ABOUT THE AUTHOR Louis Fisher is Specialist in Constitutional Law with the Law Library of the Library of Congress. The views expressed here are personal, not institutional. Earlier in his career at the Library of Congress, Fisher worked for the Congressional Research Service from 1970 to March 3, 2006. During his service with CRS he was Senior Specialist in Separation of Powers and research director of the House Iran-Contra Committee in 1987, writing major sections of the final report. Fisher received his doctorate in political science from the New School for Social Research and has taught at a number of universities and law schools. He is the author of eighteen books, including In the Name of National Security: Unchecked Presidential Power and the Reynolds Case (2006), Presidential War Power (2d ed. 2004), Military Tribunals and Presidential Power (2005), The Politics of Executive Privilege (2004), American Constitutional Law (with Katy J. ••••••••••••TENNESSEE CONSTITUTIONAL HISTORY Settlement and 1796 Constitution • The area that became Tennessee was part of the 1663 land grant of North Carolina from Charles II. • In violation of the British Proclamation of 1763 prohibiting settlements west of the Appalachian Mountains, the Watauga settlement was founded in 1771. (T. R's "Great Leap Westward" He wrote that Robertson and Sevier were two of the three greatest leaders in the development west of the mountains, the third being George Rogers Clark) The Watauga Association adopted articles to govern their settlement in 1772—this was the first government west of the mountains. The last British Governor of Virginia, the Earl of Dunmore, wrote in 1774 that Watauga was "a dangerous example to the people of America of forming governments distinct from and independent of his majesty's authority." In 1775, Richard Henderson purchased a large area of Kentucky and Middle Tennessee from the Cherokees--20 million acres for 6 wagon loads of goods. The governments of Virginia and North Carolina refused to recognize it. It was Henderson who was behind the settlement of Nashville in 1779-80. James Robertson led most of the men and the livestock over land to the settlement. John Donelson led a flotilla by water, down the Tennessee River to the Ohio, up the Ohio to the Cumberland, and up the Cumberland to the settlement. The Cumberland Compact was signed in 1780. It provided for the government of the settlement. · After being ignored by North Carolina for many years, the eastern settlements attempt to form the state of Franklin in 1784. -

The United States suffered an economic downturn throughout the 1820s, which especially affected South Carolina. Many South Carolina politicians blamed the economic downturn on the national tariff policy that was enacted after the War of 1812. This tariff policy was implemented to help Northern manufacturing industries better compete in domestic markets against well established European manufacturers. The Nullification Crisis occurred when the South Carolina state government refused to enforce the federal government’s tariffs, declaring them to be unconstitutional. -

Growth of Presidential Power A. Article II of the Constitution 1. Article II is the part of the Constitution that deals with the Executive Branch. 2. Article II is basically just a short outline of powers. 3. A large part of America’s early political history deals with defining the extent of the executive power. B. The Changing View of Presidential Power 1. Why Presidential Power Has Grown -The presidency is in the hands of one person, rather than many, and many Presidents have worked to expand the powers of their office. -As the country grew and industrialized, especially in times of emergency, people demanded that the Federal Government play a larger role and looked to the President for leadership. -Congress has delegated much authority to the President, although presidential control over foreign affairs is greater than it is over domestic affairs. Congress simply continues to assert itself in the implementation of social programs. -Presidents have the attention and general respect of the media, the public, and their own party. C. How Presidents Have Viewed Their Power 1. Stronger and more effective Presidents have taken a broad view of the powers of the office. 2. Teddy Roosevelt viewed his broad use of Presidential powers as the “Stewardship Theory”, which means that the President should have the power to act as a “steward” over the country. 3. Recent, very strong presidents have given rise to the phrase “Imperial Presidency”, which implies that the President becomes as strong as an emperor. The term is often used to refer to the administration of Richard Nixon. -

ANDREW JACKSON: SHOULD HE BE ON THE $20 BILL? Introduction: Historians continue to debate the merits of the decisions and actions taken by President Andrew Jackson during his two terms in office. Living between the Revolutionary War and the Civil War, Jackson played a central role in virtually all of the controversial issues of his time - Indian removal, economic reform, states' rights, and slavery. Overshadowed in popular culture by the Founding Fathers and even wartime Presidents Abraham Lincoln and Franklin Roosevelt, Jackson nonetheless played a pivotal role in America's development. In 1929, the Treasury Department replaced Grover Cleveland's portrait on the twenty-dollar bill with that of Jackson, a nice bit of irony considering Jackson's opposition to paper money. Today, some people advocate replacing Jackson's image with that of some other prominent American, such as Martin Luther King or even President Ronald Reagan Procedures/tasks: -You will be assigned a specific role you are to research. Judicial Power, Political Fragmentation, and the Failed 1831 Repeal of Section 25 A ntebellum Americans anticipated contemporary political science when they complained about the tendency of embattled political elites to take refuge in the judiciary. Recent scholarship on comparative judicial politics suggests that judicial review is a means by which constitutional framers provided protection for certain class interests that may no longer be fully protected in legislative settings. Tom Ginsburg claims, "[I]f they foresee themselves losing in postconstitutional elections," the politicians responsible for the constitution "may seek to entrench judicial review as a form of political insurance." 1 Such a constitutional design ensures "[e]ven if they lose the election, they will be able to have some access to a forum in which to challenge the legislature."2 In 1801, Thomas Jefferson foreshadowed this strategy. He asserted that the defeated Federalist Party had "retired into the judiciary as a stronghold ...and from that battery all the works of republicanism are to be beaten down and erased.",3 More than a half century later, Chief Justice David S. *Professor of Law and Government, University of Maryland School of Law. Kosar Analyst in American National Government Government and Finance Division Summary The veto power vested in the President by Article I, Section 7 of the Constitution has proven to be an effective tool for the chief executive in his dealings with Congress. Since the founding of the federal government in 1789, 35 of 43 Presidents have exercised their veto authority a total of 2,550 times. Congress has overridden these vetoes on 106 occasions (4.2%). Presidents have vetoed 80 appropriations bills, and Congress has overridden 12 (15.0%) of these vetoes. This report will be updated at the beginning of each new Congress. Constitutional Basis and Importance To become law, the U.S. Constitution (Article I, Section 7) provides that all bills that have been approved by both houses of Congress must be presented to the President for his approval and signature.1 The President may sign a bill into law within the 10-day period (excluding Sundays) provided in the Constitution,2 let it become law without his signature, or veto it. The Constitution states that, when the President vetoes a bill, “he shall return it, with his Objections to that House in which it shall have originated.” This type of action is called a “regular” or “return” veto. If, on the other hand, Congress has adjourned within the 10-day period after presentation of the bill to the President (thereby preventing the return of the bill to Congress), the President may simply withhold his signature, and the bill does not become law — a practice that has been dubbed a “pocket” veto.3 The President’s veto authority is among his most significant tools in legislative 1 These bills include joint resolutions, but do not include proposed amendments to the Constitution, which require a two-thirds vote in each house, and are sent directly to the states for approval. -

Pro: If you were a craftsman or manufacturer in the United States, you would like tariffs because your products would not have that additional tax, therefore your products are cheaper than foreign products. People will be more likely to buy your products. Con: If your business is agriculture, you need to sell your food and raw materials and buy manufactured goods. You may depend on foreign nations to buy your goods and in return you buy their manufactured goods. You are afraid that tariffs will make foreign goods more expensive.
