Geotechnical Transportation iii Innovation Park Medway Request for an EIA Screening and Scoping Opinion 1.0 INTRODUCTION Planning context 1.1.1 Medway Council (MC) and Tonbridge and Malling Borough Council (TMBC) (hereafter jointly referred to as ‘the applicant’) are preparing a masterplan for the development of approximately 18.37 hectares (ha) of land on the current site of Rochester Airport, referred to as the ‘Proposed Development’, for employment-led development and supporting infrastructure. The site location and red line boundary are shown within Appendix A. 1.1.2 The preferred way for the development to be progressed is by way of a Local Development Order (LDO) in accordance with section 61A of the Town and Country Planning Act 1990. Such an order should be screened for the need for Environmental Impact Assessment in accordance with Regulation 6 of the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 (the ‘Regulations’), as amended. 1.1.3 This report therefore represents a formal request for an Environmental Impact Assessment (EIA) Screening Opinion and a subsequent Scoping Opinion. 1.1.4 MC will act as lead planning authority. TMBC will act in a consultative basis and will adopt the agreed EIA Screening and Scoping Opinions. 1.1.5 This request for an EIA Screening and Scoping Opinion was originally submitted, and issued for consultation in October 2018. Subsequently, consultation comments have been taken into account and the scope of the EIA has been updated. The request for a Scoping Opinion is therefore being re-issued for consultation. To aid interpretation by consultees that had reviewed and commented on the previous draft, the additional sections of text have been provided in a blue font. An additional appendix has also been included (Appendix C). Innovation Park Medway Request for an EIA Screening and Scoping Opinion 2.0 THE DEVELOPMENT IN THE CONTEXT OF THE EIA REGULATIONS Screening and the Local Development Order 2.1.1 This Request for a Screening Opinion is issued in accordance with the requirements set out within the Town and Country Planning (Environmental Impact Assessment) Regulations 2017, as amended. 2.1.2 Regulation 32 deals with LDO applications, which states that an LDO must not be made until the Local Planning Authority has adopted a screening opinion. In this context, the Proposed Development falls within the descriptions of development contained within Schedule 2, category 10(a) Industrial estate development projects. 2.1.3 A development is considered to be Schedule 2 development if any part of it lies within a ‘sensitive area’ or if it meets or exceeds the relevant thresholds and criteria for that category of development, as detailed in the EIA Regulations. For category 10(a) projects, this is as follows: i. “The area of the development exceeds 0.5 hectares.” 2.1.4 Schedule 3 of the Regulations sets out the considerations that are to be applied in determining whether significant environmental effects may be present sufficient to require an EIA. These are: i. Characteristics of the proposed development; ii. Nature of the receiving environment; and iii. Characteristics of the potential environmental impacts arising from
