It was with great sadness that the community learned of the death of the Prince Phillip, husband and consort to Her Queen Elizabeth II, Lord of Mann. I would ask that we stand for a minute's silence to reflect on his service to the British Monarchy during his full and active lifetime.

The Monthly Board Meeting of the Ramsey Town Commissioners was held via telephone link the Boardroom of the Town Hall, Ramsey, on Wednesday, 17th February, 2021, at 7.00 p.m.

Present: Mr. A. G. Cowie, Mesdames M. B. Quayle and J. Wedgwood, Messrs', Rev Canon N. D. Greenwood N. P. Howard J. McGuinness, L. Parker, F. B. R. Williams and W. G. Young.

Apologies: Apologies for absence had been received from Mr. A. J. Oldham.

The Town Clerk, Deputy Town Clerk, Finance Officer, Technical Services Manager, Housing and Property Manager, and Minute Clerk were in attendance.

(2020121 :297) Minutes:

It was noted that any decisions made at virtual meetings would require ratification as a subsequent meeting pending the passing of the Elections and Meetings (Local Authorities) Bill.

Resolved: That the Minutes of the Board Meeting held on 17th February, 2021, be confirmed and signed by the Chairman.

(2020/21:298) Matters Arising:

No matters were raised, but Mr. McGuinness queried whether this meeting properly constituted a Public Monthly Board Meeting as he felt uncomfortable at the level of pre-exposure it had been given. Mr. McGuinness was informed that the meeting had been advertised as usual via the Commissioners website and the Town Clerk asked members if they would like to defer the meeting to a later date. Members agreed not to defer the meeting.

(2020121 :299) Chairman's Report:

Resolved: To note the Chairman's report dated 10 th March, 2021. The Chairman also referred to the sadness in noting that a member of the refuse crew had tested positive for the Corona Virus and in so doing wished that staff member a full and speedy recovery. The Chairman also thanked members for their attempt in trialling albeit unsuccessfully, a "Teams Meeting".

The Chairman thanked officers and staff for the manner in which they had responded to the further lockdown period, and for their continued effort in providing essential services to the town during the ongoing restrictions.

Finance and General Purposes:

(2020/21 :300) Town Clerk's Report - Local Authority General Elections 2021:

Resolved: To note the Town Clerk's report dated Illh March, 2021, advising of the postponement of the April 2021 Local Authority General Elections to 22,,,1 July, 2021, or as soon as practicable thereafter, in view of current Covid-19 lockdown restrictions.

The Town Clerk informed members that the Elections and Meetings (Local Authorities) Bill 2021, details of which had been circulated to members, will be processed through its various stages by Keys and Legislative Council on 18 1h March, 2021.

The Bill will, amend the Local Elections Act, 1986, and: - • Provide that Local Authority General Elections be held in July, 2021 and thereafter in April of every successive fourth year. • Allow the Department to make regulations to postpone such elections to a different date. • Allow local authority members to go out of office on 151 August, 2021. • Provide that attendance at meetings can be affected remotely, [as long as members can hear and be heard]. • Provide that casual vacancies can be filled as soon as reasonably practicable after they have arisen. • Extend the existing provision of the Act which provides that the chairman continues in office until the successor has accepted office, to the chairman of a local authority where that authority has not held an annual general meeting at which such a person would be elected.

Amendments are also introduced to the Local Government Act 1985 and the Emergency Powers (Amendment) Act 2020, which are mainly "enabling". The Town Clerk reminded members that the date of the Local Authority General Election and, therefore, the schedule for election Notices was decided by the Department.

(2020/21:301) Town Clerk's Report - Manx Development Corporation:

Resolved: To note the Town Clerk's report dated 5th March, 2021, advising of the proposal of the Department for Enterprise to establish by 31 st March, 2021, the Manx Development Corporation, at the directive of the Select Committee on Unoccupied Urban Sites.

It was noted that the Commission will be able to meet with the Corporation in the future when it has formed a company. Ramsey Town Commissioners Board Meeting - 17'10 March, 2021, Pnblic Continued:

(2020/21:302) Deputy Town Clerk's Report - Street Trader's Licence Manx Whippy:

Members considered the Deputy Town Clerk's report dated 10 th March, 2021, advising of the application madc by Manx Whippy Limited for a Street Trader's Licence to allow two vehicles to trade, during 2021. It was noted that the company do trade at specific events by invitation and do not trade within the town centre.

Resolved: That following a proposal by Mr. McGuinness seconded by Mr. Cowie and agreed that a One Year Licence be granted on the same terms and conditions as previous years.

(2020/21 :303) Deputy Town Clerk's Report - Street Trader's Licence Parish Pantry:

Members considered the Deputy Town Clerk's report dated 10 th March, 2021, advising of the application for a Street Trader's Licence to allow the Parish Pantry to trade on the footpath on the Mooragh Promenade, oppose the Rugby Pitch, up to 2 days per week. Members noted that the existing licence is for one day per week and a recent request to operate for up to 3 days had been refused.

Mr. Williams asked what progress had been made with regard to a Policy Document with regard to Street Traders and was advised that a report would be provided to the next policy committee meeting.

Resolved: That, following a proposal by Mr. Williams, seconded by Mr. Parker and agreed by 7 votes to 2 that a One Year Only Licence be granted on the same terms and conditions as previous years. Mrs. Wedgwood and Mr. McGuinness voted against.

(2020/21 :304) Finance Officer General Report:

Resolved: To note and approved the Finance Officer's general report dated 10 th March, 2021, subject to the following: -

Summary of Revenue Income and Expenditure: Mr. Cowie asked if a receipt in respect of rates was anticipated and was informed that £268,000 had been received on 12th March, 2021, which members were also informed was greater than the amount received at the same time in 2020.

(2020/21:305) Technical Services Manager's Report - Planning Applications:

Members agreed that the Technical Services Manager's Report dated II th March, , 2021, detailing planning applications received from the Department of the Environment, Food and Agriculture, under the planning consultation procedures, be noted and no objections be made to such applications, subject to the following:-

(2020/21:305) Technical Sel'vices Manager's Report - Planning Applications Continued:

REF NO: 3836 AMENDED PLANS P.A.NO.: 20101401lA PROPOSED: Approval in Principle for the erection of 2 dwellings addressing matters of access and parking NOTES: Approval in Principle SITE: Land to rear of 6, Summerland, Seamount Road, Ramsey.

Members were informed that the amendment addressed one of the objections made by the Commission, namely a preference to see a single dwelling.

Mr. Williams proposed that the Commission object to the amended plans on the grounds that the dwelling does not respect the site and surroundings in terms of General Policy 2(b) of the Isle of Man Strategic Plan 2016 and is contrary to Policy R!R/P 3 of the Ramsey Local Plan with regard to infill/back-land sites. Mrs. Wedgwood seconded the proposal. Members noted that there were other reasons on which the Commission objected to the original application and that should the Commission decide to object they would not be moving away from the original objections.

Mr. Young queried if the Highways Authority had commented on the amendments and was advised that it would appear not.

The proposal to submit an objeetion was put to the vote and earried by 6 votes to 3, Mrs. Quayle and Messrs' Cowie and Howard voting against.

REF NO: 3864 PA NO.: 20101510/A PROPOSED: Approval in principle for residential development NOTES: Approval in Principle SITE: Gladstone Industrial Park, Ramsey.

Mr. Williams advised members of a conversation he had with the Architects who explained their reasoning in submitting the application, namely because of difficulties in renting larger units, wish to generate income to enable redevelopment of the larger units of the Industrial park and those affected by asbestos. It was noted that the Architects have spoken with the Planners who, whilst giving no decision on the proposals, have suggested they are sound.

A proposal put by Mr. McGuinness, seconded by Mr. Cowie to object to the application was carried by 5 votes to 3. Mesdames Quayle and Wedgwood and Mr. Williams voting against. Mr. Howard temporarily left the meeting [at 7.52 p.m.] during discussion of the clause and was not available when the vote was taken. REF NO: 3867 P.A. NO.: 2 1100 144/B PROPOSED: Variation of condition 2 ofPA 17/00870/B. Erection of two 6 storey apartment buildings containing 23 apartments in total and associated parking, to amend the car parking provision NOTES: P.A. in Detail SITE: Land at corncr of Mooragh Promcnadc and Prcmicr Road, Ramscy

In response to a query put by Mr. Cowie, the Town Clerk confirmed that this application, which addressed the loss of two parking spaces to the proposal as a result of garages having been constructed, had been withdrawn.

Resolved: To note the Housing and Property Manager's report dated 5th March, 2021, advising of the intention of the tenant of the Boathouse Cafe to commence prior approved works during Spring/Summer 2021.

(2020/21:307) Mattcrs Raiscd by Mcmbcrs of thc Public "Covid-19":

Members noted the content of correspondence received from a ratepayer concerning "Covid-19" and a request that the matter be debated.

Members agreed they did not have sufficient medical knowledge or expertise to comment on the correspondence. Members felt they had done their utmost in responding to the pandemic and they have and must continue to take the advice of Government's health professionals.

(2020/21 :308) Rcprcscntativc Rcport:

Resolved: To note the report ofa meeting of the Isle of Man Municipal Association, held on 25 th February, 2021, submitted by Mr. Cowie.

(2020/21:308) Dcckchair Rcntal Conccssion:

Mr. Young queried whether the re-introduction of a deckchair rental concession was worthy of consideration and suggested Mr. Parker's shop premises as a suitable rental point.

5 Ramsey Town Commissioners Board Meeting - 17th March, 2021, Public Continued:

(2020/21:309) Public Question - Presentation of Accounts Paid:

Mr. McGuinness referred to the query put by a membcr of the public about the way accounts paid are presented within the Finance Officer's monthly report. He confirmed that the Finance Officer has made some suggested to him and assured Members that this matter has not been forgotten and will be brought to the Board when possible.

The Chairman closed the public session at 8.07 p.m. and, after thanking Mrs. Woolley for her "attendance", moved directly to private business.

The following items were considered in private the detail of which, having regard to data protection, matters affecting persons who cannot be named, etc., is not as extensive as that contained in minutes of matters discussed in pUblic.

(2020/21:310) Minutes:

It was noted, for record purposes that no matters from the Board Meeting held on 171h February, 2021, were recorded in private.

Mr. Howard returned to the meeting at this stage.

Matters for Information:

(2020121:311) Housing Committee:

Resolved: To note and approve the Minutes of a meeting of the I-lousing Committee held on 2nd March, 2021, subject to the following:-

Clause 52b) Cronk Elfin External Refurbishment - it was noted that tenders had been opened on 51h March, 2021, as it had been possible to do so allowing for social distancing and have been referred to the consultant for examination. Clause 87 Allocated Properties and Clause 88 Vacant Properties - members were pleased to note the number of tenancies allocated in February and that work can be safely progressed in vacant properties.

Mr. Cowie queried the number of applicants now on the I bedroomed housing waiting list and was advised by the I-lousing and Property Manager that there were 48 who would qualify on the I or 2 bedroomed list (the list does not reflect just I bedroom). (2020/21:312) On-Going Matters "Action Tracket''':

Resolved: To note the "Action Tracker" to loth March, 2021, and the following comments made thereon, accepting that some matters may be referred to within other Clauses of these minutes:-

• Shoprite Group - the Town Clerk advised that a draft agreement is with Advocates and it is hoped that it can come into force from I $I April. • Shelter Public Art - the Deputy Town Clerk indicated he would check to sec if work, for which funding has been received, can start. • Water Play Area - members were informed by the I-lousing and Property Manager that it had been identified that one local firm could undertake the works and that the UK manufacturers had provided technical specification. Members were informed that it was difficult to price the works and ensure the same level of guarantees but envisaged that the works could be undertaken within budget but would take a little longer. Mr. Parker proposed that the Commission proceed with a local contractor subject to castings. • Bowling Green - the Deputy Town Clerk confirmed the Bowling Club is happy with the arrangements for future use of the Bowling Green and that the Commission will be submitting a planning application for a storage unit associated thereto. • Boul1dmy Extension - the Town Clerk was instructed to seek progress on this matter. • Rate Arrears - the Town Clerk confirmed that the Government Valuer is looking into this matter and will be able to do more after lockdown but that no response has been from the Treasury's Chief Financial Officer. • Ralllsey Events - the Deputy Town Clerk confirmed that some events will probably be delayed, and it is hoped to proceed with events planned for June. • Insurance Renewal- the Finance Officer advised that some verbal expressions of interest have been forthcoming despite the advertisement not yet having been placed.

Members also noted the Register of Ruinous Property and Unsightly Land and Buildings to I I th March, 202 I, subject to the following:-

• 10111 West Quay - the Technical Services Manager reported that I I West Quay has been acquired and the new owners have concerns about the neighbouring property. • 67 Parlialllent Street - the Town Clerk informed members that the owners have given an undertaking to carry out works, and will, therefore, be given 30 days to do so (after lockdown).

Finance and General Purposes:

(2020/21:313) Town Clerk's Report - Equality Policy:

Members considered the Town Clerk's report dated 5th March, 2021, to which was appended an Equality Policy having regard to a model produced by the UK Advisory, Conciliation and Arbitration Service [ACASj.

Resolved: That, following a proposal by Mr. McGuinness seconded by Mr. Cowie and agreed unanimously that the Equality Policy be adopted,

(2020121:314) Town Clerk's Report - Public Opeu Space:

Resolved: To note and approve the Town Clerk's report dated 1 I'h March, 2021, advising of the progress of various petitions and applications for adoption of Public Open space in terms of Section 25 of the Local Government Act 1985.

The Town Clerk verbally report receipt of draft proposals for Auldyn Walk and Auldyn Meadow on which he will report further when more detailed information is available.

(2020121:315) Deputy Town Clerk's Report - Commercial Rents:

Members considered the Deputy Town Clerk's report dated lO'h March, 2021, advising that since the introduction on 3rd March of the circuit-breaker lockdown a commercial tenant of the Commission's properties has now requested a "rental payment holiday".

Resolved: That following a proposal by Mr. McGuinness seconded by Mr. Williams and agreed, a rental holiday of one month be granted to the Commission's commercial tenants and the matter be reviewed thereafter.

(2020/21:316) Finance Officer's Report:

Resolved: To note and approved the Finance Officer's Report dated 10'h March, 2021, subject to the following:-

Aged Debtors - Mr. McGuinness asked if any recent debtors had made contact about late payments and was advised not most of the debts being older and were being paid by instalment and the debtors are being chased to maintain payments. Mr. Cowie queried a specific debt the circumstances of which were explained, and members were assured that payment is being chased.

Works and Development:

(2020/21:317) Town Clerk's Report - Ramsey Quayside:

Members considered the Town Clerk's Report dated 22"d February, 2021, advising of discussions held at a meeting with Mr. Robinson. The Town Clerk reported receipt of an email from Mr. Robinson which regard to car parking.

Resolved: That, following a proposal by Mr. Williams, seconded by Mr. McGuinness, and agreed by 8 votes to 1, Mr. Young voting against, that a further meeting be requested with the Minister.

(2020/21:318) Technical Services Manager's Report - Christmas Lights:

Members eonsidered the Technical Services Manager's report dated 9th March, 2021, providing an update on options available for decorative lighting.

Resolved: To note the report and ask the Technical Services Manager to submit further report on the provision of a Christmas Tree including comparisons within the lowlmedium and higher price ranges and provision of traditional trees.

(2020/21:319) Technical Services Manager's Report - Fleet Sale:

Members considered the Technical Services Manager's report dated 4th March, 2021, advising of the result of the sale at auction of items of vehicle and plant surplus to the Commission's requirements. It was noted that it is proposed to auction a further item of plant when Covid restrictions allow, Mr. Young indicated his willingness to purchase the item at the reserve price should it not reach such reserve at auction. The Finance Officer confirmed that sale receipts had not been projected with in the budget due to uncertainty of values.

Resolved: That, following a proposal by Mr. Williams, seconded by Mr. McGuinness and agreed, subject to the auction achieving the anticipated result, authorisation be given to the purchase of an addition van.

Canon Greenwood did not vote owning to his temporary absence from the meeting.

(2020/21:320) Technical Services Manager's Report - Ruinous Buildings:

Members eonsidered the Technical Services Manager's report dated 11th February, 2021, advising of problems with 4 pmiicular properties in Ramsey and recommending action to remedy such problems, when Covid restrictions allow.

Resolved: That, following a proposal by Mr. Williams seconded by Mrs. Wedgwood and agreed that the action recommended be progressed, subject to enquiry being made to determine the address at which the owner of the property listed first on the list is residing and advice being sought from Environment Health in respect of the premises listed third on the list.

Mr. Cowie declared an interest in respeet of one of the properties due to residential proximity. Ramsey Towll Commissioners Board Meeting _17'h Mal'clt, 2021, Continued:

(2020/21:321) Technical Services Manager's - Dandara Lower Milntown Development:

Members considered the Technical Services Manager's tabled report dated 15 th March, 2021, advising of the submission of amended plans by Dandara Homes Ltd., for their proposed development at Lower Milntown. It was noted that details of the th submission were published on 12th March and submissions are required by 9 April.

Members were informed that the amendment reflected improved access onto Lezayre Road but no other matters about which the Commission had object in the original application had been addressed. Members were reminded that the original application had also been on public display at the Town Hall.

Resolved: That, following a proposal by Mr. Williams, seconded by Mr. Cowie and agreed that the Commission seek an extension and in the absence thereof repeat their objections to the proposals except for the entrance location, which had addressed that concern.

Mrs. Wedgwood withdrew from the meeting at 9.30 p.m., during discussion of the clause and did not vote.

(2020121:322) Technical Services Manager's Report - Street Lighting Contract 2021122:

Members considered the Technical Services Manager's tabled report dated 17th March, 2021, concerning the contract for the maintenance of streetlights for 2021122.

Resolved: That following a proposal by Mr. Williams seconded by Mr. Parker and agreed that the Commission enter a contract with Manx Utilities for a further year. It was noted that the prices have been retained as those for 2020/21.

Members queried if any alternative quotations had been sought and were informed not as health and safety requirements ofMUA involving their equipment would make it extremely difficult for others to undertake the contract.

(2020121:323) April Board Meeting:

The Chairman drew attention to the cancellation of local authority general elections scheduled to have taken place on 22'1(1 April.

Resolved: That, following a proposal by Mr. Cowie, seconded by Mr. McGuinness and agreed that the date of the April Board Meeting revert its original date, namely 21't April- members having agreed to hold the meeting earlier because of the now cancelled elections.

(2020/21:324) Fibre Poles:

The Chairman drew attention to the increasing number of "fibre poles" being erected around town, which he considered unsightly.

It was agreed that, in view of some concerns raised by members, the Town Clerk seek further information on this matter.

(2020/21:325) Covid-19:

Mr. Parker referred to the confirmation that a member of the refuse-crew had tested positive for Covid- I 9 and queried if the additional refuse collection would proceed.

The Town Clerk confirmed that it would and referred members to the media release which had been copied to them. Mr. Parker asked if further publicity could bc given to this matter.

Matters of Establishment

(2020/21 :326) Establishment Committee:

Resolved: To note and approve the minutes of the meeting of the Establishment Committee held on 16 th February, 2021.

The meeting closed at 9.55 p.m. giving a time of3 hours for the payment of attendance allowances.

It was with great sadness that the community learned of the death of the Prince Philip, husband and consort to Her Majesty Queen Elizabeth II, Lord of Mann.

It is important to recognise his dedicated and tireless service to the people of Britain during his full and active lifetime.

Essential Services

I would again note the efficiency with which the team coped with the impact of the latest Covid outbreak and how the essential services were maintained for the benefit of the town. My thanks again to the staff involved.

Service of Thanks and Blessings

The members of Sui by Methodist Church have re-arranged a service of Thanks and Blessings for the emergency services and volunteer groups who did so much to help those in isolation and in lockdown in the North of the Island during the Covid crisis, th from its original date of 7th March, and will now be held on Sunday, 6 June, 2021.

An invitation is again extended to the Chairman and Commissioners to this celebration service which will start at 10.30 a.m. and at which the Chief Minister will be in attendance.

Members and family wishing to attend are requested to notify the Town Clerk's Secretary so that seating can be reserved.

1:2.. RAMSEY TOWN COMMISSIONERS TOWN CLERK'S REPORT ELECTIONS AND MEETINGS (LOCAL AUTHORITIES) BILL 2021 APRIL, 2021 - PUBLIC

Mr. Chairman and Members,

The I-louse of Keys and Legislative Council sat on Tuesday 18'h March in order to take forward the Elections and Meetings (Local Authorities) Bill 2021. It is understood that the Department expects to be able to announce that to the Act will have been granted at a sitting of Tynwald Court to take place before the 30'h April 2021.

The Bill makes a number of amendments to the Local Elections Act 1986, the Local Government Act 1985 and the Emergency Powers (Amendment) Act 2020

The Bill amends the Local Elections Act 1986 to - (a) provide that local authority elections for the 2021 shall take place in July of that year and thereafter in April of every successive fourth year; (b) enable the Department to make regulations postponing an election to a different date; (c) provide that members of a local authority go out of office on 1st August in the year 2021; (d) provide that attendance at meetings can be effected remotely; (e) provide that casual vacancies can be filled as soon as reasonably practicable after they have arisen; (f) extend the existing provision of the Act which provides that the chairman continues in office until the successor has accepted the office where that authority has not held an annual general meeting at which such a person would be elected; (g) apply the same provision as in (f) to the election of a mayor and deputy mayor.

The Bill amends the Local Government Act 1985 to­ (a) enable attendance at meetings to be effected remotely; (b) provide that a local authority discharges any duty it has to publish documents or make them available for inspection or copying by publishing them electronically or (as appropriate) in a conspicuous place; (c) enable an annual meeting in 2021 to be held in August and to give a local authority the power to decide when and where to hold its meetings; (d) determine what constitutes quorum when one-third or more of a local authority are disqualified or whcre casual vacancies apply to that number.

The Bill amends the Emergency Powers (Amendment) Act 2020 to - (a) postpone the date of local elections in 2021 to 22 July 2021; (b) provide that an existing office holder continues in post until 1 August 2021,

The Bill Amends a number of Orders fO!' joint or combined authorities to deal with vacancies arising and provides that the existing office holders are to continue in office until their successor has been appointed,

13. Clause 20 deals with continuity of offices and appointments in respect of joint boards and committees of local authorities. 14. Clause 21 introduces the Schedule which- (a) makes consequential amendments to various Orders by postponing the date of local authority elections for 2021 to 22 July 2021, and (b) omits article 3(2) of the Elections (Keys and Local Authorities) (Appointed Day) Order 2021 under which the repeal of the Local Elections Act 1986 was to come into operation on 1 January 2022.

The immediate effect of the legislation on the Members is that all current serving members have had their term of office extended until the 1s[ August 2021, and that the appointed Chairman will continue in that capacity until such time that the Commission holds an AGM at which a new Chairman is elected.

At the time of reporting the announcement of Royal Ascent has not appeared on a Tynwald Agenda paper, the Department have stated that they are hopeful that Royal Ascent will be announced within the timeframe necessary.

The Town Clerk's understanding of the Bill is that it does not provide for the retrospective extension of existing appointments beyond the 1st of May 2021. Effectively if Royal Assent isn't announced before 1'[ May 2021 then all existing Members terms of office will expire on that date with only the Chairman holding office until such time as a successor is elected.

In the event of Members terms of office expiring it is understood that the Department of Infrastructure will consider taking steps to appoint Temporary Commissioners for all local authorities under Section 19 of the Local Elections Act 1986 which states: -

Where there are so many vacancies in the office ofmember ofa local authority that the authority is unable to act, the Department may, after consultation with the members ofthe authority, by order appoint persons to jill all or any ofthe vacancies until other members are elected and take up office.

It is further understood the event that temporary appointments are not made, then the Town Clerk would be required to issue a public notice of casual vacancies S 15 of the Local Elections Act 1986, as soon as practicable and that and election to fill those vacancies would be required to be held with 42 days from the date of declaration.

14- RAMSEY TOWN COMMISSIONERS TOWN CLERK'S REPORT INVESTIGATION DEMAND RESPONSIVE BUS SERVICES APRIL, 2021- PUBLIC

Mr. Chairman and Members,

The Office of Fair Trading [OFT] has been undertaking an investigation under the Fair Trading Act 1996 into the provision of Demand Responsive Services by Bus Vannin.

In February, 2020, the Town Clerk provided copies of correspondence and minutes related to the Connect Villages Service, a trial service operating only in the north of the Island, in response to a request for information in relation submitted by the OFT.

The OFT has now written to advise that it has reviewed all the information requested from all the noticed parties which included northern local authorities. As part of the second phase of the investigation OFT have some follow up questions which wiII assist in their enquiries. These are:-

1. Since the introduction of the ConnectViIIages and ConnectPorts demand response services what has been the feedback if any from your; (i) Constituents? (ii) Local businesses? (iii) Any other parties?

2. Do you have any other comments positive or negative regarding the ConnectVillages and ConnectPorts demand response services?

Pursuant to paragraph 6(1) of Schedule 3 to the Act, the OFT hereby requires Ramsey Commissioners to respond within 21 days of the date of the notice which was received on 12 April 2021, and a response is required no later than 3rd May 2021.

The proposed extension of the demand responsive bus services was discussed at the February Board meeting at which time the Commission resolved that the Commission welcome improvement to the Friday and Saturday [demand responsive] services to and ji-O/n Ramsey; query the practicality of the pre-booking service and its impact on the taxi trade, do not want to see any reduction in the "No.5 Service" and it must be ensured that the Town is not cut-offji-om public transport.

Mr. Chairman and Members,

Local Authorities have received correspondence from Andrew Sidebottom, Director of Strategic Asset Management and Valuation, Treasury, last year a statement was made to allow those who had been adversely impacted by the Covid-19 pandemic to defer payment of their rates bills and advising that Treasury have decided that it would be wise to offer the same opportunity on demands sent out centrally again this year. This decision is intended to offer some support to those in our community most affected by the economic impact of the virus.

Treasury appreciate this may have an adverse impact on authority's cash How but in making this decision Treasury did take into account the likely levels of exposure and considered the experiences of last year. Whilst year end collection figures were down slightly (c.3%) on previous years, the impact of the option to defer was minimal with 71 % of the amount billed in April being collected by the 30th June. (Note that this includes direct debit payees who would not have fully paid by the 30th June so approximately 66% is estimated to have been paid in full). This compares favourably with the previous year when 69% (est. 64% exc. direct debit balances) of those who could pay did pay by the 30th June. In addition to the experiences of deferral take up there is also now the new scheme being developed to support businesses which is rates focussed and should further ease pressure on those responsible for the payment of demands.

F or clarity it is also the intention that the normal rate income advances will still be made to as normal. Therefore, by the end of July local authorities whose rates are collection by Treasury should still receive 80% of rate income.

Mr. Sidebottom hopes authorities will understand not only why this decision has been taken but given the urgency of the situation in the currently extended circuit breaker situation why this decision has been taken without any formal consultation.

Mr. Chairman and Members,

The Commission has been approached by Manx Telecom seeking agreement to provide a Wayleave to Install 5 Manx Telecom Poles on land in the Commission's ownership at Bircham Avenue.

The approximate locations are shown on the attached plan and are given as

• Footway at the rear of 63/64 & comer of Car Park at the rear of 49150 Bircham A venue Close. • Adjacent to footpath at rear of No 23 & No 10 Bircham Avenue Close. • Grass area near existing Lamp Post at the rear of 617 Close Caarjys, Ramsey.

A draft wayleave document has been provided within which no provision is made for consideration of any sum.

The granting of a wayleave constitutes a lien on property and therefore requires formal consent to be obtained from the Department of Infrastructure under Section 25 of the Local Government Act 1985.

Manx Telecoms NBP Strategic Project Manager, Jason Moffatt has also written to provide more background to the request, Mr. Moffatt writes:-

I write in connection with our wayleave application to install poles in the Bircham Avenue area to provide superfast fibre broadband to the residents in the area.

The following points may help explain why we are seeking to use poles rather than underground ducting at this location: • Where possible Manx Telecom will always use existing duct ifit is available in an area. There is no existing ducting in this area. • We always speak with the Department ofInfrastructure and other utilities to see if they have any work planned that will allow for duct to be installed. There are no planned works in this area. • We have an agreement in place with the Manx Utilities Authority to share their poles if available in an area. The MUA does not have any poles in this area which we could use. • The use ofpoles to help deliver fibre broadband is common within the industry. It allows for a speedier rollout and saves weeks ofdisruption for residents as roads and pathways do not need to be excavated. It also saves residents having to install ducting across their land, at their own cost, if they wish to take fibre broadband. Poles can connect the premises without the need to dig across private gardens and driveways. Town Clerk's Report - Wayleave Bircham Avenue Area­ April, 2021 - Public Continued:

As you may be aware, the rollout ofsuperfast fibre broadband is being supported by a £40m investment by Manx Telecom plus a £ii.5m investment by the isle ofMan Government under the National Broadband Plan. The aim ofthe NBP is to make fibre broadband available to 99%of all properties on the isle ofMan by the end of 2024. This in turn, will improve the overall broadband experience across the island. Having access to superfast fibre broadband across the island is seen as a key economic driver.

Jfwe are unable to install the poles, thenfunding will need to befoundfor underground installation which is around ii times more expensive than using poles. This could be provided through residents collectively funding the additional cost of duct installation or the Commissioners could choose to provide the necessary financial support for ducting in their local area. it should be remembered that where ducting is installed, customers will also need to pay to provide the required ducting across their own land to connect to the new network. in addition, each resident will then need to apply for a separate Wayleave if the connection encroaches on to land under the Commissioners ownership. i hope this additional information will help explain our rationale further.

The Commission is invited to consider whether it would wish to provide a wayleave to Manx Telecom at this time, and under what tenus. If agreed then a resolution to provide the Wayleave and also to seek consent under S25 of the Local Government Act 1985 will be needed.

10M Bank Loans The Bank have advised us that as from 31 st December 2021 the London Interbank Offered Rate (LIB OR) is being phased out and is being replaced with alternativc Risk­ Frce Rates (RFRs). Historically LIB OR has becn used as a base on which the bank would set intcrest ratcs for loans etc. and as we have loans with the 10M Bank it will impact on the Commission. The reason behind the transition is that over the past few years LIBOR is being applied to a lesser extent and has therefore become more volatile as a basis for the cost of funding to banks. During a zoom presentation the bank indicated the necessmy steps to achieve the transition from LIBOR to RFRs and the fact that they are working towards having all the relevant documentation in place by 30 th September 2021. The Bank identified a couple of alternatives which are applicable for us -- Base Rate and Sterling Overnight Index Average (SONIA), with both these being more stable and predictable than LIBOR and SONIA being the 10M Bank preference. There are a couple of decisions to be made: I. Do we transfer from LIB OR to an alternative RFR from I st January 2022 or at a quarterly loan maturing period before 31 st December 2021 ? 2. Do we transfer from LIBOR to Base Rate or SONIA? The pros and cons relating to the above questions are as follows: Transfer date 31 Sl December 2020 - allows more time for planning, getting an approved methodology & approach in place and for documentation review and completion. 30th June / 30th Sept. 2020 - early transfer so any possible LIB OR risk is removed early, but would give less time for reviewing etc. Alternative RFR Base rate - more widely understood. - would require new documentation in place when re-financing. SONIA - administratively it is set to allow more time to arrange maturity repayments. - Based on daily market rates so is more flexible & re-financing is easier. It is anticipated that there would be little or no difference between the rate of interest charged but it should be noted that cannot be guaranteed. Appendix 3 gives an illustration of the historic rates comparing LIB OR, Base Rate & SONIA.

Recommendation: 1. Undertake necessary preparations to transfer from LIBOR to an alternative RFR as from 1'1 January 2022. 2. Transfer existing LIBOR loan facilities to SONIA.

Mr. Chairman and Members,

Members will be aware that Manx Telecom have embarked on the rollout of superfast fibre broadband under the National Broadband Plan. The aim of the NBP is to make fibre broadband available to 99% of all properties on the Isle of Man by the end of 2024. This in turn, will improve the overall broadband experience across the Island. Having access to superfast fibre broadband across the Island is seen as a key economic driver.

Within Ramsey MT has notified of two specific areas where it proposes the installation of telegraph poles to facilitate fibre broadband being Bircham Avenue and Gainsborough Crescent. Following notification of the proposals a number of residents in the area of Gainsborough Crescent have raised concerns particularly as there are presently no overhead services in the area.

Manx Telecoms NBP Project Manager has provided the following points to help explain why MT are seeking to use poles rather than underground ducting at this location: • Where possible Manx Telecom will always use existing duct if it is available in an area. There is no existing ducting in this area. • We always speak with the Department ofInfrastructure and other utilities to see if they have any work planned that will allow for duct to be installed. There are no planned works in this area. • We have an agreement in place with the Manx Utilities Authority to share their poles if available in an area. The MUA does not have any poles in this area which we could use. • The use of poles to help deliver fibre broadband is common within the industry. It allows for a speedier rollout and saves weeks of disruption for residents as roads and pathways do not need to be excavated. It also saves residents having to install ducting across their land, at their own cost, if they wish to take fibre broadband. Poles can connect the premises without the need to dig across private gardens and driveways.

Telecommunication installations by licensed operators require consent under the Town and Country planning Act and permitted development provisions are contained within the Town and Country Planning (Telecommunications) Development Order 2019. The Order defines:- • "mounted equipment" means transmission equipment including transmission lines, base transceiver stations and multiplexers; and • "telecommunications structure" means a structure the primary purpose of • which is to have mounted equipment attached to it; and it follows therefore that the installation of telegraph poles requires to be permitted under the terms of the Order.

Article 4 of the Order grants approval to classes of development within Schedule 2 which provides the following conditions or limitations on the installation of telecommunications structures on land.

In relation to residential estates, where telegraph poles installed in pavements are unlikely to be more that 20 metres from a primary window, such as Gainsborough Crescent, it follows that any installation wiIl require to be dealt with by way of a prior approval.

The Order further details in Schedule 4 the procedures under which the Department is required to consider and determine prior approval applications, this does not include advertising of such nor the opportunity for public or local authority comment. Of particular relevance in this matter is the requirement in sub-paragraphs 7 to 9 of Schedule 4 that: -

(7) The Department must only consider the folloWing factors in determining an application- (a) the visual and noise impact on residential amenity; (b) the visual impact on the character and appearance ofthe area; (c) the impact on any designated conservation area; and (d) the impact on any designated watercourse.

(8) The Department must only approve an application ifit considers that the development would not have a material negative impact in relation to any ofthe factors specified in sub-paragraph (7).

(9) The Department must adopt a precautionary approach and in cases ofdoubt it must assume a material negative impact.

Where an application for prior approval is refused then licensed operators can submit another application for prior approval addressing the reasons for refusal, or can submit a full planning application.

Fees for prior approval are presently £310 per application and for full planning approval £465.

The matter has been referred to the planning office for further advice.

At the March meeting the Town Clerk was requested to seek further information from Manx Telecom, discussions with the MT consultant dealing with the roll out indicate that the matter remains current and subject to further discussions on a case by case basis. The question of a Wayleave is covered by a separate report.

Mr. Chairman and Members,

Planning application 20100433/8 has been submitted for the demolition of existing buildings within yard and creation of residential development of 10 dwellings with associated roads, landscaping and parking.

All new development is subject to consent required to meet the requirements of the Isle of Man Strategic Plan 2016. The plan covers a number of provisions including recreation where it states that:-

The planning officer's report makes the following comment in relation to public open space:-

6.9 OPEN SPACE PROVISION

6.9.1 In terms of open space provisions for the new dwellings, Recreation Policy 3 indicates that where appropriate, new development should include the provision of landscaped amenity areas as an integral part ofthe design. New residential development often or more dwellings must make provision for recreational and amenity space in accordance with the standards specified in Appendix 6 to the Plan.

6.9.2 Whilst the proposal would provide one main area of open space around the southern boundary ofthe site and the northern sections of the site abutting 9 Loch Villas, this is not considered to be sufficient given that this would serve 10 properties within a constrained site, with the open space provisions being more of an amenity benefit rather than being useable as Public Open Space. As such, the applicant has agreed to provide a commuted sum in lieu ofthe shortfall in the provision ofpublic open space. The details are provided below:

6.9.3 Public open space calculations. In accordance with the 10M Strategic Plan Appendix 6 - the calculation for POS there are 10 units, 6 ofthese are 2 bedrooms, 4 are 3 bedrooms +. The last agreed cost was £17/ m2 for this site (previous application) andforms the basis for the current calculation. The commuted sum: • 6 x 2 bed units @ 54 = 324 m2 • 4x3bed(+)@96=384m2 • Total area = 708 sq. m @£17 = £12,036.00.

6.9.4 It should however be noted that there is a large area ofPublic Open Space (larger open areas ofgrassljields formally laid out as sport pitches and children's play area within afew minutes (under 5 mins) walk away, with goodfootpath access situated north ofShore Road which would serve to ameliorate the loss ofpublic open spaces within the site. 6.9.5 Overall, it is considered the proposal would meet the aims ofRecreation Policy 3.

The Strategic Plan states that once the open space requirement has been established it is then necessary to determine how the open space will be provided. There are three possibilities: - 1. Provided on site. 2. Provide off site but adjacent or close to the development. 3. Provided by payment of a commuted sum to enable the Local Authority to provide the open space on behalf of the developer.

The Town Clerk has been in contact with the developer who has indicated that they wish to proceed on the basis of a commuted sum, and agree the value thereof, and would be agreeable to payment of such prior to habitation of the first unit of housing, e.g., on issue of the first completion certificate for any unit on the development. On the receipt the sum would have to be applied within an agreed timescale, usually 12- 18 months, to the addition to or improvement of amenity facilities in the vicinity of the development, in this case the Mooragh Park. Any monies received would require to be ringfenced and be subject to accrued interest until expended.

The Planning Committee has notified that the application is to be approved subject to a suitable legal agreement being put in place - a Section 13 Agreement - providing amongst other things for the payment of a commuted sum against the shortfall in public open space. The Commission is invited to consider whether, in these circumstances, it would accept a commuted sum of £12,036.00, payable prior to the prior to the occupation of any property in the development, against the provision of public open space.

In addition to the commuted sum there remains within the estate proposal some areas of public open space which will be offered for adoption in due course, identified in the attached plan.

Recommendation: to agree to enter into a Section 13 Agreement for an abated sum of £12,036.00 to be accepted in respect of public open space provision at development proposed for Caine's Yard, to be paid prior to habitation ofthe first unit.

Mr. Chairman and Members,

Department of Environment Food and Agriculture officers met with representatives from Technical Services on the 12th February to talk about their intention to place a number of trees within Ramsey on the Protected Trees Register. They needed to establish ownership of a number of trees before they eould continue.

On the 6th April the Technical Services Manager received a letter with a 'Notice of Entry in Register of Trees' and numerous plans. A total of 18 trees have been identified in the following locations:

• Bircham Avenue • Court House Square • Queen's Drive West Island • Albert Road Island • Cronk Elfin • Brookfield Court • Gladstone Park Industrial Estate • Faaie Wyllin

A further 27 trees within the town, under the ownership of the Department of Infrastructure have also been placed on the register.

Entry on to the register does not restrict reasonable management or work which is justified for sound arboriculturally reasons; however a licence will need to be applied for before any work can be carried out.

39 RAMSEY TOWN COMMISSIONERS TOWN CLERKS REPORT AULDYN MEADOW ESTATE, ADOPTION OF OPEN SPACES APRIL, 2021 - PUBLIC

Mr. Chairman and Members,

The Commission has been approached by Dandara Limited, developers of the Auldyn Walk estate to adopt the areas open space [POS] contained within the approved planning scheme for the development. A plan showing the areas ofPOS offered for adoption is appended hereto. The areas offered for adoption include areas of established grass and planting within the estate and were provided for within the approved planning applications for the estate.

One of the POS areas, identified as area 5 on the appended plan, is intended to be utilised to house a play area in conjunction with a Section 13 Agreement for the remaining area of development at Auldyn Walle Once the Section 13 Agreement has been completed, and the planning process for this development concluded the developer will be submitting a planning application or the play area, which will be transferred to the Commissioners as POS.

Members will be aware that the adoption of public open space designated within a valid planning consent is provided for within Section 12 of the Local Government (Miscellaneous Provisions) Act 1984. A petition to seek approval to formally adopt these areas, required under Section 25 of the Local Government Act 1985, will require to be submitted to the Department ofInfrastructure for the acquisition of the lands for nominal consideration.

Recommendation: To agree the adoption of open spaces within Auldyn Meadow Estate and to submit a petition under S25 of the Local Government Act 1985 for approval to acquire the land for nominal consideration.

The areas offered for adoption include the riverside path and areas of established grass and planting within the estate and were provided for within the approved planning scheme for the estate PA03/0 l846/B.

The amend plans recently submitted for remainder of the estate include further public open space which will be the subject of a separate process following completion.

Members will be aware that the adoption of public open space designated within a valid planning consent is provided for within Section 12 of the Local Government (Miscellaneous Provisions) Act 1984. A petition to seek approval to formally adopt these areas, required under Section 25 of the Local Government Act 1985, will require to be submitted to the Department ofInfrastructure for the acquisition of the lands for nominal consideration.

Recommendation: To agree the adoption of open spaces within Auldyn Walk Estate and to submit a petition under 825 of the Local Government Act 1985 for approval to acquire the land for nominal consideration.

Mr. Chairman and Members,

The following Report has been submitted by Mr. Cowie:-

"Isle of Man Municipal Association: 25 March 2021

The meeting was held over Teams and reasonably weIl-attended, with some amusing distractions by some of the members, although disappointingly no appearances of Cat­ themed backgrounds.

Minister Baker [TBl and Emily Curphey from the Dol Strategy unit were (virtually) present to explain the current situation with the LA elections.

The LA elections have been deferred to a proposed date of 2211<1 July due to the ongoing Covid situation.

Your rep asked if any work was being undertaken in paraIlel to propose systems for electronic voting, as recommended by RTC several years ago on a continuous basis. EC said No but would refer to Crown and Elections team in cabinet office.

TB informed us that this was likely to be the last traditional LA election and the Tynwald election would be different with greater emphasis on postal votes.

The Minister informed the reps that he was to send a letter asking the LAs to consider re-opening the CA sites. I-Ie was pleased to see the coIlaboration between the CA sites.

BoD rep Betty Quirk complained of the state of the (fUIl) bring banks in Douglas and asked what the Dol was doing about it. Also wanted CA sites open!

A long discussion was held on the relative merits ofwho/when/where to open. Your rep identified that we would have difficulty staffing the Northern CA site at the moment due to Covid-related staff issues.

Neal Mellon (Braddan) suggested the quite ridiculous proposal of providing a 2 week "holiday" on appliance disposal costs to encourage people back to the CA sites after they were reopened.

Tim Kenyon (Garff) suggested that all the CAs should open at the same time.

Viv Quane (Lezayre) queried the Minister on the range of potholes available in the North. Representative Report(s) April, 2021 - Public Continued

Jamie (Garff) asked the Minister ifhe felt the Dol was too large for one minster to manage. The Minister thought not and went on to explain the review commissioned by Beamans to look at the scope of the Dol delivery. Your rep was somewhat concerned to note that the Minister felt that the Railways and possibly the Local Government unit might not need to be part of the department.

Betty Quirk (BoD) thanked the Minister for repairing the potholes on Marine Drive (in Braddan)

Neal Mellon (Braddan) asked the Minister what he would do differently. A long preamble on the covid situation followed and TB stated (incorrectly) that the vaccination programme was restricted by the supply of vaccine.

Neal Mellon stated that the Covid crisis was a big opportunity to stop people spitting. NM also stated rather worryingly that he felt the DI-lSC should have managed the crisis throughout, not CoMin or Tynwald.

The Secretary's report identified a recommendation to increase subs from £270 to £320. Your rep confirmed the discrepancy from this year but queried the large (25%) increase and was informed that the secretary and treasurer had agreed a voluntary reduction this year.

Adrian Cowin (Malew) suggested a revision to £300 which was agreed by everyone except your rep, who pointed out that we had had a much-reduced schedule this year and that the secretary had indicated his desire to retire at the end of this year provided an opportunity to review costs. This was agreed by Alison Lynch (Marown) and a proposal to review the costs at the next meeting was agreed by all.

Some discussion ensued on the date of the AGM and a date in June suggested. Your rep pointed out that we may not be in post in June, and it was agreed to defer to later when the Covid situation was clearer.

Michael are due to take the presidency of the MA but had not agreed to accept the honour as yet."
