JUDGMENT Nkutha-Nkontwana J. Background [1] In this matter the applicant (Solidarity) is suing the respondent (Damelin) by way of a stated case for a back-pay in the amount of R420 000.00 consequent to an order reinstating its member, Mr Parkinson. Damelin had dismissed Mr Parkinson on 15 May 2012. Solidarity unsuccessfully challenged his dismissal at the Commission for Conciliation, Mediation and Arbitration (CCMA). The commissioner, Mr Sithole, found that his dismissal was procedurally and substantively fair. 2 [2] Solidarity launched the review proceedings and succeeded. In a judgement delivered on 2 December 2014, this Court, per Bleazard AJ, reviewed and set aside the award, replacing it with an order reinstating Mr Parkinson retrospective to 1 January 2014. Damelin appealed the judgment but was unsuccessful. The Labour Appeal Court, in judgment delivered on 10 January 2017, dismissed the appeal with costs. [3] I pause to allude to the fact that Mr Parkinson secured employment with his current employer on 21 August 2014. Soon after receiving the judgment by Bleazard AJ, Solidarity addressed a letter to Damelin, through its attorneys, proposing a discussion on compensation instead of reinstatement. Damelin was seemingly not indulgent; instead, it instituted the appeal proceedings. [4] On 17 January 2017, Damelin’s attorneys addressed a letter to Solidarity stating the following: ‘We refer to the above matter and note the judgment handed down by the Labour Appeal Court on 10 January 2017.

    Distance Education at Traditionally Contact Higher Education Institutions REPORT PREPARED FOR THE SOUTH AFRICAN COUNCIL ON HIGHER EDUCATION Introduction In the second half of 1999, in response to a concern raised by the Council on Higher Education (CHE), SAIDE undertook a research process examining distance education practices at traditionally contact public higher education institutions. The research was conducted under the auspices of the Higher Education branch of the Department of Education. The aim of this work has been to understand better the nature of these practices, and to use this understanding to inform policy developments in South African higher education. The statistical analysis was to be conducted by the national Department, and is not incorporated into this report. In this summary report in Part One, we outline key trends emerging from our research work, then, in Part Two, we make a limited number of recommendations drawn from our findings. The summary is supplemented by in-depth appendices capturing the details of our findings. In the interests of brevity, we have not incorporated these into the summary itself, but have ensured that all observations made in this report are substantiated by the research we have undertaken. In this regard, we have drawn on a range of primary research tasks: Case studies of selected programmes that described themselves, in some form or another, as using distance education methods. These case studies were written on the basis of institutional visits and interviews conducted with officials of providing institutions. What is the framework of higher education and situating journalism education in that? South Africa’s education system is divided into three levels – primary, secondary and tertiary which consists of universities, universities of technology and further education and training colleges. Journalism education is taught in the universities and universities of technology. The universities of technology are fairly recent additions to the tertiary education framework and many of them were “merged” into already-existing universities under a plan to revise the academic landscape by the SA Minister of Education in 2003. Before the mergers they were called technikons and their journalism teaching components had a strong focus on practical journalism without the theoretical media studies, cultural studies or communication studies components other universities were teaching. Typically two years of study with one spent in a newsroom resulted in a diploma in journalism. When they were merged with other institutions or became universities of technology they began to offer degrees and so revised their curricula adding more theoretical courses to reflect this enhanced status. Many of these institutions still produce graduates considered by many editors as more likely to “hit the ground running” when they apply for jobs in South African newsrooms (see http://mg.co.za/article/2007-10-16-the-best-journalism-schools-in-sa ). The universities consist of both public institutions and private institutions although there are few of these (among them Monash, an Australian university, Midrand and Varsity College) and private institutions did not exist in this arena until the post-apartheid era.
