At its second meeting of the Ad hoc Technical Expert Group on Farmers’ Rights (AHTEG), the Expert Group agreed on a revised version of the template for collecting information on examples of national measures, best practices and lessons learned from the realization of Farmers’ Rights

This document presents the updated information on best practices and measures of implementing Article 9 of the International Treaty submitted by on 31 July 2019.

The submission is presented in the form and language in which it was received.

INTRODUCTORY

As stated under Article 9 (Art. 9) of the International Treaty of Plant Genetic Resources for Food and Agriculture (ITPGRFA), Contracting Parties are obliged to recognize the enormous contribution that the local and indigenous communities and farmers have made sustainably conservation and development of the plant genetic resources for food and agriculture (PGRFA) over time and generation (Art. 9.1). More over, Contracting Parties are responsible to protect the traditional knowledge relevant to PGRFA (Art. 9.2a), realizing farmers’ right to equitably participate in sharing benefits arising from the utilization of PGRFA (Art. 9.2b), and farmers’ right to pasrticipate in making decisions, at the national level, on matters related to the conservation and sustainable use of PGRFA. However, nothing in this Article shall be interpreted to limit any rights that farmers have to save, use, exchange, and sell farm-saved seed/propagating material, subject to national law and as appropriate. Considering the urgent needs to realize the implementation of Farmers’ Right around the world, a group of expert was established in the last session of Government Body (GB-7) in Kigali, Rwanda on 2017, namely Ad Hoc Technical Expert Group on Farmers’ Right (AHTEG-FR). The mandate of the the Expert Group was to produce an inventory of national measures and to develop options for encouraging, guiding, and promoting the realization of Farmers’ Right, as consideration for the Governing Body. This group has been conduct two times meeting, i.e. on 11-14 September 2018 and 20-23 May 2019, and from these meetings, there have been produced document IT/GB-8/AHTEG- 2/19/3, IT/GB-8/AHTEG-2/19/3Add.1, and IT/GB-8/AHTEG-2/19/4. These documents are rolling document and should be configured in a manner that would allow for the inclusion of new information and possible updates. Therefore, the Expert Group further requested for the Secretary to accept new submissions and that only submissions received by 31 July 2019 will be included in the updated version of the draft Inventory. In accordance with that, at the national level, National Focal Point of ITPGRFA in Indonesia, i.e. Indonesian Center for Agricultural Biotechnology and Genetic Resources Research and Development (ICABIOGRAD)-Indonesian Agency for Agricultural Reserch and Development (IAARD) under Ministry of Agriculture has organized a national workshop in term of raising awareness of the global position of Multilateral Systems, and inventory of the implementation of Farmers’ Right from the national stakeholders. The workshop was held on 17 July 2019 in , West and attended by 44 participants from various institutions/organizations, i.e. Ministry of Agriculture, Ministry of Environment and Forestry, University, NGO, and Indonesian Institute of Sciences. From this workshop, participants agreed to contribute for the updating information of the implementation of Farmers’ Right and to date there have been 12 stakeholders participated as contributor for realization of Farmers’ Right of this report, i.e. 1) Center for Plant Variety Protection and Agricultural Permits, 2) Directorate General of Food Crops, 3) Directorate General of Estate Crops, 4) Directorate General of Intelectual Property, 5) National Commission on Genetic Resources, 6) Indonesian Center for Horticulture Research and Development, 7) Indonesian Center for Agricultural Biotechnology and Genetic Resources Research and Development, 8) Indonesian Center for Rice Research, 9) Bogor Agricultural University, 10) , 11) Indonesian Biodiversity Foundation, and 12) Serikat Petani Indonesia. This report contains of two main sections, i.e. Section A for the table summary of the inventory of measures/practices of Farmers’ Right in Indonesia, informing a short description and type of measures/practices, which are provision under Article 9 in which the measures/practices have been addressed. Details of each measures/practices may be found under Section B, which informs the history, geographical outreach, number(s) of farmer(s)/communities involved, impact of the measures/practices, and lesson learned gain from the activity that can be reffered by other stakeholders/contracting parties.

Category 1. Recognition of local and indigenous communities’, farmers’ contributions to conservation and sustainable use of PGRFA, such as awards and recognition of custodian/guardian farmers 1 √ Award for breeder Awarding awards to breeder farmers is part of a series of Indonesia - √ farmers who contribute awards in various fields. This activity aimed to promote crop diversity in Indonesia, particularly the local variety. Kind of crop selected to be contested in this event on 2018 was banana since this crop was available in every place in Indonesia. For the next event (2020), there will be selected another crop for the contest. Through this event, the superior local genetic resources were expected to be widelyknown by public, thus the region where the crop originated can gain economic benefits from the use and promotion of genetic resources.

Through this program, farmers have opportunity to produce and sell seed to other farmers. Most of the seed developed by the farmer was local variety and the seed was produce by breeder farmers.

local farmer as the main actor (participatory varietal selection) as well as the main stakeholder that benefit from the produced varieties. Through this approach, farmer has more right to select the specific varieties to be developed. Along with the strength of their traditional knowledge that is passed down from generation to generation, farmers are proven to accelerate the varieties selection to be highly adaptive to the local agro-ecological conditions.  Training and mentoring program on the selection of parental line based on local variety, crossing and selection technique based on plant breeding rules.  Output : genetic material of F1- F2 from crossing activities by the farmer 2) Until 2009, the farmer continued to do selection activity independently by using positive mass selection method. The best performance of line was selected and then planted in bulk in the following season, and so forth until F12 generation. 5) During the rainy season of 2011, yield observation for those lines above and 2 varieties as control at three villages (Wanguk, Bango Dua and Cijengkok) have been done and guided by the researchers of ICRR.

6) In 2012, IPPHTI which is facilitated by FIELD has officialy proposed participation in the rice consortium program of ICRR on multilocation test activities for high yield potential lines and resistant to major pests and diseases. The lines used in multilocation test are Gadis Indramayu and Pemuda Idaman. Multilocation test activities of the consortium were fully facilitated by ICRR, in which one of location used belong IPPHTI member.

17 √ Releasing local variety Sugar palm is originating from Indonesia and become one of Indonesia √ of sugarpalm and early the main daily income for farmers in particular areas in detection of its maturity Indonesia. As a lesson learned of special case, one of superiol loal variety (sugarpalm) that has been released by local government, is accompanied by a decree (Ministreal Decree) of selected parental trees and blocks to allow farmers to produce seeds with high quality and have superior sugar palm collection. This is important for commercialization, in case farmers/local communities want to produce seeds and distribute in commercial way either in their region or outside the area. The most early maturing sugarpalm flower at last 4 years after planting and other type must be waited till 10 years leter. To help farmers, for around 3 years researchers from IAARD collaborated with local governments which have sugar palm population in their region to establish an early detection kit to identify sugar palm maturity on the seedling phase. The kit will be useful to help farmers to identify sugar palm seedling before growing according to their own interested type, therefore, with this asisted technology will save time, low cost and high economic. For socialization this technology, researchers from ICABIOGRAD-IAARD, other stake holders and local government will do assistance how to select sugar palm in early phase with no cost for farmers. exploration or breeding activity as well as the network for distributing the seed widely, the SCD concluded an exemption for smallholder farmer in order to have more right to save, use, exchange, and sell farm-saved seed and other propagating material only for their farmer community. They also now have more right to do crops breeding by themselves and government should provide the necessary assistance (i.e. assistance of Participatory Plant Breeding (PPB)). This activity aimed to promote the crop diversity of local variety in Indonesia. Banana was selected to be contested in this event since this crop is available in every place in Indonesia. For the next event (2020), there will be selected another crop species for the contest. Through this event, the superior local genetic resources were expected to be widelyknown by public, thus the region where the crop originated can gain economic benefits from the use and promotion of genetic resources. • Brief history : The first G-Difa was held in 2018 in conjuction with the 7th National Congress of Genetic Resources. Banana fruit was selected tp be contested in this event considering its wider plantation in Indonesia. There have been 9 regions/provinces participated in the event, and total 14 local varieties of banana were competed each other. • Core components of the : Every province through its Regional Commission on Genetic measure/practice Resources proposed one or more local varieties of banana originated from their region. Around 34,000 of local varieties/landraces were inventoried, recorded, and some of them were collected and conserved in the ex-situ conservation facilities in ICABIOGRAD. From 2-3 years ago, some of those varieties that may have economic value or the potential to be developed/improved are registered for PVP (around 350 varieties) and some of them are released as local superior varieties. This achievement was not only done by researchers from the research institutes or government representatives like AIAT, but also involved local farmers as the main actors in participatory varietal selection, as well as the main stakeholder that benefit from the produced varieties. Through this approach, farmer has more say in selecting the specific varieties to be developed. Due to the strength of their traditional knowledge that is passed down from generation to generation, farmers accelerated the selection of varieties that are highly adaptive to the local agro- ecological conditions. LESSONS LEARNED • Describe lesson learned : Conservation programs should be able to cover the upstream to which may be relevant for downstream processes. • Brief history : Indonesian Biodiversity Foundation supports the preservation and utilization of various local foods for arid regions in eastern Indonesia. The program's focus is on re-utilizing neglected and underutilized crops such as barley, millet, sago, sorghum, taro, and tubers. By utilizing these local foods, Indonesian Biodiversity Foundation believes that food security will be achieved, while genetic resources will be maintained. By returning to preserve and conserve local food, the type of biodiversity will be maintained and can be utilized as a source of income to improve the economy of farmer families. In East Nusa Tenggara, the area which consists mainly of dry land is one of Indonesian Biodiversity Foundation's interventions in utilizing community-based local food sources, especially sorghum specific in dryland areas. Since 2013 till now, the program is still focused on Flores Island starting from West Manggarai to East Flores and surrounding small islands such as Adonara, Solor and Lembata. The people lived in East Nusa Tenggara basically have a tradition of consuming food sources of carbohydrates other than rice including sorghum for cultivation. In fact, in Nggela, Ende Regency, there was a special ceremony for Nggoa lolo, namely the sorghum ceremony. However, along with the food policy, the people increasingly abandone their food patterns and switched consumption to rice. Along with these conditions, the local wisdom of local culture through ceremonial rituals before planting to harvest to indicate an "appreciation" of food sources is increasingly lost. Why Food Diversification Is Important 1. The availability of potential diversity of food spreading throughout Indonesia can be used as food in accordance with the natural and cultural conditions of the local community. 2. Advantages of Sorghum on Dry Land in East Nusa Tenggara Sorghum bicolor Sp (Sorghum spp.) is a multi-functional plant with many advantages and benefits as well as high adaptive properties. In Indonesia, this plant is commonly found in Java, East Nusa Tenggara, and West Nusa Tenggara, especially in dry and marginal lands. Sorghum which was grown in areas such as Central Java (Cantel), East Nusa Tenggara (Pena Mina, solor corn, mesak, Watablolo / lolo / Corn Rote / Terae / Penbuka / Wataru) began to diminish and slowly disappeared due to this plant no longer planted and utilized, land conversion, and policies and other causes. As an example is sorghum was commonly planted in intercropping and used as a food source for the community in past.

Sorghum is a source of carbohydrates that has nutritional value not inferior to rice and corn. In fact, sorghum is very potential to replace flour which is still imported until now. Some areas in Flores are dry land (rock land). The East Nusa Tenggara region has always been at risk of experiencing food insecurity, while on the other hand the availability of local food sources of sorghum has begun to be abandoned by the community (the tradition of Lamaholot, Lio). Advantages of Sorghum: 1. Sorghum is easily cultivated and needs low oparational cost. 2. Adaptive in all land with good nutrients or marginal land. 3. Sorghum can be harvested more than once in one planting period. 4. Sorghum need low water input. 5. Sorghum is usually resistant to pests and low fertilizer input. 6. In addition to food, it can be used as bioethanol, feed, etc. 7. It is Healthy, highly nutritious food accompanied by high protein content and gluten free 8. Smulen ST1 has been released by local government, is accompanied by a decree (Ministreal Decree in 2018) of selected parental trees and blocks to allow farmers to produce seeds with high quality and have superior sugar palm collection. This is important for commercialization, in case farmers/local communities want to produce seeds and distribute in commercial way either in their region or outside the area. IAARD collaborated with local governments which have sugar palm population in their region to establish an early detection kit to identify sugar palm maturity on the seedling phase. The kit will be useful to help farmers to identify sugar palm seedling before growing according to their own interested type, therefore, with this asisted technology will save time, low cost and high economic. For socialization this technology, researchers from ICABIOGRAD-IAARD, other stake holders and local government will do assistance how to select sugar palm in early phase with no cost for farmers. Overall, farmers have right to determine their own interest to increase their income. • Brief history : Sugar palm is originating from Indonesia and become one of the main daily income for farmers in particular areas in Indonesia. Bengkulu is on one center for sugar palm production since last centuries and the cultivationof this plant become the main income of some local people/farmers in this area intercropping with coffee. A semi tall sugar palm, Smulen ST1 is preferable cultivated by farmers in

Bengkulu to increase their income. The most early maturing sugarpalm flower at last 4 years after planting and other type must be waited till 10 years leter. To help farmers, for around 3 years researchers from IAARD collaborated with local governments which have sugar palm population in their region to establish an early detection kit to identify sugar palm maturity on the seedling phase. DESCRIPTION OF THE EXAMPLE MANDATORY INFORMATION • Short summary of the : The Declaration of Peasant Rights came from people working in rural measure/practice areas in Indonesia. The initiation began in 2011 when Serikat Petani Indonesia and other farmer organizations organized a national conference in Cibubur. Serikat Petani Indonesia with help of La Via Campesina (the International Farmers Organization) brought the declaration to international level in order to be officially recognized. The declaration stated the right of proper living, land, seed, biodiversity, and the principle not to discriminate women who is working in the rural areas and agriculture sector. Farmer Rights in article 9 of ITPGRFA is a mandate for Contracting Parties which must be immediately implemented at the national level and become a reference that implementation must refers to the farmer seed system. This effort can pursued by applying international instruments existing ones, such as UN-DROP and improve the implementation of national regulations. • Brief history : • Core components of the : The Declaration of Peasant Rights can be used to detain agricultural measure/practice land-substitution and for the country, it can be used as human right standard at the national level. It can also be used to strengthen other laws that support the rights of farmers. • Description of the context : The Declaration of Peasant Rights was attended by 174 UN member and the history of the states, among these, 117 countries agreed, 50 abstentions, and 7 measure/practice is taking countries refused. Rejection and abstention occurred because some place countries did not agree on food sovereignty, rights to land, seeds,
