annex land that conforms to the terms of Title 36 Article 4, Chapter 3 of the Indiana Code. The minimum criteria used to determine the eligibility of land for annexation must establish that: 1. The territory sought for annexation is contiguous to the corporate boundary of the municipality; or 2. The territory sought for annexation is not contiguous to the corporate boundary of the municipality, but is occupied by a municipally owned or operated airport or landing field; or 3. The territory sought for annexation is not contiguous to the corporate boundary of the municipality, but is occupied by a municipally owned or regulated sanitary landfill, golf course, or hospital.

Additionally the following criteria are also used to further determine the eligibility of land for annexation and must establish that: 1. The boundary of the area proposed for annexation must be at least 1/8 contiguous to the present corporate limits of the municipality, and: 2. The boundary of the area proposed for annexation must be at least 1/8 contiguous to the corporate limits of the municipality, and the area must be needed and can be used by the municipality for its development in the reasonably near future. The preparation of a written fiscal plan is also required to outline the provisions for: a. The cost estimates of planned services to be furnished to the area proposed for annexation; b. The method or methods of financing the planned services; c. The plan for the organization and extension of planned services; d. The provision of planned services or a non-capital nature within one (1) year of the effective date of annexation; and e. The provision of planned services of a capital improvement nature within three (3) years of the effective date of annexation.

The fiscal plan must also discuss the provisions to be made to ensure the delivery of capital and non-capital services in a manner equivalent in standard and scope to those services currently being provided to other areas within the corporate boundary regardless of topography, patterns of land use, and population density. Contiguity The area considered for annexation is contiguous to the corporate boundary of the City of Fishers. The perimeter of the proposed annexation parcel measures approximately 2736.28 ft. The area (property boundary) that is contiguous to the City is 924.37 ft. or 1/3 of the aggregate boundary, which exceeds the statutory requirement of 1/8 contiguity.

Size The area proposed for annexation encompasses an area of approximately 6.8 acres.

Road Miles The proposed annexation will add 0 feet or 0.00 miles to the road inventory for the City of Fishers.

Zoning

The area proposed for annexation is currently located within the planning and zoning jurisdiction of the City of Fishers through a joinder agreement with Fall Creek Township , served by the City of Fishers Advisory Plan Commission. The current zoning of this property is PUD-C and will not be changed with this annexation petition.

Property Assessment (Gross Assessed Value)

The 2013 pay 2014 total net assessed valuation of all real property and its improvements located within the area proposed for annexation is $208,000 (estimated).

Municipal Property Tax Rate The existing 2013 pay 2014 property tax rate assessed to all real property and its improvements within the area proposed for annexation in Fall Creek Township is $ 1.7493 per $100 Assessed Value.

The existing 2013 pay 2014 property tax rate assessed to all real property and its improvements within the City of Fishers is 2.1645$ per $100 Assessed Value.

The City of Fishers municipal rate for the 2013 pay 2014 year is $ 0.6302 per $100 Assessed Value.

B. Providing Non-Capital Municipal Services The City of Fishers currently extends to its citizens a diverse range of public services. These services are provided by different municipal departments. Each department has a unique and separate function within the municipal service system of the City.

The City of Fishers recognizes the following municipal departments and agencies as providing municipal services to residents of the City:

Some services are already available to the Annexed Area, while other services may have to be initiated. The requirements and costs of these new services were determined by utilizing the budget information located in the Comptroller's office in consultation with the administrator in charge of each service. The City of Fishers already provides fire and EMS service to the proposed area. In addition, the city administers all of the planning, zoning, building permits and code enforcement for the annexed area. The City Parks are already easily assessable and utilized by the proposed annexation area.

In each case service is being or will be provided to the area to be annexed within one (1) year in the same manner as those services are provided to areas within the corporate boundaries, regardless of similar topography, patterns of land use, and population density, and in a manner consistent with federal, state, and local laws, procedures and planning criteria.

C. Providing Capital Municipal Services

The capital services within the Annexed Area were evaluated to determine what, if any, new is needed to provide services to the area in the same manner as those services are provided to other areas within the City’s boundary. Each capital service was assessed and, where required, specific improvements have been programmed.

In each case service is being or will be provided to the area to be annexed within 3 years after the effective date of the annexation in the same manner as those services are provided to areas within the corporate boundaries, regardless of similar topography, patterns of land use, and population density, and in a manner consistent with federal, state, and local laws, procedures and planning criteria.

D. Liability for Indebtedness of a Township To the extent required by statute, the City is liable for and shall pay any indebtedness in the same ratio as the assessed valuation of the property in the annexed territory bears to the assessed valuation of all property in the township as reflected in the most recent assessment for taxation before the annexation. Payment must be made to the township executive at the time of annexation unless the assessed property within the municipality is already liable for the indebtedness. If the indebtedness consists of outstanding unpaid bonds or notes of the township, the payments to the executive shall be made as the principal or interest on the bonds or notes becomes due. Fall Creek Township does not have indebtedness for which the assessed property within the City is not already liable.

E. Council Districts

The proposed Annexation Area will initially be assigned to City Council District 6 . The initial council district assignments are subject to subsequent reapportionment adjustments as required by law. Kroger ANX - Fiscal Plan

F. Financial Summary

The area proposed for annexation has been researched and analyzed in accordance with the terms of the Indiana code, Title 36, Article 4, Chapter 3. Indiana State Statutes require the City of Fishers to determine the costs to provide services for this proposed annexed territory. In addition, a comparison of the costs to provide service to the expected revenue is also required.

Municipal Cost to Provide Services

The City of Fishers has calculated that the overall total annual cost to support one residence within the City of Fishers is $ 1,372 based upon 2013 budget numbers.

The City of Fishers has calculated that the overall total cost to support commercial and industrial projects within the City of Fishers is $100 for each $ 15,991 of Gross Assessed Value.

The proposed annexation property being analyzed is in the ag/undeveloped category for cost consideration.

Expected Revenue from Proposed Annexation

The City of Fishers has calculated that the overall average annual revenue received from annexed property is $100 per $21,519 of Gross Assessed Value. This average applies to residential, industrial and commercial property.

Conclusion

The costs to provide non-capital services is negligible and can be funded within the current budget and future budgeting cycles.

The revenue and cost comparisons utilized in this analysis assumes that the planned annexation parcels will generate “average” revenue and require “average” costs to be incurred as calculated from historical information. The comparison of revenue and costs should be viewed as a “snapshot” of the cost of annexation if that annexation “stood alone” and required all municipal services.

The fact is that municipal services required for many smaller annexations can be accommodated by existing staff in many departments and incremental new cost to the City of Fishers is nearly zero. All city departments are resourced to accommodate new demands for services, up to a point, and then, after an accumulation of demand for services from multiple smaller annexations, some departments will require staff additions that will be justified through the city council’s annual budgeting process.

G. Recommendation

Annexation is recommended due to its conformity with the Indiana State Statutes governing annexation by a municipality, as noted below. The effective date of the annexation is expected to be thirty (30) days following its passage and recordation as required by law. Pursuant to I.C. 36-4-3-1.5, the area proposed for annexation is at least one-eighth contiguous to the existing corporate limits of the City of Fishers. Furthermore, this report has established a plan and cost estimate for the provision of municipal services to the area proposed for annexation and outlined provisions for the following, pursuant to IC 36-4-3-13-d.

1. The cost estimates of planned services to be furnished to the area proposed for annexation; 2. The method or methods of financing the planned services; 3. The plan for the organization and extension of planned services; 4. The provision of planned services of a non-capital nature within one (1) year of the effective date of the annexation; and 5. The provision of planned services of a capital improvement nature within three (3) years of the effective date of the annexation.

THE PROPOSAL SUBMITTED TO INCORPORATE THE REAL ESTATE MEETS THE STATUTORY REQUIREMENTS OF I.C. 36-4-3 QUALIFYING FOR ANNEXATION INTO THE CITY OF FISHERS.

The North Shore Woods/Taylor Woods (Kroger) property is recommended for annexation.

The Fiscal Plan for this property is available for public review at the time the project is placed on the City Council agenda for public hearing.

The City Council must adopt the Fiscal Plan prior to approving the Annexation Request.
