If one wants to build a structure on his or her property, should he or she be concerned about the small stream or wetland in the backyard? Does the size of the stream or wetland matter? Does it matter if the stream flows continuously throughout the year? What if there is a lake nearby? What if one receives a nod from state authorities to go forward with a development project-can one initiate such a project without authorization from the federal government?     THE POTENTIAL IMPACT OF UNITED STATES v. LOPEZ ON ENVIRONMENTAL REGULATION LORI J. WARNER* United States v. Lopez, which held a statute unconstitutional for exceeding Congress's commerce power, raises complex issues regarding federalism and the nature and scope of federal authority under the Commerce Clause. The decision is significant in relation to environmental regulation because many environmental protection statutes were passed pursuant to the commerce power and may now be susceptible to challenge. This Article assesses the vulnerability of certain provisions of the Clean Water Act and the Endangered Species Act in light of the Lopez decision. In particular, the Article explores whether the destruction of isolated wetlands and the degradation of endangered species' habitat are economic activities that substantially affect interstate commerce. While plausible arguments may be made to the contrary, this author ultimately concludes that the analyzed provisions satisfy Lopez, and are thus capable of withstanding constitutional challenge. Our organizations strongly oppose any regulatory action that limits the scope of the MBTA’s prohibitions “only to actions directed at migratory birds, their nests, or their eggs.” Our legal, scientific and policy explanations for opposing this action are well documented, and we incorporate by reference our previously submitted comments here.1 The FEIS, released on November 27, 2020, fails to address our comments and remains wholly insufficient in its analysis to form a reasoned basis on which the Service can justify its action. The cursory changes throughout the FEIS – as compared to the draft released on June 5, 2020 – demonstrate not only a severe lack of regard to abide by applicable laws, but also a complete unwillingness to consider the overwhelming majority2 of public comments submitted in opposition to this proposed rule. In addition to hundreds of thousands of public comments, unresolved objections by more than 25 states, 30 tribes, three flyway councils, our treaty partner, Canada, and more remain on the record.

    Migratory Birds and the Administrative State David A. Strauss† INTRODUCTION Solid Waste Agency of Northern Cook County v United States Army Corps of Engineers,1 a case in which Judge Diane Wood wrote the opinion for a unanimous Seventh Circuit panel, ad- dressed important questions about both the Commerce Clause and the Clean Water Act2 (CWA). The Supreme Court reversed the Seventh Circuit’s decision by a vote of five to four.3 To read the Supreme Court’s majority opinion side by side with Judge Wood’s is to see a contrast that does not, to put it mildly, make the Supreme Court look good. Judge Wood’s opinion is lucid, care- ful, and measured; it deals with the complexities of environmen- tal protection in a realistic way. The majority opinion of the Su- preme Court is loosely reasoned and almost transparently result oriented. As it turned out, the Supreme Court’s decision in SWANCC (as it is abbreviated) was a first step in rolling back the federal government’s power to implement the CWA.4 And the con- trast between what Judge Wood did and what the Court did is a warning about the future not just of environmental protection but of the administrative state. I.
