American Quarter Horse Association 1600 Quarter Horse Drive Amarillo, TX 79104 | Customer Service (806) 376-4811 Multiple Embryo Since the American Quarter Horse Association (AQHA) rule change allowing more than one foal (multiples) to be registered out of a mare in the same year, it is not possible for AQHA/or the sale catalog company to know how many live foals a mare has produced each year. PLEASE NOTE: The fact that a foal which is an embryo transfer does not necessarily mean it is one of multiple foals. The fact that a foal was born naturally out of a mare does not necessarily mean it is a single foal. Neither AQHA nor Sale Catalog Company will be held responsible for providing information as to multiple embryos (foals of the same year) out of mares or dams in sale; nor will they be held liable in any way for buyer’s belated awareness of such information. Embryo Transfer status of sale entries may be announced at the sale. BUYERS PLEASE LISTEN CLOSELY FOR ANNOUNCEMENTS AT THE SALE. Announcements always pertain to information that is NOT on the catalog page. Awareness of such announcements is the buyer’s responsibility. Settlement Procedures FIRST - SALE TICKET; At the conclusion of bidding on each lot, the successful bidder will immediately complete and execute the Sale Ticket presented by the clerk. The Sale Ticket is not transferable without the approval of AQHA and the copy retained by the buyer must be presented by the buyer at the time of settlement. SECOND – PAYMENT OF ACCOUNT; Not later than one (1) hour after the conclusion of the session in which an animal is purchased, each buyer will make payment of the full purchase price for the animal to AQHA. Payment will be made by United States currency, bank wire, certified check, money order, or traveler’s check, unless credit is approved by AQHA. THIRD - CREDIT APPROVAL; The Approval of AQHA is required for all checks and funds which are not certified by a United States bank. Prior approval of credit may be obtained by delivery of an irrevocable letter of credit, banker’s letter of reference or Request for Credit Verification to AQHA. Prospective buyers are requested to notify their bank that AQHA will contact the buyer’s bank for credit confirmation. PROSPECTIVE BUYERS ARE URGED TO OBTAIN PRIOR CREDIT APPROVAL TO AVOID DELAYS ON SALE DATES. 4 WORLD SHOW SALE FOURTH – ORDER FOR DELIVERY; After payment of the buyer’s account in full, AQHA will issue to the buyer an Order For Delivery, possession of which will permit removal of the animal from the stables after payment of all applicable charges. Buyers are cautioned not to lose the Order For Delivery and AQHA assumes no responsibility for any delivery made on presentment of an Order For Delivery. FIFTH – AGENT’S AUTHORIZATION; Persons acting as agents must so indicate on the Sale Ticket and file an Agent’s Authorization in form satisfactory to AQHA simultaneously and settlement of the buyer’s account. SIXTH – EXPENSES; All expenses relating to the animal incurred by AQHA after the hammer falls will be paid by the buyer. All accounts not paid within ten (10) days after the date of sale will bear interest at the rate of eighteen percent (18%) per annum. All court costs, filing fees, expenses of collection (including reasonable attorney’s fees) and all expenses of insuring, maintaining, transporting or reselling any animal incurred by the consignor or AQHA arising from the buyer’s default will be paid by the buyer. ALL PURCHASES MUST BE PAID FOR IN CASH AT TIME OF SALE. HORSES PURCHASED MUST BE MOVED FROM THE SALE PREMISES BY 12:00 NOON, MONDAY, NOVEMBER 18, 2013. Sale Conditions FIRST – All transactions between the buyer, consignor and AQHA will be governed by the laws of the State of Texas. EXCEPT AS EXPRESSLY PROVIDED IN CONDITION SEVEN, EACH HORSE OFFERED IN THIS SALE IS SOLD AS IS AND WITH ALL DEFECT. The right to bid, as provided under law, is reserved by all consignors. AQHA reserves the right to reject any and all bids. SECOND – BIDDING PROCEDURE; Unless waived by announcement, there shall be an upset price of $500 on any animal entering the sales ring. If an opening bid in the amount of the upset price is not immediately forthcoming to the auctioneer’s call, the animal shall be passed out as unsold. The highest bidder shall be the buyer. The right to bid is reserved by all consignors. Successful bidder shall forthwith sign the Acknowledgement of Purchase; should Acknowledgement of Purchase not be presented to him for signature prior to commencement of bidding on the next lot offered, he shall forthwith identify himself to auctioneer as purchaser, and sign Acknowledgement of Purchase when presented. Right of purchase of successful bidder is not impaired in case of signing of Acknowledgement of Purchase by another, provided that such bidder acts in accordance with THIS CONDITION OF SALE and CONDITION OF THIRD below. THIRD – BIDDING DISPUTES; Should any dispute arise between or among two or more bidders, the auctioneer shall forthwith adjudicate the dispute, and his decision shall be absolute, final, and binding on all parties. Bids received after the fall of the hammer are not grounds for dispute. Bids acknowledged by bid spotters employed by the undersigned are recognized as if tendered to auctioneer, but in case of dispute the bidding on the horse shall be forthwith reopened for advance bids, and if there be no advance, the horse will be sold to the person from whom the auctioneer recognized the last bid In case of any dispute, advance bidding shall be restricted to the contending parties, but should the recognized bid be reduced below the bid of commencement of dispute, then bidding is reopened to all bidders, regardless of whether or not final bid exceeds bid which was disputed. The auctioneer reserves the right to reject any and all bids. In the event of any dispute between the buyer and the consignor, AQHA will occupy the position of agent for a disclosed principal and stakeholder and will be discharged from all obligations owing to the consignor or buyer on delivery of any property or funds held by AQHA to the court having jurisdiction of such dispute. FOURTH – TITLE RISK AND DELIVERY; Title passes to purchaser at fall of hammer, at which time he assumes all risk and responsibility for the horse. PURCHASER OR HIS REPRESENTATIVE SHALL TAKE CARE, CUSTODY AND CONTROL OF THE ANIMAL IMMEDIATELY AT THE FALL OF THE HAMMER, and such taking constitutes delivery of the animal, which shall be contingent upon purchaser presenting himself to the cashier of the undersigned to make settlement. Purchaser must so present himself within one hour of conclusion of the sale session in which the horse is sold, at which time delivery will be made in form of an “Order For Delivery” for the horse, provided that purchaser satisfactorily makes settlement. After delivery, purchasers shall remove horses promptly, and shall be subject to stable charges as determined by undersigned, should they fail to do so. The buyer further agrees to indemnify and hold the consignor and AQHA harmless from all loss, cost and expense arising from the illness, injury or death of such animal or loss or damage to property and injury or death of persons caused by the buyer, the buyer’s agents or employees or by the animal subsequent to the time of purchase. FIFTH – TERMS FOR SETTLEMENT, MAKE SETTLEMENT WITH CASHIER OF AQHA PAYMENT TO OTHERS, INCLUDING CONSIGNORS OR THEIR REPRESENTATIVE ARE NOT RECOGNIZED AS SETTLEMENT. Purchaser shall make settlement WORLD SHOW SALE 5 within one hour of conclusion of sale session in which the horse is sold for the full purchase price, such settlement to be in the form of U.S. currency, certified check, traveler’s check or approved bank check which has been verified and approved in advance by cashier and/or officer of AQHA.
