Paulina Gonzalez-Brito and CRC My name is Paulina Gonzalez-Brito. I am the Executive Director of the CRC. The California Reinvestment Coalition builds an inclusive and fair economy that meets the needs of communities of color and low-income communities by ensuring that banks and other corporations invest and conduct business in our communities in a just and equitable manner. We envision a future in which people of color and low-income people live and participate fully and equally in financially healthy and stable communities without fear of displacement, and have the tools necessary to build household and community wealth. Over the last 30 years, CRC has grown into the largest statewide reinvestment coalition in the country, with a membership of 300 organizations that serve low-income communities and communities of color. CRC has our main office in San Francisco, and an office in Los Angeles. Introduction In this testimony, I wish to highlight to following points: 1. The ability of communities to have their voices heard through a fair and transparent public comment process is central to the Community Reinvestment Act and its effective implementation. -

Steven Mnuchin—Secretary of Treasury Mnuchin spent 17 years working at Goldman Sachs, following in the footsteps of his father, former Goldman Sachs partner Robert. E. Mnuchin. At Goldman, Mnuchin was described as “an early player in the mortgage-backed securities market, which was later to figure prominently in the 2008 financial crisis.”1 In 2002, Steven Mnuchin started the private equity firm Dune Capital Management. In 2009, Dune Capital Management created OneWest Bank from assets of IndyMac Federal Bank, which Dune purchased from the Federal Deposit Insurance Corp. Dune Capital sold OneWest to CIT Groupin 2015. Mnuchin’s appointment was strongly condemned by Sen. Elizabeth Warren (D-Mass.), who called Mnuchin the “Forrest Gump of the financial crisis,” and warned that his appointment “should send shivers down the spine of every American who got hit hard by the financial crisis.”2 Much of the criticism of Mnuchin comes from his role overseeing the former OneWest Bank. David Dayen, author of an exposé into mortgage lender practices, explained that even “among the many bad actors in the national foreclosure crisis, OneWest stood out. It routinely jumped to foreclosure rather than pursue options to keep borrowers in their homes; used fabricated and “robo-signed” documents to secure the evictions; and had a particular talent for dispossessing the homes of senior citizens and people of color.”3 PROFITING FROM TAXPAYERS: OneWest made a huge profit on loans it bought from the government at fire-sale prices. OneWest was formed out of assets of IndyMac, a government-sponsored housing lender that was sold off during the Great Recession. -

Written Testimony of Orson Aguilar, Executive Director, The Greenlining Institute CIT Group/OneWest Joint Public Meeting Held by the Federal Reserve and the Office of the Comptroller of the Currency February 26, 2014 Greenlining is in strong opposition to the proposed OneWest/CIT merger. The story behind this merger reminds me of a Spanish Telenovela. Its hard to belieye this is real. •. CIT, a bank who failed to repay its bailout funds, now has enough money to buy a bank. Needless to say, the $2 billion it received in TARP funds never did reach small businesses, let alone minority-owned small businesses. John Thain, the same guy who was spending millions of dollars to decorate his office at Merrill Lynch during the height of the housing crisis is now the guy in charge of CIT. This is the same John Thain who misled BofA about Merrill Lynch's position while he distributed $3.5 billion in bonuses to top Merrill executives. All of this occurred while families were losing their homes, people were losing their jobs, and retirees witnessed their retirement savings dwindle. On the other end we have OneWest bank, a bank that emerged from the ashes of the failed IndyMac bank. IndyMac, a notorious subprime lender, is the 2nd largest bank failure in American history. Our government sold lndyMac's assets to a group of billionaire investors for an estimated $2.5 billion. Buying a failed bank is a risky bet but it definitely helps when the federal government agrees to cover billions of dollars in losses. Let me tell you about OneWest, a bank the bank did little to serve people of color and low income communities. -

OneWest/CIT Merger Fabricated Email Inquiry Freedom of Information Act (FOIA) Response DOCUMENTS OBTAINED BY CRC AND INNER CITY PRESS SHOW BANK WHICH FORECLOSED ON 36,000 CALIFORNIA HOUSEHOLDS DOES NOT EXPLAIN HOW FABRICATED LETTERS OF SUPPORT FOR BANK MERGER WERE GENERATED New information obtained from the regulator of national banks, the Office of the Comptroller of the Currency (OCC), raises a number of questions about the agency’s oversight of OneWest Bank, which was acquired by CIT Bank in 2015 in a merger approved by the OCC and the Federal Reserve Board of Governors. The data, obtained via a Freedom of Information Act (FOIA) request, show evidence of fraudulent email letters of support for the merger, and other troubling information about the bank. Information provided by the OCC confirms that the national bank regulator was aware that certain letters of support for the OneWest/CIT bank merger were fabricated, and sought a response from the bank and its counsel. The FOIA response did not include any answer from the Bank to the OCC’s question. The FOIA response also indicated certain consumer complaints and improper foreclosures practices.
