REASON FOR REPORT 1.1 To ask the Committee to consider studies into potential flood protection schemes at Hopeman, Dallas, Portessie and Arradoul and agree a course of action, making recommendations to The Moray Council where there are budgetary implications. 1.2 To ask Committee to note the revised programme and a potential grant funding opportunity for Newmill Flood Protection Scheme Phase 2. 1.3 This report is submitted to Committee in terms of Section III (F) (21) of the Council's Scheme of Administration relating to the functions of the Council under the Flood Risk Management (Scotland) Act 2009. 2. RECOMMENDATION 2.1 It is recommended that Committee:- (i) recommend to The Moray Council that Flood Protection Schemes for Hopeman and Portessie are taken forward and the Capital Plan amended to include £830,000 for the Hopeman scheme and £3.65 million for the Portessie scheme; (ii) note that Dallas is considered to have flood protection to the normal 1 in 200 year design standard, and consider whether protection beyond that standard should be provided; (iii) agree that there is no practical or economic means of providing further flood protection to Arradoul by means of a Flood Protection Scheme and it therefore is not taken forward; and (iv) note the change to construction start date and opportunity of potential grant funding for Newmill Flood Protection Scheme Phase 2.

To stand as a candidate a completed and valid nomination form must be submitted to the Elections Office, Moray Council, Council Offices, Elgin, IV30 1BX no later than 4pm on Thursday 28 September 2017. Large pothole/ flooding on unclassified road from Arradoul towards Walkerdale. Remedial work has been undertaken but Moray Council have had to liaise with Scottish Gas as its situated beside gas main/ electricity box before any work carried out. Discussions with land owner, Christies, who have agreed to a dig ditch to help with drainage. Community council will give update when work is to begin. Walls at North High Street, Buckie have now been repaired. Railway line, cycle path has been looked at.

    1INTRODUCTION Moray Council is in the process of preparing the Moray Local Development Plan (MLDP) 2020. The MLDP has been informed and supported by the preparation of this Strategic Flood Risk Assessment (SFRA). 2AIMS AND OBJECTIVES This SFRA sets out strategic flood risk across Moray to support sustainable land allocation in the emerging MLDP by identifying areas of land that are most suitable for accommodating future development. The main objectives of this SFRA are to: x Provide a strategic outline on flooding issues to contribute to allocation of land; x Identify flood risk areas in line with Scottish Planning Policy (SPP) risk framework; x Provide an evidence base to inform the LDP; x Develop new policies on flood risk as necessary. 3 NATIONAL AND LOCAL POLICY FRAMEWORK Flood Risk Management (Scotland) Act 2009 The Flood Risk Management (Scotland) Act 2009 sets out a statutory framework for delivering a sustainable and risk­based approach to managing flooding. The Act also sets duties on SEPA and local authorities to exercise their flood related functions to reduce overall risk of flooding and promote sustainable flood risk management. The Act promotes a risk­based, plan­led approach to managing flood risk and requires SEPA, in partnership with responsible authorities to develop and implement flood risk management strategies and plans. The Local Flood Risk Management Plans set out how and when actions to reduce the impact of flooding in the Local Plan Districts identified in the Flood Risk Management Strategy will be delivered. The Strategy identifies where the risk of flooding and benefit of investment is greatest and the Plan says how and when prioritised actions will be delivered.
