Notice of Community Council Elections NOTICE OF COMMUNITY COUNCIL ELECTIONS Elections are to be held for all Moray Community Councils noted below. Persons wishing to represent their Community Council must be 16 years of age or older, live in the Community Council area and be named on the electoral register for the area in which they are standing. To stand as a candidate a completed and valid nomination form must be submitted to the Elections Office, Moray Council, Council Offices, Elgin, IV30 1BX no later than 4pm on Thursday 28 September 2017. Nomination forms are available from the elections office at the above address by calling 01343 563334, emailing [email protected] or downloaded from www.moray.gov.uk/communitycouncils. Nomination forms are also available on request from the Council’s Access Points in Buckie, Elgin Forres and Keith. If the number of valid nominations exceeds the maximum number of seats available for a Community Council a postal ballot will be held in October. If the number of nominations received is between the minimum and maximum membership, those nominated will be declared elected. WATER SAFETY With the continuing warm weather it is always tempting to go swimming to cool off. Water may look safe, but it can be dangerous. Learn to spot and keep away from dangers. You may swim well in a warm indoor pool, but that does not mean that you will be able to swim in cold water. REASON FOR REPORT 1.1 To ask the Committee to consider studies into potential flood protection schemes at Hopeman, Dallas, Portessie and Arradoul and agree a course of action, making recommendations to The Moray Council where there are budgetary implications. 1.2 To ask Committee to note the revised programme and a potential grant funding opportunity for Newmill Flood Protection Scheme Phase 2. 1.3 This report is submitted to Committee in terms of Section III (F) (21) of the Council's Scheme of Administration relating to the functions of the Council under the Flood Risk Management (Scotland) Act 2009. 2. RECOMMENDATION 2.1 It is recommended that Committee:- (i) recommend to The Moray Council that Flood Protection Schemes for Hopeman and Portessie are taken forward and the Capital Plan amended to include £830,000 for the Hopeman scheme and £3.65 million for the Portessie scheme; (ii) note that Dallas is considered to have flood protection to the normal 1 in 200 year design standard, and consider whether protection beyond that standard should be provided; (iii) agree that there is no practical or economic means of providing further flood protection to Arradoul by means of a Flood Protection Scheme and it therefore is not taken forward; and (iv) note the change to construction start date and opportunity of potential grant funding for Newmill Flood Protection Scheme Phase 2.

The meeting agreed to suspend standing orders to allow presentations by those in attendance. Councillor Eric McGillivray took the floor and referred to the forthcoming library closures in Burghead and Hopeman. Hopeman, he said, had reluctantly accepted the decision to close their library and were to hold a public meeting to set up a committee to run their library themselves. Eric advised the meeting that, in his opinion, any protest marches against the closures were futile and would be a complete waste of time. He suggested, taking a lead from Hopeman to accept what was a fait accompli and to apply to take over the running of the library by volunteers. Eric suggested that a Community Asset Transfer request be made to Moray Council to enable the Burghead Community to advance the possibility of volunteer takeover and handed over leaflets which explained the procedure. The Chair thanked Eric for his advice and advised him that Burghead was not going to “roll over” and accept the closure of their library without a fight and was invited to stay in the meeting to hear the representations of the Save Burghead Library Action Group who were present at the meeting.

    SCOTTISH GOVERNMENT Issued on behalf of The Local Government Boundary Commission for Scotland Not for Publication, Broadcast or use on Club Tapes before 0001 Hours on 26 May 2016 Recommendations for councillor numbers and wards submitted to Scottish Ministers The Local Government Boundary Commission for Scotland has submitted its recommendations on councillor numbers and wards for each of Scotland's 32 council areas to Scottish Ministers. These recommendations arise from the 5th Reviews of Local Government Electoral Arrangements which began in February 2014. The recommendations provide for 351 wards and 1219 councillors across Scotland, an overall decrease of 2 wards and 4 councillors relative to existing arrangements. Under the recommendations, representation of the electorate within council areas will be more evenly shared between councillors and across Scotland there will be greater equity in electoral representation. Ronnie Hinds, Chair of the Commission, said: "Today we have submitted to Scottish Ministers our recommendations for electoral arrangements which we believe are in the interests of effective and convenient local government across Scotland. These recommendations set out the number of councillors for each council area and the boundaries of the wards they will represent. We are grateful to councils and to the public who responded to our consultations over the last two years. Their input has been invaluable in shaping our proposals and while we must take account of our obligations under the legislation and consider the interests of the whole council area, we have been able to take on board many of the views expressed. The legislation which governs our reviews places equality of representation at the heart of what we do and we have delivered a set of recommendations that significantly improves electoral parity across Scotland and so provides for fairer local democracy and more effective local government ." 1 A summary of the recommendations for each council area is contained in the appendix to this release.

REASON FOR REPORT 1.1 To seek approval for the revision of arrangements for polling districts and polling places following statutory review. 1.2 This report is submitted to Committee in terms of Section II (9) of the Council's Scheme of Administration relating to all election matters. 2. RECOMMENDATION 2.1 It is recommended that Council approve the proposals to amend the current polling district and polling place arrangements as summarised in Section 4. 3. BACKGROUND 3.1 Section 18(3) of the Representation of the People Act 1983 requires each Local Authority in Scotland to designate a polling place for each of its polling districts and to review these within 16 months of 1 October 2013 and every 5 years thereafter. 3.2 A polling place is defined as ‘a geographical area in which a polling station is located’. There is no legal definition of what a polling place is but it is widely accepted to be a specific building identified for the purpose, which the Local Authority is responsible for determining. 3.3 A polling station is the actual area where the process of voting takes place, and must be located within the polling place designated for the particular polling district for which the Returning Officer is responsible for determining. 3.4 In designating a polling place the Local Authority must demonstrate they have, as far as is practicable, met the criteria set in the legislation and in doing so must: • ensure all the electors in the constituency have such reasonable facilities for voting as are practicable in the circumstances; and • ensure that, so far as is reasonable and practicable, every polling place for which it is responsible is accessible to disabled electors.
