Terms & Conditions

All business undertaken by Murrays Medical Equipment Ltd. (The Company) as principles, agents, wholesalers, distributors or suppliers is transacted subject to the following terms and conditions. No condition imposed by a purchaser or agent will be binding on the company unless specifi cally accepted by the company in writing.

Retention of Title

All goods supplied shall remain the property of The Company until The Customer has paid all monies owed in full in accordance with The Company’s Terms & Conditions. If any, lawfully demanded, payment is overdue the company may, without prejudice to any of its other rights and remedies, be entitled to enter the premises of The Customer and recover and resell those of The Company’s goods that are available.

It is explicitly against company policy to sell goods on a Sale or Return Basis.

Order Delivery

Goods shall be delivered to The Customer or an address nominated by The Customer. The risk of damage or deterioration (but not ownership) passes to The Customer on delivery. The minimum carriage paid order in the Republic of Ireland is €50. Orders for less than €50 will be charged at cost.

Claims for Non Delivery, Damaged or Faulty Stock

Any claims for shortages, damaged or faulty goods must be notifi ed to The Company in writing within 7 days of the date of invoice. After such period, claims will not be entertained and such failure to notify cannot be used as an excuse for non-payment of the account. If any goods supplied by The Company prove to be defective, the Company undertakes at its option to either replace or refund the price of the goods to the Customer. Under no circumstances will The Company’s liability exceed the cost of replacement or the price paid for the goods.

Return of Goods

The Company is unable to accept return of goods without prior written notifi cation. And only when authorisation of The Company’s Sales Offi ce has been given can goods be accepted. Any goods returned for credit will be liable for the following handling charges. For any goods to be considered for refund they must be currently stocked by The Company and in perfectly merchandisable condition fi t for resale.

0-90 Days - 25% Over 90 Days - 50% Over 180 Days – At The Company’s discretion

Payment

Payment of account are strictly nett and must be made within 30 Days of Month End Statement in which the goods were supplied. Credit Terms offered by The Company are 30 Days for Month End Statement and such terms can be terminated at any time, without prior notice, by The Company whereupon all balances shall become due and owing forthwith.

Pricing

Prices quoted in this catalogue are correct at the time of publication. However, prices are regularly reviewed and subject to change. For information on our current prices please contact our customer service team on 1800 819 189. The prices charged are at the date of dispatch. It is an expressed condition of sale that in the event that The Company has recourse to legal action or debt collection against The Customer in order to obtain outstanding accounts that any costs incurred are payable by the customer on a full indemnity basis and The Company has the right to without notice 2.5% interest per month on an overdue amount for as long as it is overdue.

Irish Law

The contract shall be subject and construed in accordance with Irish Law and all contracts entered into shall be deemed to have been entered into under the jurisdiction of Irish Law.
