Livestock Notice to Purchasers

Health & Safety - Kivells accept no liability for any damage or injury to persons, livestock, vehicles or plant not arising out of their negligence. Any person entering the livestock market premises does so at their own risk and must comply with the requirements of any Health and Safety notices. All persons entering the livestock markets premises are hereby given notice that there are potential hazards due to the type, penning, herding, loading and unloading of livestock and vehicle movement. Caution should be exercised and children must be fully supervised at all times. Kivells reserve the right to refuse admission to any person or vehicle into the livestock market premises without giving reason. Kivells strongly advise that no persons access the sale ring, pennage or livestock passageways during the sale or whilst animals are being moved through passageways. Should any person decide to enter these aforementioned areas they do so entirely at their own risk. Any incidents or accidents in the livestock market premises should be reported to Kivells market office immediately. Biosecurity and Livestock Welfare - All persons entering Kivells livestock market premises must comply with all current Biosecurity legislation, rules and conditions. All persons should be in clean clothing and disinfect footwear upon entry and exit from the livestock market premises. Hand wash facilities, disinfectant boot dips and brushes are available and should be used. Vehicles used to transport animals to or from the livestock market premises must comply with current cleaning and disinfection legislation. All vendors, purchasers, agents and hauliers must comply with all current legislation governing the welfare of livestock whilst at Kivells livestock market premises or in transport to or from the livestock market premises. Any concerns over Biosecurity and Animal Welfare should be reported to Kivells Biosecurity and Animal Welfare officers, whose details are located in the Kivells market office. Registration - In order to bid, all new Buyers are required to register before the auction, at the Kivells market office or as otherwise advised by the Auctioneers. All such Buyers will be asked for two forms of identification and a credit reference will be required. Acceptable identification includes Driving Licence/Passport together with a Utility Bill/Proof of Address/Business Letter Heading/Business Card. The Auctioneers reserve the right to request a deposit ahead of any purchase or during sale proceedings and to refuse registration or any bid or bidder without giving reason. New Buyers are strongly advised to contact the Auctioneers well in advance of the sale. Payment - All Lots must be paid for on the day of the Sale by the Buyer prior to any removal or consolidation, unless alternative arrangements have been agreed with the Auctioneers. At the fall of the hammer the highest bidder will be deemed to be the Buyer and transfers of purchases will only be permitted with prior approval from the Auctioneers. Any payment is to be by a means approved by the Auctioneers. Our preferred payment terms are debit card or cash and Kivells reserve the right to stipulate payment by these methods. Kivells may also accept bank transfers and cheques with prior approval. Our Bank Account details are: Sort Code 56-00-49 Account Number 32376359. Payment in Cash - In order to comply with money laundering regulations we cannot accept Cash payments above the maximum permitted at the time of sale. The maximum varies according to exchange rates and currently it is circa £9,000. Buyers are advised to check with the Auctioneers ahead of the sale.

Conditions of Sale - It is strongly recommended that Bidders and Buyers visit Kivells.com and read the full Conditions of Sale produced by the Livestock Auctioneers Association (LAA) ahead of the sale. Unless advised otherwise you will be bidding and buying under these Conditions and you will be obligated to abide by these Conditions and these Notice to Purchasers. The LAA Conditions of Sale are also displayed in Kivells market office. Clauses 12 to 19 inclusive relate mainly to the Purchaser. This catalogue may also contain reference to Warranties as defined by the LAA Conditions of Sale. Warranty issues will not be considered if payment in full has not been received. Risk - All livestock are at the risk of the Vendor before they are sold and at the risk of the Buyer when they are sold (fall of the hammer). It is strongly advised that Vendors and Buyers ensure that their insurance policies cover livestock at market premises and that Buyers have immediate cover for animals purchased. Removal of Lots - Lots can only be removed once payment has been made in full and/or a pass issued by the Auctioneers. All Lots need to be cleared from the sale premises by 5pm on the day of sale unless otherwise agreed with the Auctioneers. Descriptions of Lots - Buyers should satisfy themselves prior to making bids as to the condition of any Lot and should rely on their own judgement as to whether the Lot accords with its description. All Lots are sold under the Livestock Auctioneers Association Conditions of Sale as referred to above to include the following two clauses: Statements of Fact - Unless otherwise announced all statements of fact made in any sale catalogue or at the time of sale regarding the breeding of any animal, its health status or other tests carried out on any animal are statements of fact made by the Vendor and not the Auctioneer and the Auctioneer accepts no responsibility for any misstatement nor does he nor the Vendor accept any responsibility for any subsequent reaction by an animal sold to any relevant test administered after the sale. Liability of The Auctioneer - The Auctioneer acts in all respects only as agent for the Vendor and no warranty is given by the Auctioneer or his employees or contractors, and none shall be implied, as to title, description or the quality of any Lot. Neither the Auctioneer nor his employees or contractors shall be liable to the Purchaser in any respect for any defect of title, error of description or imperfection or for any announcement or statement concerning any Lot offered for sale whether made orally or in writing (whether in a sale catalogue, order of sale, advertisement for the sale or otherwise) and whether given before, during or after the sale, nor shall he incur any liability in relation to any dispute between a Vendor and Purchaser. EXPLANATORY NOTES FOR CATALOGUES

Only British Charolais BREEDPLAN EBVs can be validly compared between Charolais herds. ESTIMATED BREEDING VALUES (EBVS) The EBV is the best estimate of an animal's genetic merit for that trait. ACCURACY An accuracy value (Acc) is presented with every EBV and gives an indication of the amount of information that has been used in the calculation of that EBV. The higher the accuracy the lower the likelihood of change in the animal's EBV as more information is analysed for that animal or its relatives. CALVING EASE Calving Ease EBVs are based on calving difficulty scores, birth weights and gestation length information. More positive EBVs are favourable and indicate easier calving. DIR: Direct calving ease indicates how this animal influences the birth of its progeny. Using a bull in the Top 1% for CE direct (+16.3) is predicted to result in approximately 15% fewer assisted calvings in 2 year old heifers compared with using a bull in the Bottom 1% (-15.5). This range is predicted to be smaller in cows. Remember that the dam’s genetics and management are significant factors influencing calving ease in any mating. DTRS: Daughter’s calving ease indicates how well the animal produces daughters that have easier calving. BIRTH AND FERTILITY GL: Gestation Length EBV (days) is based on AI records. Lower (negative) GL EBVs indicate shorter gestation lengths which generally relate to easier calving and increased growth after birth. BWT: Birth Weight EBV (kg) is based on the measured birth weight of animals, adjusted for dam age. The lower the value the lighter the calf at birth and the lower the likelihood of a difficult birth. This is particularly important when selecting sires for use over heifers. SS: Scrotal Size EBV (cm) is an indicator of male fertility in regards to semen quality and quantity. Higher (positive) EBVs indicate higher fertility. There is also a small negative correlation with age of puberty in female progeny. GROWTH MILK: 200-Day Milk EBV (kg) is an estimate of an animal's milking ability. For sires, this EBV is indicative of their daughter’s milking ability as it affects the 200-day weight of their calves. 200: 200-Day Growth EBV (kg) is calculated from the weight of animals taken between 80 and 300 days of age. Values are adjusted to 200 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth to early ages. 400: 400-Day Weight EBV (kg) is calculated from the weight of progeny taken between 301 and 500 days of age, adjusted to 400 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for yearling weight. 600: 600-Day Weight EBV (kg) is calculated from the weight of progeny taken between 501 and 900 days of age, adjusted to 600 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth beyond yearling age. MWT: Mature Cow Weight EBV (kg) is an estimate of the genetic difference in cow weight at 5 years of age. Moderate or larger EBVs are generally more favourable. CARCASE EMA: Eye Muscle Area EBV (cm2) estimates genetic differences in eye muscle area of a 300kg dressed carcase. More positive EBVs indicate better muscling on animals. FAT: Rib Fat EBV (mm) estimates the genetic differences in fat depth at the rib in a 300kg dressed carcase. More positive EBVs indicate more subcutaneous fat and earlier maturity. RBY%: Retail Beef Yield Percent EBV (%) represents total (boned out) meat yield as a percentage of a 300kg dressed carcase. A more positive EBV indicates higher percentage yield for the 300kg carcase size. IMF%: Intra-muscular Fat Percent EBV (%) is an estimate of the genetic difference in the percentage of intra-muscular fat at the 12/13th rib site in a 300kg carcase. Depending on market targets, larger more positive values are generally more favourable. TERMINAL INDEX The BCCS Terminal index is aimed at a commercial herd using Charolais bulls over large framed, mixed breed cows to breed steers and heifers to finish at 18 months of age. All progeny are destined for slaughter and no replacement females are selected from within the herd. There is some emphasis on calving ease while finishing steers at around 680 kg live weight (375 kg carcase weight) using a pasture based production system supplemented with extra rations during the finishing phase. Use this index in a commercial herd to produce progeny for slaughter. The index has moderate emphasis on easier calving (i.e. getting a live calf with minimal human interference) while producing calves that will then grow quickly to market specifications at around 18 months of age. The index is focused on slaughter animals and does not account for maternal traits and is therefore not suited to breeding replacement females. If you are using smaller framed cows or heifers in your herd, then you should also put extra emphasis on a higher calving ease direct EBV when selecting a sire using this index. SELF REPLACING INDEX The BCCS Self Replacing index is aimed at a Charolais herd breeding steers to finish at 16 months of age. Replacement females are selected from within the herd. There is some emphasis on calving ease and maternal traits while finishing steers for slaughter at around 680kg live weight (375kg carcase weight) using a pasture based production system. This Self Replacing index is also suitable to using Charolais sires over mixed breed cows where replacement females are sourced from within the herd. There may be some hybrid vigour expressed in the progeny depending on the breed type of the cows used. Therefore you should consider placing extra emphasis on the Calving Ease EBVs (more positive) of the sire to allow for possible heavier birth weights of his calves due to hybrid vigour. Use this index in both commercial and pedigree herds where you are balancing the requirements of selecting replacement females while also producing animals for slaughter. Charolais EBV ratios have been incorporated with the Estimated Breeding Values (EBV) to assist breeders in making their selection decisions when purchasing Charolais cattle. The Charolais EBV ratio for each trait shows that animal`s breeding value for that trait in relation to the current published breed average. The average for each trait is 100, and the approximate range between the bottom 1% and the top 1% is between 70 and 130.

Maiden heifers stated to be sold for breeding purposes. The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes to be free from any malformation which would render the animal incapable of breeding. The warranty is a 5 day warranty if the malformation is patent or a 6 month + 5 day warranty if the malformation is latent. If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of claim must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf. The vendor warrants a cow or heifer in calf and/or in milk: (a) To be correct in the udder and teats; (b) Not to be infected with clinical mastitis; and, (c) Not to suck any other animal or herself. The warranties in conditions (a) & (b) is an after sale warranty which shall run from the close of the day’s sale or until the animal is removed from the sale premises, whichever is sooner. The warranty in conditions (c) is a 5+5 day warranty.

Cleansing: The vendor warrants that all newly calved cows and heifers have cleansed satisfactorily before the sale. This warranty is a 3 day warranty in which any claim made by the purchaser must be supported by a veterinary surgeon’s certificate. The vendor is obliged to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf. When an animal stated to have been served less than 10 weeks prior to the sale and is pregnancy diagnosed positive, this is given as guidance only and carries no warranty. If a cow or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is produced there is a 38 + 5 day warranty. Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal being in calf at the time of sale is given.

Breeding Stock Bulls: The vendor warrants that any bull 10 months or over sold as a stock bull is capable of and effective at natural service. This warranty is a 16 week warranty. The descriptions are supplied by the vendor and whilst they are believed to be correct this catalogue in no way shall guarantee their accuracy.
