This article proposes a public interest principle that would guide courts to settle fair use cases with better-informed decisions. I argue that the proposed principle would legally upgrade fair use from serving as an engine of free expression to serving as an engine of public interest protection. SESSION OF 2021 CONFERENCE COMMITTEE REPORT BRIEF HOUSE BILL NO. 2026 As Agreed to April 8, 2021 Brief* HB 2026 would establish a certified drug abuse treatment program for certain persons who have entered into a diversion agreement pursuant to a memorandum of understanding and amend law related to supervision of offenders and the administration of certified drug abuse treatment programs. It also would amend law to change penalties for crimes involving riot in a correctional facility and unlawfully tampering with an electronic monitoring device. Certified Drug Abuse Treatment Program—Divertees The bill would establish a certified drug abuse treatment program (program) for certain persons who have entered into a diversion agreement (divertees) pursuant to a memorandum of understanding (MOU). The bill would allow eligibility for participation in a program for offenders who have entered into a diversion agreement in lieu of further criminal proceedings on and after July 1, 2021, for persons who have been charged with felony possession of a controlled substance and whose criminal history score is C or lower with no prior felony drug convictions. ____________________ *Conference committee report briefs are prepared by the Legislative Research Department and do not express legislative intent. Conspiracy, it is generally said, is a necessary doctrine in some respects, but also one that is overbroad and invites abuse. Conspiracy has been thought to be necessary for one or both of two reasons. First, it is said that a separate offense of conspiracy is useful to supplement the generally restrictive law of attempts. Plot- ters who are arrested before they can carry out their dangerous schemes may be convicted of conspiracy even though they did not go far enough towards completion of their criminal plan to be guilty of attempt.' Second, conspiracy is said to be a vital legal weapon in the prosecu- tion of "organized crime," however defined.' Hoffman * The use of celebrities' names, pictures, and other identifying character- istics in connection with the mass merchandising of consumer products and services has increased greatly in the last decade. Because a celebrity adds audience appeal to the commercial products that he or she endorses, like the presence of a much-publicized trademark, the purchasing public's desire to obtain such products is enhanced. This merchandising phenomenon, coupled with the media's increased use of the personal attributes' of the famous in connection with fictionalized movies and novels,2 has escalated the judicial development of the right of publicity doctrine. A review of the current cases concerning this right of recent origin3 reveals that celebrities and their heirs are no longer content to permit unauthorized commercial uses and media portrayals of their publicity rights to go unchallenged. -

M. A. S. TORTS-LIBEL AND SLANDER-FAIR COMMENT.-The plaintiff is a district attorney. He commenced this action against a news- paper publisher alleging the publication of two defamatory articles. The first article stated that a petition had been filed with the gov- ernor requesting him to name a competent attorney to conduct an investigation of a case which the plaintiff had handled. The second article contained a statement of an attorney criticizing the method in which the plaintiff had handled the aforementioned case, and by in- nuendo charged the plaintiff with incompetency. -

Requirement that trial counsel confine their argument strictly to the evidence and to the arguments of opposing counsel does not mean that jury arguments must be sterile or nondescript; instead, counsel has great latitude in discussing the facts and issues, and may discuss the environments or circumstances of the case, the reasonableness or unreasonableness of the evidence, and the probative effect, or lack thereof, of the evidence. In jury argument the facts of the case may be related to history, fiction, personal experience, anecdotes, Bible stories, or jokes. Green v. Charleston Area Medical Center, Inc., 600 S.E.2d 340 W.Va.,2004 Great latitude is allowed counsel in argument of cases, but counsel must keep within the evidence, not make statements calculated to inflame, prejudice, or mislead the jury, nor permit or encourage witnesses to make remarks which would have a tendency to inflame, prejudice, or mislead the jury. Boxa* NATURE OF THE DEFENSE A quarter of a century has passed since Professor Hallen ex- haustively explored the role of fair comment in actions for defama- tion.' His analysis has withstood the passing of time. A review of the subject to date shows numerous litigation and a plethora of ap- plication but little in the nature of fundamental development. This writer, a former student of the late Professor, is pleased to par- ticipate in honoring him by reconsidering this segment of hig specialized subject. At the outset it may be noted that there is still conflict and uncertainty as to the exact nature of the defense of fair comment. It has been denominated as both a right2 and a privilege. 3 It has also been said that its exact nature is of no consequence since im- munity results in either case.4 The English view concerning the nature of fair comment as a right is succintly stated thus: It is the right of everyone, not the privilege of any par- ticular individual, to comment fairly and honestly on any matter of public interest, and the defense of fair comment is equally applicable whether the criticism be oral or writ- ten. THORNTON$ FORTY years ago Bohlen expressed the view that "There is no dis- tinction more deeply rooted in the common law and more fundamental than that between misfeasance and non-feasance, between active mis- conduct working positive injury to others and passive inaction, a fail- ure to take positive steps to benefit cthers, or to protect them from harm not created by any wrongful act of the defendant." 1 The line between "active misconduct" and "passive inaction" is not easily drawn. The range of human conduct theoretically susceptible of tort consequence runs from the zenith of clearly affirmative mis- conduct (misfeasance) to the nadir of clear inaction (nonfeasance), but there exists an area of shadow-land where misfeasance and non- feasance coalesce. The existence of this shadow-land is well illustrated by Bohlen's famous example. 2 For one to use a chattel known to be defective in such a way as to create a serious risk of harm to others is palpably a misfeasance. On the other hand a failure to take steps to provide protection for people who come on one's premises without in- vitation and without permission is patently passive inaction, a non- feasance. But between those extreme cases consider a median situation where one uses a chattel for a particular purpose without having ascer- tained by inspection or othenvise whether it is fit for that purpose, with knowledge that the article, if defective, will create a serious risk of harm to others. Here there exists an admixture of nonfeasance and misfeasance. -

Thank you for the opportunity to provide testimony to the Committee on the Judiciary and Public Safety for the record of the public hearing on B23-0723, the “Rioting Modernization Amendment Act of 2020” (hereafter “rioting bill”), and B23-0882, the “Comprehensive Policing and Justice Reform Amendment Act of 2020,” (hereafter “policing and justice reform bill”). My name is Richard Schmechel. I am the Executive Director of the Criminal Code Reform Commission (CCRC) and am testifying on its behalf. The CCRC is a small, independent District agency that began operation October 1, 2016. The CCRC’s primary mission is to issue comprehensive recommendations for the Mayor and Council on reform of the District’s criminal statutes. Specifically, the CCRC’s work is focused on developing comprehensive recommendations to reform the District’s “substantive” criminal statutes—i.e. laws that define crimes and punishments. The CCRC expects to issue its final recommendations on or by March 30, 2021. These recommendations will address at least four matters in the policing and justice reform bill and rioting bill, including: (1) codification of a new restriction on law enforcement use of force; (2) repeal of the current failure to arrest statute (D.C.
