1.0 DEFINITIONS AND GENERAL INFORMATION

WEXFORD COUNTY COUNCIL in exercise of the powers conferred on them by Section 9 of the Road Traffic Act, 2004 (No. 44 of 2004), following consultation with An Garda Siochana and with the consent of Transport Infrastructure , hereby makes the following bye-laws in respect of the area comprising the administrative County of Wexford.

These Bye Laws shall come into operation on the ____ Day of ______2018

1.1 DEFINITIONS

In these bye-laws:

o “The Act of 1993” means the Act, 1993 (No. 14 of 1993); o “The Act of 2004” means the Road Traffic Act, 2004 (No. 44 of 2004); o “Administrative County of Wexford” means the County of Wexford; o “Built-up area speed limit and “special speed limit” have the meanings respectively assigned to them in part 2 of the Act 2004; o “Distance” means distance measured along the centre line of the road; o “The Minister means the Minister for Transport, Tourism and Sport; o “Local Road, , National Road” and Motorway have the meaning assigned to them by the Roads Act of 1993; o “Perimeter road” means a road on and along the roadway of which there runs the boundary of a county borough, a borough, or a town and shall be considered as being within such boundary for the purposes of these bye-laws; o “Road” means a public road and includes a motorway.

1.2 GENERAL INFORMATION

Default speed limits apply, except where special speed limits or road works speed limits apply and subject to the provisions of Section 10 and Section 11 of the Road Traffic Act 2004, to the following public road categories.

o Built-up area speed limit is 50 kilometres per hour for all mechanically propelled vehicles. o Regional and local roads speed limit is 80 kilometres per hour for all mechanically propelled vehicles. o National roads speed limit is 100 kilometres per hour for all mechanically propelled vehicles. o Motorway speed limit is 120 kilometres per hour for all mechanically propelled vehicles. 1.3 SPECIAL SPEED LIMITS

Special speed limits may be specified in bye-laws and applied as follows:

o 20 kilometres per hour, which shall only be applied in respect of a road or roads (other than a motorway) in accordance with guidelines issued by the Minister 4 | P a g e County Wexford Road Traffic Special Speed Limit Bye Laws 2018 DRAFT

o 30 kilometres per hour, which shall only be applied in respect of a road or roads (other than a motorway) in accordance with guidelines issued by the Minister under Section 9 (9) of the Road Traffic Act 2004.

o 40 kilometres per hour, which shall only be applied in respect of a road or roads (other than a motorway) in accordance with guidelines issued by the Minister under Section 9 (9) of the Road Traffic Act 2004.

o 50 kilometres per hour, in respect of any road other than a road in a built-up area.

o 60 kilometres per hour.

o 80 kilometres per hour, in respect of a motorway, a national road or a road in a built-up area.

o 100 kilometres per hour, in respect of a motorway, a non-urban regional or local road or a road in a built-up area.

o 120 kilometres per hour, in respect of a that forms part of a national road that is not a motorway in accordance with guidelines issued by the Minister under Section 9(9) of the Roads Traffic Act 2004.

1.4 PERIODIC SPEED LIMITS

The Periodic Special Speed Limit shall be the speed limit for mechanically propelled vehicles for the specified period or periods during the day or during specific days on a specific road or specific motorway or part of it and such Special Speed Limits shall, notwithstanding any other provision in the said Bye-Laws relating to any such road or motorway or part of it, be the speed limit for that road for that period or periods only.

1.5 SCHEDULE LIST

o Schedule 1 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the First Schedule shall be 20 kilometres per hour.

o Schedule 2 - The Special speed limit for mechanically propelled vehicles on the roads specified in the Second Schedule shall be 30 kilometres per hour.

o Schedule 3 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Third Schedule shall be 40 kilometres per hour.

o Schedule 4 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule shall be 50 kilometres per hour.

o Schedule 5 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Fifth Schedule shall be 60 kilometres per hour.

o Schedule 6 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Sixth Schedule shall be 80 kilometres per hour.

o Schedule 7 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Seventh Schedule shall be 100 kilometres per hour.

o Schedule 8 - The Special Speed Limit for mechanically propelled vehicles on the roads specified in the Eighth Schedule shall be 120 kilometres per hour.

o Schedule 9 - Roads in respect of which a Periodic Special Speed Limit of 30 km/hr during specified periods and specified days is prescribed, in accordance with Section 9 (5) of the Road Traffic Act 2004 are listed in the Ninth Schedule.

o Schedule 10 - Roads in respect of which a Periodic Special Speed Limit of 40km/hr during specified periods & specified days is prescribed, in accordance with Section 9(5) of the Road Traffic Act 2004 are listed in the Tenth Schedule.

1.6 EXEMPTIONS

There shall be exempted from the special speed limits prescribed in these bye-laws the following:-

Ambulances, Fire Brigade Vehicles and Vehicles used by members of An Garda Siochana in the performance of their duties as such members.

2.0 REPEALS

The following Speed Limit Bye-laws are hereby revoked insofar as they apply to the Administrative area of County Wexford;

“County Wexford Special Speed Limit Bye Laws 2008”

3.0 CITATION

These bye-laws may be cited as the

“County Wexford Road Traffic Special Speed Limit Bye-Laws 2018”

These Bye-Laws will come into operation on the _____ of ______2018

All alterations and additions to the existing County Wexford Special Speed Limit Bye-Laws 2008 have been indicated in Yellow.

4.1 First Schedule (20 km/h) - Enniscorthy District

20 km/h shall be the Special Speed Limit for mechanically propelled vehicles on those public roads shown indicatively on the accompanying drawings and as specified hereunder.

4.2 Second Schedule (30 km/h) - Enniscorthy District

30 km/h shall be the Special Speed Limit for mechanically propelled vehicles on those public roads shown indicatively on the accompanying drawings, shaded Yellow and as specified hereunder.

4.3 Third Schedule (40 km/h) - Enniscorthy District

40 km/h shall be the Special Speed Limit for mechanically propelled vehicles on those public roads shown indicatively on the accompanying drawings, shaded Magenta and as specified hereunder.

4.4 Fourth Schedule (50 km/h) - Enniscorthy District

50 km/h shall be the Special Speed Limit for mechanically propelled vehicles on those public roads shown indicatively on the accompanying drawings, shaded Orange and as specified hereunder.

1. The following roads at Ballaghkeen:- (Map Ref SL-EN-18-01)

(a) The Enniscorthy-Blackwater Road (R744) between a point 505 metres north-west of its junction with the Ballymurn Road and a point 95 metres east of said junction.

(b) The Ballymurn Road for a distance of 300 metres from its junction with the Enniscorthy-Blackwater Road (R744).

(c) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

2. The following roads at Ballindaggan:- (Map Ref SL-EN-18-02)

(a) The Kiltealy-Ferns Road (R745) between a point 255 metres west of its junction with the Coolycarney Road and a point 300 metres east of said junction.

(b) Coolycarney Road for a distance of 265 metres south-west of its junction with the Kiltealy-Ferns Road (R745).

(c) Templeshanbo Road for a distance of 385 metres from its junction with the Kiltealy-Ferns Road (R745).

(d) School Road for a distance of 315 metres from its junction with the Coolycarney Road.

(e) Curraghgraigue Road for a distance of 90 metres from its junction with the School Road.

(f) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

3. The following roads at Ballyhoge:- (Map Ref SL-EN-18-03)

(a) The Enniscorthy-Killurin Road between a point 235 metres north of its junction with the Galbally Road and a point 230 metres south of said junction.

(b) Galbally Road for a distance of 770 metres from its junction with the Enniscorthy-Killurin Road.

(c) Bellvue Road for a distance of 120 metres from its junction with the Enniscorthy-Killurin Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

4. The following roads at Ballymurn:- (Map Ref SL-EN-18-04)

(a) The Enniscorthy- Road between a point 250 metres north- west of its junction with the Oilgate Road and a point 228 metres south-east of said junction.

(b) Oilgate Road for a distance of 135 metres from its junction with the Enniscorthy-Curracloe Road.

(c) Ballina Upper Road for a distance of 350 metres from its junction with the Enniscorthy-Curracloe Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

5. The following roads at Blackwater:- (Map Ref SL-EN-18-05)

(a) The Curracloe- Harbour Road (R742) between a point 364 metres north-east of its junction with the Beach Road (L2031) and a point 364 metres south-west of its junction with the Enniscorthy Road (R744).

(b) Enniscorthy Road (R744) for a distance of 625 metres from its junction with the Curracloe-Courtown Harbour Road (R742).

(c) Beach Road (L2031) from its junction with the Curracloe-Courtown Harbour Road (R742) to its terminal point at the Coast.

(d) Ballyconnigar Road (L6168) from its intersection of the Beach Road (L2031) to its terminal point at the Coast.

(e) Inch Lane (L6004) for a distance of 250 metres from its junction with the Curracloe-Courtown Harbour Road (R742).

(f) The roads in Ashfield.

(g) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

6. The following roads at Bree:- (Map Ref SL-EN-18-06)

(a) The Knocknagross-Clough Road between a point 540 metres north of its junction with Bree Lane and a point 330 metres south of said junction.

(b) Bree Lane for a distance of 100 metres from its junction with the Knocknagross-Clough Road.

(c) The roads in Hillview, Rock of Bree and Cluain Aiteann.

7. The following roads at Bunclody:- (Map Ref SL-EN-18-07)

(a) The Bunclody-Enniscorthy Road (National Road N80) between a point 75 metres north-west of its junction with Church at Clody (County Boundary with County ) and a point 250 metres south- east of its junction with Irish Street (R746), including Carrickduff Road (part of), The Mall, Ryland Street and Ryland Road (part of).

(b) Irish Street (R746) and its continuation as the Kiltealy Road between its junction with Ryland Street (National Road N80) and a point 53 metres south-east of its junction with Hospital Hill.

(c) Church Street and its continuation as the Mill Road for a distance of 770 metres from its junction with The Mall (National Road N80).

(d) Road (R746) for a distance of 575 metres north-east of its junction with Ryland Street (National Road N80).

(e) Hospital Hill between its junction with the Kiltealy Road (R746) and a point 220 metres south-west of its junction with Ard Colm.

(f) Chapel Lane and Market Square.

(g) The roads in Sliabh Ros and Mill Road.

(h) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

8. The following roads at Castledockrell:- (Map Ref SL-EN-18-09)

(a) The Ballindaggan-Mountfin Road between a point 390 metres west of its junction with the Tombrick Road and a point 230 metres east of said junction.

(b) Tombrick Road for a distance of 525 metres from its junction with the Ballindaggan-Mountfin Road.

(c) Tomanoole Road for a distance of 170 metres from its junction with the Ballindaggan-Mountfin Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

9. The following roads at :- (Map Ref SL-EN-18-10)

(a) The Bunclody-Ferns Road between a point 83 metres north-east of its junction with the Bunclody-Enniscorthy Road (National Road N80) and a point 330 metres south-east of its junction with the School Road.

(b) School Road for a distance of 925 metres from its junction with the Bunclody-Ferns Road.

(c) Graigue More Road for a distance of 95 metres from its junction with the School Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

10. The following roads at Courtnacuddy:- (Map Ref SL-EN-18-11)

(a) The Courtnacuddy-Rathfylane Road between a point 240 metres west of its junction with Chapel Lane and a point 225 metres south-east of said junction.

(b) Chapel Lane for a distance of 160 metres from its junction with the Courtnacuddy-Rathfylane Road.

11. The following roads at Davidstown:- (Map Ref SL-EN-18-12)

(a) The Coolamurray-Ballygillistown Road between a point 440 metres north-west of its junction with Cloney Park and a point 195 metres east of said junction.

12. The following roads adjacent to and near Enniscorthy Town:- (Map Ref SL- EN-18-13-1 & SL-EN-18-13-2)

(a) Kiltealy Road (R702) between the point where the Enniscorthy Town boundary intersects the north-eastern side of the road and a point 7 metres north-west of the centre point of the Bloody Bridge.

(b) Munster Hill between its junction with the Enniscorthy-New Ross Road (National Road N30) and the point where the Enniscorthy Town boundary intersects the eastern side of the road.

(c) Oulart Road (R744) between the Enniscorthy Town boundary and a point 40 metres south-east of its junction with Rectory Heights.

(d) Solsborough Road for a distance of 66 metres north-east of its junction with the Oulart Road (R744).

(e) Old Church Road and its continuation as Rectory Road between the Enniscorthy Town boundary and its junction with the Oulart Road (R744).

(f) Esmonde Road between the Enniscorthy Town boundary and its intersection with the Aughnagalley Road.

(g) That part of the Spring Valley Road which lies outside of the Enniscorthy Town boundary.

(h) Nunnery Road (R890) between the point where the Enniscorthy Town boundary intersects the south-eastern side of the road and a point 425 metres north-east of said point.

(i) Killagoley Road between its intersection with the Esmonde Road and a point 340 metres south-west of said junction.

(j) The Drumgold / Aughnagalley Road between the point where the Enniscorthy Town boundary intersects the north-eastern side of the road and a point 75 metres south east of its intersection with Esmonde Road.

(k) Gaelscoil Road for a distance of 120 metres from its junction with the Aughnagalley Road.

(l) Moyne Road between its junction with Nunnery Road (R890) and a point 985 metres north of said junction.

(m) Ross Road (Carleys Bridge Road) between the Enniscorthy Town boundary and a point 860 metres south-west of said boundary.

(n) Cherryorchard Road between its junction with the Kiltealy Road (R702) and a point 570 metres west of said junction.

(o) Greenville Lane between its junction with the Moyne Road and its terminal point in Greenville a distance of 885 metres.

(p) The roads in The Paddocks.

13. The followings roads at Galbally:- (Map Ref SL-EN-18-14)

(a) The -Bree Road between a point 245 metres south west of its junction with the Adamstown Road and a point 115 metres north east of said junction.

(b) Adamstown Road for a distance of 150 metres from its junction with the Taghmon-Bree Road.

(c) Ballyhoge Road for a distance of 250 metres from its junction with the Taghmon-Bree Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

14. The following roads at Glenbrien:- (Map Ref SL-EN-18-15)

(a) The Enniscorthy-Ballymurn Road between a point 675 metres north- west of its junction with the Ballyroe Road and a point 65 metres south- east of said junction.

(b) Ballyroe Road for a distance of 360 metres from its junction with the Enniscorthy-Ballymurn Road.

(c) Ballynastraw Road for a distance of 30 metres from its junction with the Enniscorthy-Ballymurn Road.

(d) The road in St. Bernadette’s Avenue.

(e) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws..

15. The following roads at Kilmyshall:- (Map Ref SL-EN-18-16)

(a) The Ballyphilip-Ryland Lower Road between a point 230 metres south- west of its junction with the School Road and a point 380 metres north- east of said junction

(b) School Road for a distance of 535 metres from its junction with the Ballyphilip-Ryland Lower Road.

(c) Old School Lane for a distance of 215 metres from its junction with the School Road.

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

16. The following roads at Kiltealy:- (Map Ref SL-EN-18-17)

(a) The New Ross-Bunclody Road (R730/R702) between a point 220 metres south-west of its junction with the Road (R702) and a point 500 metres north-east of said junction.

(b) Kilkenny Road (R702) for a distance of 145 metres north-west of its junction with the New Ross-Bunclody Road (R730/R702).

(c) Mocurry Road for a distance of 385 metres from its junction with the Bunclody Road (R702).

(d) All other public roads (including housing estates) which are located within the zone created by the points above but excluding any roads that are defined in any other Schedule within these Bye-Laws.

17. The following roads at Marshalstown:- (Map Ref SL-EN-18-18)

(a) Farmley Road for a distance of 520 metres north-east of its junction with the Ballyorril Road.

(b) Ballydaw Road for a distance of 770 metres south-west of its junction with the Ballyorril Road.

(c) Ballyorril Road for a distance of 625 metres south-east of its junction with the Farmley Road.

(d) The roads in St. Joseph’s Park.
