Township launches innovative BizPal support for businesses

PORT CARLING: The Township of is proud to introduce an innovative business tool for new, expanding and relocating businesses.

BizPal is an online service that simplifies the process of obtaining business permits, licences and other regulatory requirements for entrepreneurs, governments, and business service providers.

“People who are interested in starting or expanding a business simply have to answer the online questionnaire and they will receive a list of all the permits and licences they will need from the Township of Muskoka Lakes, the District of Muskoka, the Province of Ontario and the federal government,” says Mayor Susan Pryke. “It’s convenient one- stop shopping.”

Muskoka Lakes Township is the first municipality in Muskoka to partner with the federal and provincial governments to provide this service. The initiative was recommended by the Township’s Economic Development Committee, as a result of the report from the citizens’ task force on improving government processes.

MAYOR’S TOURNAMENT TO BENEFIT BLISSYMBOLICS LEARNING CENTRE

PORT CARLING: The Blissymbolics Learning Centre will be the beneficiary of the Mayor’s Golf Classic, to be held September 15, 2008. Funds raised will support an instructional program for non-speaking students to further their communication, literacy and computer skills.

“I have been a proud supporter of this organization since they opened their doors in Bala in 2002,” says Mayor Susan Pryke. “The Blissymbolics Learning Centre helps profoundly disabled, non verbal adults with Cerebral Palsy gain independence, but its presence in our community helps us all better understand the abilities and needs of persons who cannot speak.”

Ensuring the learning centre has the funds necessary to continue its good work is an ongoing challenge. “We are very grateful to the Mayor for selecting The Blissymbolics Learning Centre as the recipient of proceeds from this year’s Mayor’s Golf Classic,” says Executive Director Mara Smelters-WeIr.

Township of Muskoka Lakes joins Earth Hour challenge

PORT CARLING: At 8 pm on March 29, the world will turn off its lights for just one hour – Earth Hour – to show their support for taking action on climate change.

The Township of Muskoka Lakes will be participating in Earth Hour by turning off its non-essential lights and computer monitors and encouraging staff, councillors, businesses and residents to do the same.

Climate change is the biggest environmental threat to our planet and the number one concern for Canadians. We are already seeing its impact.

“Participating in Earth Hour is a simple way to show that you want to be a part of the solution. Together we can make a difference,” says Mayor Susan Pryke.

“Personally, I have registered my commitment at www.earthhour.org and I would encourage you to do the same.”

Last year more than two million residents in Sydney, Australia participated in Earth Hour and more than 2,000 businesses, which resulted in a 10.2 per cent energy drop. This was double the anticipated energy savings and represents a reduction of 24.86 tonnes of carbon dioxide, which is the equivalent of taking 48,613 cars off the road for an hour.

MUSKOKA BID COMMITTEE MEDIA RELEASE FOR IMMEDIATE RELEASE March 12, 2008 MUSKOKA WANTS THE 2010 ONTARIO WINTER GAMES!

The Muskoka-wide Bid to host the 2010 Ontario Youth Winter Games was submitted to the Sport Alliance of Ontario in early February. As part of the evaluation process, representatives of the Sport Alliance of Ontario will be conducting a site visit on March 19th , 2008. The bid committee is looking for assistance from our community organizations and businesses to demonstrate that not only is Muskoka capable, of hosting the event, but that “MUSKOKA WANTS THE ONTARIO WINTER GAMES 2010!”

If successful, the Ontario Youth Winter Games would attract up to 4000 athletes, coaches and officials to our region to participate in over 20 events. The Bid Committee has suggested that our hosting dates would be February 24-28, 2010.

According to Cheryl Kelley, a representative of the bid committee and Director of Economic Development for the Town of Bracebridge said, “we are calling on our communities (Muskoka-wide) to hang posters in their windows that say ‘MUSKOKA WANTS THE 2010 ONTARIO WINTER GAMES!” “As well”, she added, “businesses that have changeable signage are asked to add the same message to their signs”.

Kelly Haywood, also a member of the bid committee and Manager of the Huntsville/ Chamber of Commerce suggests, “these messages from the business community and Muskoka-at-large will go a long way in showing that our residents are enthusiastic about the Games. This will demonstrate to the evaluation committee that we are excited about the potential of hosting this event in Muskoka “.

The Ontario Youth Winter Games is held every two years and brings together athletes, officials, supporters and volunteers. In the 2008 event, which ended on March 9 th the participants numbered over 3200. The communities of Collingwood and surrounding area hosted 23 sports over 5 days of competition. The Winter Games helps the province's amateur athletes hone their skills for future national and international events.

The Sport Alliance of Ontario announced today that Muskoka has been unanimously chosen to host the 2010 Ontario Winter Youth Games. This announcement comes following the lengthy bidding process that included a formal bid submission and the successful site visit, which took place on March 19th.

“The Ontario government is pleased to have Muskoka as our partner in these Games, which will showcase great competition and tremendous community spirit,” said Ontario Health Promotion Minister Margarett Best. “Congratulations to the leaders and volunteers of the Muskoka bid. “The Muskoka Region submitted a very thorough and comprehensive bid,” said Blair McIntosh, Site Selection Chair for the 2010 Ontario Winter Games - Youth. “The pride and enthusiasm of the communities during our site evaluation was a true reflection of their abilities. It solidified for us that the care and comfort of the participants will be a priority and that they will do a great job in organizing and hosting the 2010 Ontario Winter Games.”

Speaking on behalf of the Bid Committee, Kelly Haywood, General Manager – Huntsville/Lake of Bays Chamber of Commerce said, “The Muskoka bid committee is thrilled to receive the news. We believe that positive relationships were formed with the Sport Alliance of Ontario when Huntsville and Lake of Bays hosted a very successful inaugural Paralympic Winter Championships in 2006. “ Haywood went on to say, “We believe that through our partners from all over Muskoka, we will able to deliver another success for the Ontario Games Program”.

The bid committee comprised of members from all of Muskoka’s communities, representing economic development offices, recreation departments and chambers of commerce have been working on this initiative since late 2007. The members of the committee worked together to build the bid and plan the site visit. “It was a motivating experience, having all of Muskoka’s partners collaborate to execute such a significant task,” says Graydon Smith, District of Muskoka Councillor. “We look forward to the continuation of building great relationships across Muskoka.”

“This will benefit our communities in many ways; there is an obvious economic impact and we anticipate significant development of the involved sports along with the development of our volunteer base,” says John Cowan, Chair of Events Tourism Huntsville/Lake of Bays.

Cowan indicated that, “Hosting an event of this magnitude will not be possible without the help of our communities’ amazing volunteers and we know that volunteerism is alive and well in Muskoka”. The Winter Games will require the recruitment and training of approximately 1000 volunteers. Competitions for the Games will be hosted throughout the following communities; Bracebridge, Gravenhurst, Huntsville, Lake of Bays, Muskoka Lakes, Mount St. Louis Moonstone and Sudbury.

The development of shoulder season growth is gaining momentum as the communities within Muskoka continue to search out potential hosting opportunities. Sport tourism is one of the most rapidly developing sectors of the tourism industry. This industry is estimated at having an economic impact in excess of $2 billion per year in Canadian communities.

The next steps for this exciting initiative will be to form an organizing committee and to appoint a volunteer chair. Sub-chairs from all of the communities involved will also be recruited to ensure that there is adequate representation across the region. In addition, a general manager for the games will be hired for a contract position. This position will serve as a liaison between representatives at the Sport Alliance of Ontario and the Games Organizing Committee.

Process in the Bid Development:

The committee partnered with the City of Greater Sudbury and Mt. St. Louis Moonstone on this initiative. Sudbury is home to many outstanding facilities that are not available in Muskoka, and outsourcing to other communities is a common practice when trying to best facilitate the athletes. Mount St. Louis was selected as the ski partner to provide the western area of Muskoka, the opportunity to garner benefits through the hill itself and accommodation partners. While the tendency has been to look further south to accommodate the facility requirements, the bid committee felt it was more appropriate to invite collaboration with another northern partner.

When deciding which community would host each sport, the Muskoka Bid Committee examined which facility would best suit the needs of the athletes, as well as which one had an active sport organization or club for that particular sport. This would serve to better accommodate the visiting athletes, as they would have a host of knowledgeable volunteers and local athletes. The games promise to lead to continued sport development in our area.

Muskoka Lakes completes its Economic Development Strategy

PORT CARLING: The Township of Muskoka Lakes is set to launch its much anticipated Economic Development Strategy on April 30.

“This is the culmination of two years of research,” says Councillor Mary Grady, Chair of the Economic Development Committee. “We have thoroughly evaluated the issues impacting the business community and have identified 44 goals to address their concerns.”

In January 2006 the Township of Muskoka Lakes, in conjunction with Muskoka Futures and the Muskoka Lakes Chamber of Commerce, undertook a comprehensive, statistically significant Business Expansion and Retention Survey. This survey of 46 businesses took a snapshot of the economic health of our municipality. Amongst other findings, it identified key issues impacting business in the municipality.

Following the receipt of the final report of the B R+E survey in September 2006, six task forces were created to report to the new Economic Development Committee. The task forces reported on: infrastructure, affordable housing, labour force issues, services, government processes and promoting year-round business. The Economic Development Committee compiled and coordinated the Task Forces’ findings and recommendations into the Economic Development Strategy.

Some of the aims, objectives and goals of the Economic Development Strategy have already been achieved. It is important to note that departments or committees of the Township of Muskoka Lakes other than the Economic Development Committee have carried out many of these accomplishments. The success of our Economic Development Strategy is dependent upon the collaborative efforts of Council, businesses, institutions and community groups working together.

The Economic Development Strategy is available at the Township Office and on the Township website. Implementation of the Strategy includes an annual review of the progress made during the previous calendar year.

“Implementation of the Economic Development Strategy will allow the Township of Muskoka Lakes to approach the challenges ahead with enthusiasm and confidence,” says Mayor Susan Pryke.

All business owners and heads of organizations are encouraged to attend the launch, which will take place at 5pm on Wednesday, April 30 at the Delta Sherwood Inn. Light food and refreshment will be provided.

WALT SCHMID OFFERED PERMANENT POSITION AS CAO

PORT CARLING: Mayor Susan Pryke announced today that Walter H. Schmid has been offered the position of permanent CAO for the Township of Muskoka Lakes.

Mr. Schmid was installed as Interim CAO in December 2007, following the resignation of the former CAO.

“Following an in-depth job interview with Mr. Schmid, Council has determined that we have the very best candidate for the permanent job in the person of the interim CAO,” Pryke said.

“Over the last four months, Walt has had the opportunity to get to know this municipality and demonstrate his management skills and leadership style,” Pryke added. “Quite frankly we are impressed. Walt is a man of great personal integrity. He understands that paying attention to the little things ensures that they don’t become big issues. I do not think we could find a candidate more suited to our municipality, our Council and our employees than the one we have presently.”

Mayor’s Walk celebrates International Trails Day

PORT CARLING: Muskoka Lakes Mayor Susan Pryke extends an invitation to her annual Mayor’s Walk, held this year at Hardy Lake Provincial Park on Saturday, June 7 at 10 a.m. June 7th is International Trails Day, with events in various locations around the province.

The three-kilometre hike will take participants along the shore of Hardy Lake. The hike is one of the most picturesque in the Township and a favourite of residents and visitors alike.

Directions: Trail parking is off Muskoka Road 169, one kilometre west of Walkers Point Road, between Gravenhurst and Bala. Hiking trails require good footwear.

Restored 1890s Schoolhouse officially opened

PORT CARLING: The Township of Muskoka Lakes officially opened the restored 1890s Schoolhouse in Glen Orchard Thursday, July 24.

This is the second school for the area, replacing a log school that had burned down in 1886. It has served as a home for the Glen Orchard Women’s Institute for many years. They first used the building in 1941 to make clothing for troops overseas.

At the opening Mayor Susan Pryke thanked the architect, Duncan Ross, and the builders Quinan Construction, who were represented by project manager Mike Harvey.

“The Glen Orchard Women’s Institute made important contributions to this building, from detailing the history to caring for the building and keeping it a vital part of the community,” the mayor said.

The building was raised and a new foundation placed under it. Aesthetic improvements were also incorporated, but the heritage integrity of the building remains intact.

The mayor predicted that Council will be remembered for their foresight in preserving the little building and caring about the Township’s heritage.

Lake Joseph cottager to restore historic freight shed at Port Sandfield

PORT CARLING: David Sutherland Yoest, of St. Helen’s Island Lake Joseph, will restore the historic Port Sandfield freight shed and post office. The news of this donation to the Township of Muskoka Lakes was announced today by Mayor Susan Pryke.

The freight shed/post office has been in a state of disrepair for many years and efforts to replicate it have been delayed owing to the reconstruction of the canal.

Mr. Sutherland Yoest has engaged Gren Weis Architects to design an exact replica of the freight shed/post office. The proposal was presented to Township’s Management and Services Committee on July 30.

“We are fortunate to have residents willing to donate their resources for the good of the community,” says Mayor Pryke. “The Port Sandfield canal is a significant landmark in our municipality. The rehabilitation of the derelict freight shed will be a fitting complement to the rehabilitation work and park improvements undertaken by the Ontario Realty Corporation.”

Gren Weis will incorporate the original windows and some of the hardware (such as the original mail slot) into the structure. He plans on using locally milled lumber and local builders to complete the project. He also hopes to also recreate the interior of the post office and is looking for pictures that show the post office/freight shed in the early days.

MAYOR’S GOLF CLASSIC RAISES $60,000 FOR BLISSYMBOLICS

PORT CARLING: There were many champions at the Mayor’s Golf Classic at the Lake Joe Club on September 15, but the biggest winner of all was the Blissymbolics Learning Centre, the beneficiary of the charity event.

“It was a very successful day for the golfers and for our charity,” said Mara Smelters Wier, the organizer of the tournament.

The winning team, representing Bass Lake Roadhouse, included Graham Hatherley, Ian Hodgins, Joe Quinn and Scott Simpson. Their winning score was 64. Second place went to the Port Carling IGA team of Gary Kadanoff, Christopher Kadanoff, Bill Ferguson and Paul Fraser. Third place went to the Royal LePage team of John O’Rourke, Don Evans, Keith Edwards and Wayne Cox.

The closest-to-the-pin winner was George Edwards. Longest Drive (men) went to Scott Simpson. Longest Drive (Women) went to Barb Forrest. The Academy Shootout Winner (for the second year in a row) was Gord Adams. The winner of the Mayor’s Putting Contest was Robert Jerome.

Club Link, Muskoka Lumber, Fowler Construction, Port Carling IGA, and Red Leaves Resort were lead sponsors. The businesses were inducted onto the Mayor’s Leaderboard and received individual plaques commemorating their support of the tournament.

“Having this depth of corporate support makes a big difference in the financial success of the tournament,” noted Mayor Susan Pryke. “These business leaders have consistently supported the Mayor’s charity at the highest level possible and we are all very grateful for their generosity.”

Organizers also acknowledged the significant financial contribution of Touchstone, Scotiabank, The Apothecary Shop, Muskoka Window and Door Centre and scores of local individuals and businesses who donated to the event.

Mayor Pryke congratulated the organizing committee on a job well done. “They have to work exceptionally hard,” she said, noting that the costs and volunteer labour to stage the event are borne entirely by the charity itself. MUSKOKA LAKES WINS NATIONAL AWARD IN COMMUNITIES IN BLOOM COMPETITION

PORT CARLING: Muskoka Lakes Township - Port Carling has won first place in the National Communities in Bloom competition for the population category of 1 to 1000.

The Township was also recognized for its Environmental Stewardship of Lake Waters.

Inglis MacDonald accepted the award on behalf of Port Carling Community in Blooms Committee at Lethbridge, Alberta on September 20. Subsequently, the red granite award was presented to Township Council by the chair of the Port Carling Communities in Bloom Committee, Perry Bowker.

“This is a tremendous honour and a credit to the effort of the Communities in Bloom Committee and our parks staff,” said Mayor Pryke.

“Of course it could not have happened without the support of the volunteers and the generosity of the donors in our community — and also the leadership of senior staff and Council in championing projects to build community pride.”

This is the second time Port Carling Communities in Bloom has won first place in the national Communities in Bloom Competition. The first time was in 2002.

Communities in Bloom is a Canadian non-profit organization committed to fostering civic pride, environmental responsibility, and beautification through community involvement and the challenge of a national program.

Winter Safety • Advice on Ice

Every winter, 25 to 30 Canadians die in ice-related incidents, and countless others fall through the ice and have brushes with death. Muskoka Lakes are busy every winter with ice fishing and across-water snowmobiling. So here are a few ice safety tips that winter sports enthusiasts should keep in mind before venturing out on frozen water. Be Smart. Be Safe.

Remember the thicknesses below are merely guidelines for new clear solid ice and that many factors other than thickness can cause ice to be unsafe.

There is no such thing as 100 percent safe ice! 4" of new clear ice is the minimum thickness for travel on foot. 5" is minimum for snowmobiles and ATVs. 8"- 12" for cars or small trucks.

Check for known thin ice areas with a local resort or bait shop. Test the thickness yourself using an ice chisel, ice auger or even a cordless 1/4 inch drill with a long bit.

Refrain from driving on ice whenever possible. If you must drive a vehicle, be prepared to leave it in a hurry: keep windows down, unbuckle your seat belt and have a simple emergency plan of action you have discussed with your passengers.

Stay away from alcoholic beverages. Even "just a couple of beers" are enough to cause a careless error in judgment that could cost you your life. And contrary to common belief, alcohol actually makes you colder rather than warming you up.

Don't "overdrive" your snowmobile's headlight. At even 50 km per hour, it can take a much longer distance to stop on ice than your headlight shines. Many fatal snowmobile through-the-ice accidents occur because the machine was traveling too fast for the operator to stop when the headlamp illuminated the hole in the ice.

Wear a life vest under your winter gear, or wear one of the new flotation snowmobile suits. And it's a good idea to carry a pair of ice picks that may be home made or purchased from most well stocked sporting goods stores that cater to winter anglers. It's amazing how difficult it can be to pull yourself back onto the surface of unbroken but wet and slippery ice while wearing a snowmobile suit weighted down with 60 lbs of water. The ice picks really help pulling yourself back onto solid ice. CAUTION: Do NOT wear a flotation device when traveling across the ice in an enclosed vehicle!

Always supervise children playing on or near ice. Children playing on or near ice should always be with a buddy and under adult supervision. See other side… What should you do if a companion falls through thin ice?

1. Keep calm and think out a solution. 2. Don't run up to the hole. You'll probably break through and then there will be two victims. 3. Use some item on shore to throw or extend to the victim to pull them out of the water such as jumper cables or skis, or push a boat ahead of you. 4. If you can't rescue the victim immediately, call 911. It's amazing how many people carry cellphones. 5. Get medical assistance for the victim. People who are subjected to cold water immersion but seem fine after being rescued can suffer a potentially fatal condition called "after drop" that may occur when cold blood that is pooled in the body's extremities starts to circulate again as the victim starts to re-warm. What if YOU fall in?

Try not to panic. Instead, remain calm and turn toward the direction you came from. Place your hands and arms on the unbroken surface of the ice (here's where ice picks would come in handy.) Work forward on the ice by kicking your feet. If the ice breaks, maintain your position and slide forward again. Once you are laying on the ice, don't stand. Instead, roll away from the hole. That spreads out your weight until you are on solid ice. This sounds much easier than it is to do in reality.

The best advice is don't put yourself into needless danger by venturing out too soon or too late in the season.

Township launches innovative BizPal support for businesses

PORT CARLING: The Township of Muskoka Lakes is proud to introduce an innovative business tool for new, expanding and relocating businesses.

BizPal is an online service that simplifies the process of obtaining business permits, licences and other regulatory requirements for entrepreneurs, governments, and business service providers.

“People who are interested in starting or expanding a business simply have to answer the online questionnaire and they will receive a list of all the permits and licences they will need from the Township of Muskoka Lakes, the District of Muskoka, the Province of Ontario and the federal government,” says Mayor Susan Pryke. “It’s convenient one- stop shopping.”

Muskoka Lakes Township is the first municipality in Muskoka to partner with the federal and provincial governments to provide this service. The initiative was recommended by the Township’s Economic Development Committee, as a result of the report from the citizens’ task force on improving government processes.

MAYOR’S TOURNAMENT TO BENEFIT BLISSYMBOLICS LEARNING CENTRE

PORT CARLING: The Blissymbolics Learning Centre will be the beneficiary of the Mayor’s Golf Classic, to be held September 15, 2008. Funds raised will support an instructional program for non-speaking students to further their communication, literacy and computer skills.

“I have been a proud supporter of this organization since they opened their doors in Bala in 2002,” says Mayor Susan Pryke. “The Blissymbolics Learning Centre helps profoundly disabled, non verbal adults with Cerebral Palsy gain independence, but its presence in our community helps us all better understand the abilities and needs of persons who cannot speak.”

Ensuring the learning centre has the funds necessary to continue its good work is an ongoing challenge. “We are very grateful to the Mayor for selecting The Blissymbolics Learning Centre as the recipient of proceeds from this year’s Mayor’s Golf Classic,” says Executive Director Mara Smelters-WeIr.

Once again ClubLink Corporation has offered the Lake Joseph Club facilities in Port Sandfield for the charity event. “ClubLink has been most generous in its support of community projects,” says Pryke.

Mayor Susan Pryke extends an invitation to her annual Mayor’s Walk, held this year at Hardy Lake Provincial Park on Saturday, June 7 at 10 a.m. The three- kilometre hike will take participants along the shore of Hardy Lake. The hike is one of the most picturesque in the Township and a favourite of residents and visitors alike.

Directions: Trail parking is off Muskoka Road 169, one kilometre west of Walkers Point Road, between Gravenhurst and Bala. Hiking trails require good footwear. Walker’s should bring potable water for refreshment while on the trails.

Township of Muskoka Lakes Community Clean-up Day

April 26th, 2008 is clean-up day in Muskoka Lakes Township. Volunteers from across Muskoka Lakes will be out in force cleaning roadsides and public spaces. On the same day, tipping fees at the Eveleigh Road transfer station will be waived for one vehicle load (non-commercial) of residential rubbish per property for those residents of Muskoka Lakes Township who take the opportunity to tidy up their yards.

The Eveleigh Road landfill site will be open from 9 a.m. to 6 p.m. Saturday, April 26th. The hazardous waste depot at the transfer station will also be open from 9 a.m. until 3 p.m.

The following items will be accepted: • Residential rubbish and brush • Six tires, as long as their diameter does not exceed 16 inches • Hazardous waste (paint, batteries, cleaning solvents, etc.)

The following will not be accepted: • Shingles • Vehicles • Boats • Construction / commercial waste

Parry Sound District Update:

- Flood Warning Update issued in the evening of April 12th to municipalities and media in areas with increased flood risk at this time: Huntsville (), Town of Bracebridge (North and South Muskoka Rivers), Town of Parry Sound and Township of McDougall ()

- At this time, only the north Muskoka River (Town of Bracebridge) is of some concern for flooding in traditional flood-prone areas as flows and levels continue to moderately rise at a steady rate.

- The North Muskoka River is expected to continue rising over the next 1-2 days as the Big East River peak moves downstream into the North Muskoka River.

- The Big East River (at Williamsport gauging station) peaked at 7:00 p.m. yesterday at 94 cms and is starting to decrease. Peak will be seen this morning in flood-prone locations downstream through the Town of Huntsville. Some roads are flooding but manageable. Flooding of homes is not expected due to declining flows and levels

- Temperatures dropped to -5 degrees last night which reduced the rate of snow pack melt associated with the 35-40mm of rainfall received over the last two days. Overall, the weather forecast for the next few days (no rain, relatively cool temperatures) should reduce the rise in water levels and associated flood potential. Minus 5 degrees forecasted for tonight

- Flow through the MNR Bala Dams in lower Muskoka River watershed into the Bala Reach have continued to increase as rises. Currently at 260 cms. Some shoreline inundation is likely occurring, and will increase as Lake Muskoka levels rise.

- Most lake currently at or approaching traditional spring levels and rising within the Muskoka River watershed and areas in the south part of the district. Most other rivers and lakes are beginning to crest or drop

- Sparrow Lake (Severn River); continues to decline; down 10 cm. from yesterday - Six Mile Lake (Severn River): possibly beginning to decline- down 4 cm. from yesterday

- Black River at Vankoughnet: at 54 cms and rising steady

Summary: Looks like the potential for significant flooding has/is diminishing. We will watch the North Muskoka and South Muskoka River flows as they pass through the lower watershed over the next few days. In addition, we will monitor the Black River rise and report due to the potential for increased flooding downstream in Washago and the Severn River

- North Muskoka River: 140 cms and rising moderately (up 10 cms from yesterday morning- previous 24-hour rise was 20 cms)

- South Muskoka River:76 cms and rising moderately (up 6 cms from yesterday morning- previous 24-hour rise was 7 cms)

- It is expected that the South Muskoka River may reach flood concern level of approximately 90 cms in a couple of days (dependent on favourable weather and upstream flows)

- Mary Lake and Huntsville Lakes (Town of Huntsville) expected to rise above the normal operating range for the spring

- Lake Muskoka continues to rise as water is received from upstream rivers- will likely rise above the normal operating range in approx. 2 days

- Bala Reach will likely reach the flow concern threshold of 280 cms over the next day 1-2 days

- Buck Lake and Fox Lake (town of Huntsville) are well above the normal spring levels

- Kahshe Lake and Muldrew Lake (Town of Gravenhurst) well above normal spring levels

TREE PRESERVATION BYLAW and SITE ALTERATION BY-LAW

These by-laws are being considered as a response to a need to preserve shorelines, environmental protection areas, Scenic Corridors, and implement the Lake System Health Program.

The areas cited for protection are:

i. Shoreline buffer areas (within 50 feet of the high water mark in areas designated Waterfront, and 25 feet of the high water mark in areas designated Community or Urban Centres), ii. Lands zoned Environmental Protection (EP1) in the Township’s Comprehensive Zoning By-law, iii. Lands within Scenic Corridors as designated in the Official Plan and Zoned as such in the Comprehensive Zoning By-law.

The area proposed to be regulated includes the area between 50 feet and 200 feet of a navigable waterway in the areas designated as Waterfront in the Official Plan.

Numerous exemptions to the by-law are proposed: damaged or dangerous trees, tree plantations, where site plans and building permits have been approved, pits and quarries.

This paper contains an overview of the various potential options for selection of the Muskoka District Chair, the obtaining of public input with respect to the matter and related issues such as voting by the Chair.. It does not contain any specific legal advice and as such, is not subject to solicitor client privilege and, therefore, is a public document.

ANALYSIS

Throughout this paper, a number of terms have been used to ensure that full consideration can be given to this matter. For example, the basic issue is the method of selecting the Chair of the Muskoka District Council. Selection mayor may not involve an election and that election mayor may not include voting by the general public. This paper identifies two methods of selection, each of which may have pros and cons associated with them .. It is hoped that by identifying the selection techniques, full consideration can be given to each.

B. Historical Background

Over the years, there have been changes to the methods of selecting the Chair. Three of the most recent approaches are as follows:

(a) Prior to 1992 (copy of relevant sections of The District Municipality of Muskoka Act, RS.O .. 1990, cD.14 included in Appendix 1), the Chair was selected by way of an election by the mayors elect and members elect of the Muskoka District Council at a special meeting in advance of the first meeting of Council. At this special meeting the members elect and mayors elect would receive nominations and vote .. Various procedural issues were addressed in both The District Municipality of Muskoka Act and the Muskoka District Council procedure by-law ..

(b) In 1992, the situation changed with the Municipal Statute Law Amendment Act, 1992 S.O. 1992, c.15. At the time, the special meeting was discontinued and the election was to be held as the first item of business of the first meeting of Council (copy of statutory extract included with Appendix 1) ..

(c) As of January 1,2003, the Municipal Act, 2001 came into force. Under section 233 (2) of that Act (copies of relevant sections included as Appendix 2), the Chair is to be selected by way of an appointment process at the first meeting of Council. Appointment by secret ballot also became permitted .. Various procedural aspects are addressed by the Municipal Act, 2001 and the Council Procedure by-law.

Section 458 (copy included in Appendix 2) of the Municipal Act, 2001 must be noted. It states:

"On January 1, 2003, the composition of the council of a municipality, the method of electing or appointing its members, the number of votes given to each member and the titles of its members shall be the same as they were on December 31,2002."

Section 233, being more specific, would govern over the more general section 458. Note in this regard that section 233 does not make any references to "except where otherwise provided".

Accordingly, between 1990 and the present, the following important changes have occurred: /

(1) there has been a subtle change in the selection methodology from "election" to "appointment";

(2) the selection now takes place at the first meeting of Council as opposed to a special meeting in advance; and

(3) a secret ballot is permitted (but not obligatory) (section 233 (5». To date Muskoka District Council has employed the open voting method ..

C.. Voting Rights of Chair

Also, with the advent of the Municipal Act, 2001 some confusion has developed regarding the voting rights of the Chair. Section 11 (3) of the former The District Municipality of Muskoka Act provided that the person presiding at Council meetings (either the Chair or the Acting Chair), had a vote only in the event of a tie .. Section 243 of the Municipal Act, 2001 now provides that except where otherwise provided, every member of council shall have one vote.. Copies of these provisions are included in Appendix 3. The confusion arises as a result of section 458 which refers to number of votes before the Municipal Act, 2001 came into force, but does not refer to when those votes may be exercisable It is recommended that as part of this review, steps be taken to fully clarify the situation

D. Options for Selection of Chai~

The options include, but are not limited to: Page 3

(1) maintain the current Council appointment method of selecting the Chair and the status quo on all related issues; or

(2) maintain the current Council appointment method, but proceed by way of secret voting on the appointment resolution .. This option is presently available under section 233 (5) of the Municipal Act, 2001.. Only an amendment to the Council procedure by-law would be required to implement this option; or

(3) selection by general vote at large as part of regular municipal elections.. If this option is the preferred selection methodology, legislative action will be required to implement the option. The two methods of legislative action available to implement this option are described later in this paper ..

E.. Methods of Securing Public Input

Given that option D (3) would require legislative action by the Province, it is recommended that some formal public consultation process be undertaken .. An absence of such consultation process prior to any request for legislative action would not only open the door to criticism on the basis of a failure to meet the standards of openness and transparency, the Province, in any event, may require evidence of such consultation prior to consideration of legislative action

There is substantial time available until the next general municipal election and Council may wish to consider the following approach::

(1) formally accept this paper and table it to provide Council members and other interested parties with a period of time to consider the issues and make such inquiries as they deem appropriate;

(2) schedule a date on which a presentation may be made in public to review the options detailed and address any non-legal questions. Notice of such a meeting may be posted on Muskoka's website or perhaps in newspapers;

(3) formal public meetings to gather input from the public may be considered;

(4) once the public consultation phase has been completed, Council will have to con~ider options .. Council may wish to consider a referendum .. Included in AppendiX 4 are copies of sections 8 and 8.1 to 8 .. 3 of the Municipal Elections Act, 1996, which is the legislation applicable to municipal referendums;

(5) if Council determines that a referendum is desirable, the earliest possible date for any such referendum is the next general election ..

Sections 8 .. 1 (2) and 8.2 (1) of the Municipal Elections Act, 1996 should be noted. They state:

"8.1 (2) A question authorized by by-law under clause 8 (1) (b) shall com ply with the following rules:

1.. It shall concern a matter within the jurisdiction of the municipality. 2.. Despite rule 1, it shall not concern a matter which has been prescribed by the Minister as a matter of provincial interest. 3. It shall be clear, concise and neutral. 4.. It shall be capable of being answered in the affirmative or the negative and the only permitted answers to the question are "yes" or "no" .. Page 4

8.2 (1) The results of a question authorized by a by-law under clause 8 (1 )(b) are binding on the municipality which passed the by-law if,

(a) at least 50 per cent of the eligible electors in the municipality vote on the question; and (b) more than 50 per cent of the votes on the question are in favour of those results."

Given the requirements and the second option regarding legislative action detailed in section H of this paper, any referendum question must be kept clear, concise and neutral and be capable of being answered "yes" or "no", such as:

"Should the Muskoka District Council Chair be selected by general vote at each regular municipal election?"

F. The Two Basic Selection Method Options

As noted above, there are two basic selection options:

(i) current selection by Council appointment; or

(ii) election by general vote ..

Attached as Appendix 5 is a review of the approaches presently in place in other municipalities across the Province ..

G. Election Issues - Process and Procedures

In any two tier system, there are various practical issues associated with running elections that would arise. Presently, all candidates for Muskoka District Council are also candidates for Area Councils as well. Accordingly, the Area Clerks are responsible for administering the elections

In the event that the Chair is to be selected by general vote, the following issues, amongst others, arise:

(i) who would candidates for District Chair be required to file nomination papers with?

(ii) which council(s) would set the rules application to the election?

(iii) accountability issues? (e.g. who would certify election expenses and reporting, etc .. )

A comparison may be found in the Education Act with respect to trustees. Under that Act, the municipal election process is used with a variety of modifications ..

H. Options for Legislative Action

If it is determined that the preferred method of selecting the Chair is by way of general vote, there are two options for implementing changes from the current method: Page 5

(i) Legislative Action ODtion 1.

The first option is to request specific legislation from the Province. The Regional Municipality of Waterloo used this approach in 2000 when it moved to a direct election system .. A copy of the Waterloo legislation is included as Appendix 6 .. Section 6.1 of that legislation illustrates an approach for addressing some of the issues noted in Section G of this paper.. If this method is preferred and the Province agrees, the legislation could be effective for the next general election .. Key steps in this method would be:

(i) formal request by Muskoka to amend the Municipal Act, 2001 ; (ii) Province would likely require some indication that there is at least some majority of Area Councils in support; (iii) evidence of public consultation; and (iv) the support of Muskoka's MPP would be required to sponsor the amending legislation; or

(ii) Legislative Action Option 2

The second option is to proceed under section 218 of the Municipal Act, 2001 (copy of sections 218 and 219 included as Appendix 7) which, subject to an appropriate regulation being in place, permits a limited number of changes to be made by by-law of the municipality. Of particular note is item 2 of section 218 (1) and section 218 (2) (b) which state:

"218(1) Without limiting sections 9, 10 and 11, those sections authorize an upper-tier municipality to change the composition of its council subject to the following rules:

2. The head of council shall be elected by general vote, in accordance with the Municipal Elections Act, 1996, or shall be appointed by the members of council.

218 (2) (b) Without limiting sections 9, 10 and 11, the power to change the composition of council includes the power to,

(b) change the method of selecting members of the council, including having members directly elected to the upper-tier council and not to the council of a lower-tier municipality, members elected to serve on both the upper-tier and lower-tier councils or members elected to the lower-tier councils and appointed to the upper-tier council by the lower-tier municipalities, or a combination of methods of election .. "

The combined effect of these provisions is that, subject to conditions and various processes, changing to selection of the Chair by general vote may be made by by-law..

Also of note is section 218 (5) which states:

"A regional municipality shall not pass a by-law described in this section unless the Minister has, by regulation, authorized th·e regional municipality to exercise the powers described in this section .. " Page 6

Section 1 of the Municipal Act, 2001 defines "regional municipality" as including a district municipality. Accordingly, a pre-condition to any by-law under this section would be a Ministerial regulation. The key steps in this method would be:

(i) request Ministerial regulation under section 218 (5); (ii) give notice of intention to pass a by-law and hold public meeting under section 219 (2); (iii) pass by-law; (iv) confirm whether the voting with respect to the by-law meets the requirements. In this regard, section 219 (2) states: "A by-law described in section 218 making changes described in clauses 218 (2) (a), (b) and (c) or in subsection 218 (3) is not valid unless,

(a) a majority of all votes on the upper-tier council are cast in its favour; (b) a majority of the councils of all lower-tier municipalities forming part of the upper­ tier municipality have passed resolutions consenting to the by-law; and (c) the total number of electors in the lower-tier municipalities that have passed resolutions referred to in clause (b) form a majority of all the electors in the upper-tier municipality .. " (v) timing is addressed in sections 219 (3) and (4) and depends on when the by-law to implement the changes was passed .. If the by-law is passed on or after January 1st of a year in which a regular election is being held, the by-law is not effective until the next election .. Otherwise, it is effective for the next regular election after date of passage.

This paper has outlined the options available to Council for the important task of selecting the District Chair. Following due and careful consideration of this matter by Council, staff will respectfully implement whatever directive is determined by Council ..

"'arne ill Without limiting subsection (1), the municipality shall, between 14 and 180 ~ays after voting day, (a) ifa by-law or resolution is required to implement the results ofthe question, ensure that it is prepared and placed before councilor, ifa series ofby-laws are required to implement the results, ensure that the first ofthe series is prepared and placed before council; (b) despite clause (a), ifpassage ofa by-law or resolution required to implement the results ofthe question is subject to a condition precedent under a regulation or statute (such as giving notice or holding a public hearing), ensure the initial steps have been taken to comply with the condition; (c) ifadministrative action to change a policy or practice is required to implement the results of the question, instruct municipal staffto take that action. 2000, c. 5, s. 28. Limitation CD For the purpose ofclause (1) (a), it is not within the jurisdiction ofthe municipality to eliminate or ovenide any substantive or procedural legal right ofany person or entity who is or may be affected by the implementation ofthe results ofthe question as illustrated by the following examples: 1. Ifa zoning change under the Planning Act is necessary to implement the results, the binding effect ofthe question is subject to the Planning Act and the discretion ofthe municipality under that Act is not constrained. Ifthe zoning change is approved, the municipality is bound to implement the results; ifit is not approved, the municipality is not bound. 2. Ifthe results ofthe question require the passage ofa by-law which requires notice to be given and at least one public meeting to be held to consider the matter before the by-law is passed, the binding effect ofthe question is subject to these procedural requirements and the discretion ofthe municipality to proceed following the public meeting is not constrained. If, after the public meeting, the municipality decides not to implement the results ofthe question, it is not required to do so. 2000, c. 5, s. 28. Order ill A court presiding over a proceeding in respect ofa recount, an offence under this Act or a proceeding under section 83 (controverted elections) may make an order temporarily staying the requirement ofa municipality to implement the results ofa question under this Act ifsatisfied that the requirement may be directly or indirectly affected by the proceeding. 2000, c. 5, s. 28. • Take a class tour of the municipal office • Attend a committee meeting • Be Mayor, Committee Chair, or Councillor for the Day

Class Tours: Tours of our municipal office would provide students the opportunity to learn about the function of the various departments: Planning, Clerk, Treasury, Fire, Public Works, Parks and Recreation, Building, the CAO’s Office, and the Mayor’s Office. Class tours will be booked for the afternoons of Monday, Tuesday, and Thursday that week. Classes of all ages, from primary through to senior grades, would be welcome.

Attend a Committee Meeting: Committee meetings are held on Wednesday morning (Management and Services), Wednesday afternoon (Parks and Recreation) and Thursday morning (Planning). Given space limitations, requests to attend a committee meeting will be extended to the first three classes who apply. This opportunity is best suited to junior and senior grades.

TOWNSHIP OF MUSKOKA LAKES PARKING AND SNOW REMOVAL

Citizens are reminded that Section 170 (12) of the Highway Traffic Act prohibits the parking or standing vehicles on any road or street when it will interfere with the clearing of snow or ice.

Vehicles may be towed and stored by the municipality and all costs for removing, care and storage become a lien upon the vehicles.

The Highway Traffic Act prohibits any person from depositing snow or ice upon a public street or road. This would include the placing of snow on roads to accommodate snowmobile or skiing activities.

Mayor’s Walk

Join Mayor Susan Pryke On Saturday, June 7, 2008 At 10:00 a.m. at Hardy Lake Provincial Park For the Annual Mayor’s Walk

Mayor Susan Pryke extends an invitation to her annual Mayor’s Walk, held this year at Hardy Lake Provincial Park on Saturday, June 7 at 10 a.m. The three- kilometre hike will take participants along the shore of Hardy Lake. The hike is one of the most picturesque in the Township and a favourite of residents and visitors alike.

Directions: Trail parking is off Muskoka Road 169, one kilometre west of Walkers Point Road, between Gravenhurst and Bala. Hiking trails require good footwear. Walker’s should bring potable water for refreshment while on the trails.
