ORDER No.C.14011/l/99-IND, the 20 th January, 2009. Whereas a disciplinary proceeding was instituted against Shri R. Ganesan, Superintending Geologist, vide No.C.14?111l:99-IND dt. 2.~.99 for the alleged misconduct of the following 3(three) Article of charges, VIZ Article-I, that Shri R. Ganesan, while functioning as Superintending Geologist, had passed 4(four) false Bills amounting to Rs ,~1 ,950/- for repair ofunservisable direct rotary drilling rig, as indicated by Delivery Challans, and he had manipulated the documents to facilitate drawal and misappropriation of submission of false bills, thereby violate Rule 3, Clause (1)(i) and (iii) of CCS(Conduct) Rules, 1964. In the 2nd Article ofcharges, the charged officer submitted 2(two) false bills amounting to Rs. 4900/- and Rs. 4930/- for repair ofDepartmental vehicle No ZRG-2565 (Van) which remain unservisable for several years. The bills were later withdrawn when the genuiness of the bills were doubted, thereby the charged officer displayed lack ofintegrity and conduct unbecoming ofGovt. servant, and in violating Rule 3, Clause (I)(ii) and (iii) of CCS(Conduct) Rules, 1964. Finally in the 3rd Article of charges, Mr. R.Ganesan has caused loss to the Department to the tune ofRs. 8,44,300/- by making purchase of incomplete computer hardwares and software. Further, he purchased the items from a firm not recommended by the DPAB. Further, he did not take initiative for proper and timely installation of the computer systerr for not procuring two software, viz-Spans and Spans cartographer. As a result the computer system remain inoperative and thereby the changed officer has shown lack ofdevotion to duty and integrity and violated Rule 3 Clause (1)(ii) & (iii) ofCCS(Conduct) Rules 1964. And whereas an inquiry was held on the said allegations and on careful consideration ofthe Inquiry Report, the DiiiplinaryAuthority imposed upon him a penalty ofreduction to a lowest stage in a time scale ofpay 4\Jour) years with cumulative effect, under Rules 11 (V) ofCCS(CCA) Rules, 1965 vide No.C.1401 i/1/99-IND dt. 28.2.2001.

And whereas t?e ;ai.d R. Ganesan had preferred an appeal under Part-VII of CCS(CCA) Rules, 1965 for reconsideration ofthe penalty imposed upon him. After careful consideration ofhis R-4/2009 16 poi?ts of ap~eal and the Inquiry Report, it is established that the Inquiry Officer did not prove ArtIcl.e-I against the changed Officer. The Inquiry Report clearly indicated that none ofthe witness examined could give any statement in support of the charge in Article-I. The verv mechanic Vanla!tluanga, who checked and received materials, stated that the repair work was done with parts supphe~ by United Engineering Works. If such repair works was done, it implies that there were mechanical defects which might have rendered direct rotary drilling rig unservisable necessitatinu its repair to make it servisable. Therefore, the Inquiry Officer held that Article- I is not established. l;~ the sec~n~ A~icle of charge, the work order for repair of Van No.ZR G-2565 was prepared by the mechanic mills own hand writing on 12.6.98, and the Appellant has approved it on 25.10.98 Proposa for sanction was put up to the appellant duly vetted by FAO. There was no irregularity in sanctioning the said Bills as the said Bills were put up to the Appellant by the concerned Dealing Assistant through FAO, which is the normal practice. When the Appellant came to know that the bills were n01 genuine, he had taken corrective step by withdrawing the 2(two) bills in question from Treasury, The Appellant did not commit any irregularity and neither the Govt. suffered any loss on that count. Hence, the question ofnot maintaining absolute integrity and acting in a manner unbecoming of a Govt. servant as was held by the Inquiry Officer does not arise. Thirdly, the Inquiry Officer did not establish that the Appellant had caused loss ofRs. 8,54,300/- as the Appellant had actually procured computer equipments and software from a firm as was recommended by DPAB. In the meanwhile. the Inquiry Officer held the Appellant responsible for delay in installation oftwo softwares rendering the computer system inoperative and held the Appellant to have acted in a manner unbecoming 0 f a responsible Govt. servant. On careful consideration ofthe circumstances which resulted in delay in the installation of hardware & software, there are material evidence to indicate that the Appellant Oficer had taken measures for proper installation ofthe equipments so purchased, and there is no malafide intention on the part ofthe Appellant is established. Therefore, it is unjust and incorrect to implicate the Appellant that he had deliberately delayed the installation of the system. There are circumstances beyond Appellant's control. Which were also known to the other officers of the Department including Dr. H. Lallenmawia. Therefore, to single out the Appellant for the ~~Iay. in installation ofthe system will not be in the interest offairness and will amount to travesty at Justice and principles of equity. The Governor ofMizoram, therefore, came to a conclusion that charges against the Appel­ lant have not been convincingly established and the penalty imposed upon the Appellant undeJ~~ule 11 ~ v) ofCCS(CCA) Rules, 1965 was too severe and not commensurate with the gravity of offence committed by him. Now therefore, the Governor of Mizoram, inexercise of the power under Rule 23 and Rule 27 (3) CC'S(CCA) Rules, 1965, is pleased to revoke, with immediate effe~t, the penalty imposed upon the said Shri R. Ganesan, under Rule 11 (v) of CCS(CCA) Rules. 1965. The Governor of Mizoram is further pleased to order that the period ofsuspension of Shri R.
